Commissioner Updates Commissioner Scherr shared that there would be a ribbon cutting for the Eagle Valley Trail expansion in Dotsero. The cost to complete the trail was nearly$24 million, and the goal was to collect$22 million dollars and have the trail completed by 2025. If anyone wished to help fund the project,they could visit the county website and look for the ECO Trails Fundraising popup. Chairman McQueeney stated that she had no updates. Commissioner Chandler-Henry stated that she had no updates. County Manager Updates Jeff stated that he had no updates. Consent Agenda 1. Resolution 2022-056 of Approval for AFP-009189-2021 -Amended Final Plat for 43 Borders Road Julie Pranger, Engineering 2. Resolution 2022-057 Approving the Format for the 2022 General Election Intergovernmental Agreement and Authorizing the Clerk&Recorder to Execute the IGA with Coordinating Entitles Regina O'Brien, Clerk's Office 1 07/12/2022 3. Second Amendment to the Agreement Between Eagle County and the Town of Eagle for Use, Operation and Maintenance of the Eagle River Park at the Eagle County Fairgrounds Property Christina Hooper,Attorney's Office 4. May 2022 Payment Report Jill Klosterman, Finance Commissioner Scherr moved to approve the Consent Agenda for July 12,2022 as presented. Commissioner Chandler-Henry seconded the motion. The vote was declared unanimous. Commissioner Scherr moved to adjourn as the Board of County Commissioners and reconvene as the Eagle County Housing and Development Authority. Commissioner Chandler-Henry seconded the motion. The vote was declared unanimous. Eagle County Housing and Development Authority 1. Site Lease and Development Agreement Between Colorado Mountain College and Eagle County Housing and Development Authority Jill Klosterman,Finance Executive Summary: ECHDA has been working with Colorado Mountain College to add an additional building to its Edwards Campus. This building will be financed, owned, and managed by Eagle County Housing and Development Authority and the land will be leased by ECHDA from CMC. Tori Franks, Eagle County Resiliency Director,presented a PowerPoint outlining the details of the lease agreement with Colorado Mountain College (CMC). She was joined by Dr. Carrie Besnette Hauser,President of CMC. She elaborated on the partnership,buildings, and updates on cost and timing. The goal was to construct two buildings near the Edwards campus. The buildings were almost identical and would provide 36 units. The first building(Building 1)would be owned and funded by CMC, and the second building(Building 2)would be owned and funded by the Housing Authority on land leased by CMC. Building 1 would be occupied by CMC staff and students, and Building 2 would provide housing for Eagle County Government employees and eligible households. Building 2 would have a permanent deed restriction on it to protect the investment moving forward. CMC would remain the landowner for all the land and continue to lead the construction and design process. Building 1 would be ready for occupancy in September of 2023, and Building 2 had a target start date of August 31 and available for occupancy in October or November of 2023. There was a request for$11 million on the agenda to fund the construction of Building 2. Dr. Besnette Hauser recognized the CMC Board of Trustees as well as the elected officials who acted quickly on this opportunity. Commissioner Chandler-Henry believed this was a great partnership and asked Ms. Franks to elaborate on the source of the funding. Ms. Franks stated that the funding would be coming from the Housing Authority which was funded by the proceeds of the sale of Lake Creek Village Apartments. The project would be funded in cash,but if the Housing Authority ever needed to refinance or finance the cost of Building 2, it would be subordinate to CMCs option to purchase. Commissioner Scherr expressed excitement for the opportunity and participation. Chairman McQueeney was impressed with the work and leadership. 2 07/12/2022 Commissioner Scherr moved to approve Site Lease and Development Agreement Between Colorado Mountain College and Eagle County Housing and Development Authority. Commissioner Chandler-Henry seconded the motion. The vote was unanimous. Commissioner Scherr moved to adjourn as the Eagle County Housing and Development Authority and reconvene as the Eagle County Board of County Commissioners. Commissioner Chandler-Henry seconded the motion. The vote was unanimous. Business Item(s) 1. Resolution 2022-058 Approval of the 3rd Supplemental Budget 2022 Jill Klosterman, Finance Anna Earl, Eagle County Finance Manager,presented the supplemental request. There were two items totaling $13 million dollars. The first was for$1.5 million from the General Fund to support and fund the "Workforce Support Program,"approved last week. The second item was the$11.5 million for the CMC partnership/Building 2. The total dollar amount leftover in the General Fund after the $1.5 million would be$32 million and in the ECHDA account there would still be a fund balance of$59 million. Commissioner Scherr moved to approve the resolution approving the 3rd Supplemental Budget 2022. Commissioner Chandler-Henry seconded the motion. The vote was declared unanimous. 