(hereinafter "Applicant ") for approval of the
Subdivision

WHEREAS, the Applicant requested the approval
of a

Subdivision Sketch Plan which would allow for the
development as

WHEREAS, notice of the Sketch Plan was given
to all proper
= m "
agencies and departments as required by the Eagle
County Land Use
Regulations, Section 2.17.02(1); and,
WHEREAS, at its public hearing /hearings held 5/22/97
the Planning Commission, based upon.its findings,
recommended approval of the proposed Subdivision Sketch Plan,
with certain conditions; and

WHEREAS, at its regular hearing /hearings of 6/17/1997
the Eagle County Board of Commissioners (hereinafter
"Board "), considered the Subdivision Sketch Plan, associated
plans, and the statements and concerns of the Applicant, the
Eagle County Community Development and Engineering staff, and
other interested persons.
BASED ON THE EVIDENCE BEFORE IT, and with the modifications
imposed by the conditions hereinafter described, THE BOARD FINDS
AS FOLLOWS:
1. The proposed Sketch Plan is in conformance with the
Master Plan, policies, guidelines, zoning and other
applicable regulations.
2. The land included in the proposed Sketch Plan is
suitable for subdivision.
3. Comments and recommendations from the agencies listed
in Eagle County Land Use Regulations, Section
2.17.02(1), have been considered.
4. The evidence shows that access which is capable of
servicing the development from the state highway system
to the parcel of land proposed for subdivision can be
built by the Applicant.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the application for approval of the Subdivision Sketch
Plan for Souris Mesa Subdivision be and is hereby
granted, subject to compliance with the following conditions:
1/ The Central Ranch shall be reserved as open space utilizing
dedication to a land trust with the water rights tied to the

land;
2/ The site shall be designed so as to provide open space access
connection with that which is already platted in other Aspen
Mountain View filings;
3/ The applicant shall work with the Icing's Row Homeowner's
Association concerning the provision of reasonable trail
easements;
4/ The provision of water shall only be through the existing
Aspen Mountain View system which may mean necessary repairs and
improvements. Any additional concerns of the Homeowner's
Association shall be prudently addressed;
5/ A 1041 application shall be submitted prior to the preliminary
plan;
61 A wildlife mitigation plan shall be prepared by a qualified,
independent party and recommendations be included in the
preliminary plan, which shall include revegetation for area elk
as approved by the Division of Wildlife;
7/ In addition to the County Engineer's concerns outlined in the
memo to staff dated February 20, 1997, the required traffic study
prepared by a qualified, independent consultant shall include a
determination of the carrying capacity of the E1 Jebel Hill Road
(Upper Cattle Creek Road) and Fender Lane;
8/ Building envelopes shall be proposed with greater clustering,
and positioned to provide for elk movement and to protect the
conditions of the hillside;
91 The proposal should be included within the `Aspen View Acres
Homeowner's Association';
10/ The Basalt and Rural Fire Protection District shall be
consulted and comments received for preliminary plan submittal;
11/ Efforts be made to address Electro- Magnetic Field (EMF)
mitigation by location of the envelopes in the SW portion of the
subdivision;

12/ Applicant will submit a plan for maintaining the existing
riparian lands, ponds, and ditches, as applicable;
13/ Applicant will investigate making a connection with Harmony
Road.
THAT, the Sketch Plan submitted under this application and
hereby approved, does not constitute a "site specific development
plan" as that phrase is defined and used in C.R.S. Section
24 -G8 -101, et seq. Sketch Plan approval is expressly conditioned
on the County's authority to impose further restrictions or
limitations on the Subdivision which are necessitated by impacts
which are not yet recognized or which are more severe than
realized under the review given at the hearings on the Sketch
Plan.
THE BOARD further finds, determines and declares that this
Resolution is necessary for the health, safety and welfare of the
inhabitants of the County of Eagle, State.of Colorado.
