ZS -00017 WHEREAS, The Jeep Division of the.ChlXsler CoMo ation ( "Applicant ") did file an application with the Eagle County Department of Community Development on or about january 15.1997 for a Special Use Permit for: A Mass Gathering, pursuant to Section 2.06.01(3)g), at the southeastern end of Camp Hale on August 1, 2 & 3, 1997. The intent is to provide Jeep owners with a 4 -wheel drive experience with an emphasis on the environment through education and entertainment. a Organized activities will be mountain biking, hiking, 4 x 4 trail trips, 4 x 4 instruction, fly fishing, guest speakers, art fair, local entertainers, fitness stations, various displays such as Jeep & Mopar products, supplies & engineering, Tread Lightly°, U.S. Forest Service, Vail Valley Tourism & Convention Bureau, Minturn Fire Dept., Red Cross, recycling, Camp Hale and Jeep history and a Saturday evening concert. Water will be brought in by truck. Food & beverage service will be catered and sewage disposal services will be provided by a licensed portable toilet company. First aid, search and rescue, fire prevention and security will be provided on -site. Traffic control will be contracted with state and local law enforcement agencies. Attendance is by invitation only and will be limited to a maximum of 1500 jeeps. The estimated attendance is about 4500 people. The event is planned to encompass the 71 acre area known as the rifle range and the meadow directly east. The Saturday evening concert will begin at S:OOpm and end at 8:OOpm, within a Resource Zone District, in the unincorporated area of Eagle County described as follows: Seventy-one acres included within: Range 80 West, Township. 7 North, Southeast K Section 24 and 111111111111111111111111111111111111111111111111111111 628645 07/22/1997 05:09P 8732 P687 1 of 3 R 0.00 D 0.00 Sara J Fisher, Eagle, CO WHEREAS, based on the evidence, testimony, exhibits, study of the Master Plan for the unincorporated areas of Eagle County, comments of the Eagle County Department of Community Development, comments of public officials and agencies, the recommendation of the Planning Pagel of 3 - . A , f Commission, and comments from all interested parties, the Board of County Commissioners of the County of Eagle, State of Colorado ( "the Board "), finds as follows: That proper publication and public notice was provided as required by law for the hearings before the Planning Commission and the Board. 2. That the proposed special use conforms to the requirements of Section 2.09 of the Eagle County Land Use Regulations, which are incorporated herein as if set forth with particularity. 3. That the proposed special use will be compatible with existing uses in the area. 4. That the following have been considered: The potential effect of the use on the character of the neighborhood, adequacy of access to and from the area, appropriateness of the physical arrangement of the use on the proposed site, and consistency with the Master Plan. That for the above - stated and other reasons, the proposed special use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Eagle County. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: That the application of the Jeep Division of the Chrysler Corporation , File No. ZS- 00017, for a Special Use Permit for a Mass Gathering (Section 2.06.01(3)g) within the Resource Zone District described herein, be approved, subject to the conditions as set forth herein. THAT, the following conditions shall be placed upon this approval and that violation of any condition shall be the basis for revocation of the Special Use Permit: I . All water, food service and sanitation, including sewage and trash disposal provisions shall be subject to inspection and approval by the Eagle County Environmental Health Division prior to, during and immediately following the event; 2. A fifty (50') setback from the Eagle River shall be maintained for any improvements; 3. Event organizers shall comply with building code and safety requirements that may apply to buildings or structures erected on -site (e.g. stage); 4. Any liability insurance required by the U.S. Forest Service shall include Eagle County held harmless; 5. All material representations made in this application and in hearing shall be considered as conditions of approval. 6. The applicant shall cause to be submitted to staff for Planning Commission and/or Board review, the proposed final report that documents and analyzes any environmental impacts within 90 days of the conclusion of the event. 7. Appropriate measures shall be taken to manage storm water runoff. 8. The applicant agrees to accept provision of the CDOW and the Forest Service. Page 2 of 3 9. All material representations made by the Applicant in the application and public meeting shall be adhered to and considered conditions of approval, unless otherwise amended by other conditions. THAT, this permit shall be subject to periodic review by the Planning Department, and shall be heard by the Board of County Commissioners only if complaints are received and not satisfactorily resolved by the staff. THAT, the Board of County Commissioners directs the Department of Community Development to provide a copy of this Resolution to the Applicant. THAT, the Board hereby finds, determines and declares that this Resolution is necessary for the health, safety and welfare of the citizens of Eagle County.