2. Resolution 2022-059 Regarding Presentation of Reports of Valuation for Assessment of Taxable Real and Personal Property and List of Actions on Eagle County Real and Personal Property Appeals to the County Board of Equalization Mark Chapin,Assessor's Office Mr. Chapin presented the pre-assessor level appeals and post-assessor level appeals. He stated that this was a record low appeal year for his office and Eagle County. He stated that residential properties were going up at the rate of 2%per month for the last two months. Commercial properties were also in line with those values. The value of real taxable property,personal property and exempt property totaled$3,944,729,510. The post assessor level appeals dropped to $3,940,729,600, of which 138 real property accounts were appealed; 35 were appealed rendering a loss of$3,916,960. Commissioner Scherr moved to approve the resolution regarding the presentation of reports of valuation for assessment of taxable real and personal property and list of actions on Eagle County real and personal property appeals to the County Board of Equalization Commissioner Chandler-Henry seconded the motion. The vote was declared unanimous. Eagle County Housing and Development Authority - Joint Meeting 1. Eagle County Housing and Development Authority Board with the Advisory Committee bi-annual meeting Public Hearing - Eagle County Room 3 07/12/2022 1. First Hearing-An Ordinance Repealing Eagle County Ordinance No. 92-01 and Eagle County Ordinance No. 06-01 and Prohibiting Smoking and the Use of Electronic Smoking Devices in Public Places,Places of Employment and Other Places of Interest in Unincorporated Eagle County Executive Summary: Eagle County is updating its Smoking Ordinance to reflect legislative changes made through the Colorado Clean Indoor Air Act and Colorado Revised Statutes 18-1.3-503 and 30-15-401.The revised Smoking Ordinance will repeal previous ordinances,but ensure that smoking in Eagle County remains regulated through state law and County-specific provisions that broaden the scope of the prior ordinances to include vaping. If passed,the revised Smoking Ordinance will apply throughout unincorporated Eagle County. Matt Peterson,Assistant Eagle County Attorney, stated that currently the county had two applicable ordinances to regulate smoking within unincorporated Eagle County. At the time those ordinances were enacted, they had done a great deal to reduce the risk of second hand smoke and both had been successfully enforced and implemented without issues. However,the Attorney's Office was recommending that the board repeal and replace those ordinances in favor of today's proposed ordinance. The purpose of revising the ordinance was to insure the county ordinance did not conflict with the"Colorado Clean Indoor Air Act"and to insure that the ordinance included the correct legal penalties as recently updated by the state legislature. His office had worked closely with Ms. Ivanov from Public Health to ensure that the new ordinance would be as strict as the current ordinance. The new ordinance would also confirm that vaping or the use of electronic smoking devices would be covered. To enforce the ordinance, it must be first introduced and read at a special meeting,which was the purpose of today's hearing. Public notice had been provided through publishing in the Eagle Valley Enterprise on June 30,2022 and July 7, 2022. Once the ordinance was introduced,the full text of the ordinance would be published in the newspaper 10 days prior to adoption. Today's hearing was simply an introduction of the ordinance. If the board wished to move forward,the board may move to publish the ordinance in full. He proposed August 16, 2022 as the next hearing date. Public comment would be accepted at that time. State Statute required that the full title be read into the record. Commissioner McQueeney thanked everyone for their hard work on this ordinance. Mandy Ivanov, Policy&Partnerships Manager for Eagle County Public Health, expressed support for the ordinance. She explained the offerings available through the"Quitline." She stated that the program had evolved over the years, and now youths down to the age of 16 could access the program. Commissioner Scherr read the title into the record and directed the Attorney's office to publish the proposed ordinance in full in the paper at least 10 days prior to the next meeting.
