APPROVAL OF A SPECIAL USE PERMIT
AGRIGULTURAL AND RESOURCE ZONE USES &
GRAVEL EXTRACTION AND LIMITED PROCESSING

WHEREAS, B & B Excavating, Inc.(sometimes referred to herein as
"Applicant "), filed an application with the Eagle County Department
of Community Development on or about November 28, 1996, for a Special
Use Permit for a 199.36 acre (more or less) site owned by Dr. Warren
Jacobson, as particularly described on Map Exhibit 4 (Boundary Map
B &B Gravel Exctraction Boundary, July 22, 1994) to the Application
and Exhibit "A" attached to this resolution, both of which are
incorporated herein by this reference, located in a Resource Zone
District in unincorporated Eagle County, to allow (a) uses permitted
in the resource zone district regulations on approximately 170 acres
and (b) an Industrial Use and Operation for gravel extraction and
limited processing'on a 29.2 acre site (named and referred to herein
as the "Hidden Valley Pit" site) described in the Limited Operation
Mining Plan, Map Exhibit 5 (dated December 1994, revised May 13,
1997) to the Application and Exhibit "B" attached to this resolution,
both of which are incorporated herein by.this reference; and
WHEREAS, based on the application and the evidence, testimony,
exhibits, study of the Master Plan for the unincorporated areas of
Eagle County, comments of the Eagle County Department of Community
Development, comments of public officials and agencies, the
recommendation of the Planning Commission rendered in a public
hearing held on October 15, 1997, and comments from all interested
parties, the Board of County Commissioners of the County of Eagle,
State of Colorado ( "the Board "), finds as follows:
Proper publication and public notice was provided as required
by law for the hearings before the Planning Commission and the
Board.
2. Pursuant to Section 2.09.01,
a) The application conforms to all requirements of the
Resource Zone District regulations;
b) Utilities adequate to provide water and sanitation service
based on accepted engineering standerds and approved by the
County Environmental Health officer and the Colorado State
Department of Health are either in place or to be constructed
in conjunction with the proposed Hidden Valley Pit site;
c) Street improvements adequate to accommodate traffic volume
generated by the proposed use and to provide safe, convenient
access to the use are either in place or to be constructed in
conjunction with the proposed use;

d) A detai `�d site plan of the Hidden ".11ey Pit site, drawn
to scale s JOing all physical feature_.Ind final design and
plan will be provided;
e) Technical reports as necessary to determine the feasibility
of the proposed project have been submitted,
f) Justification that the proposed special use will not be
detrimental to the character of the neighborhood -and is
consistent with the Master Plan has been.submitted;
g) An environmental impact report was submitted.
3. Pursuant to Section 2.09.02(6), the use shall be designed and
operated in compliance with all applicable laws and
regulations and shall not adversely affect
a) Existing lawful use of water through depletion or pollution
of surface run -off, stream flow or groundwater;
b) Use of adjacent land through generation of vapor, dust,
smoke, noise, glare, vibration or other emanations; or
C c) Wildlife and domestic animals through creation of hazardous
0 attractions, blockade of migration routes or patterns or other
e means.

2.09.03.

C4 5. Pursuant to Section 2.09.04(1), the following have been

6. That for the above - stated and otter reasons, the proposed
special use is in the best interest of the health, safety,
convenience, order, prosperity and welfare of the citizens of
Eagle County.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS
OF THE COUNTY OF EAGLE, STATE OF COLORADO:

THAT, the applir "ion of B & B Excavating, , File No. ZS-
00004, for a Spec-_,I Use Permit for Gravel Ex--Action and Processing
within the Resource Zone District described herein, be approved with
the following conditions:
1. This permit will expire 10 years from the date of adoption of
this resolution, that is, from December 15, 1997.
2. No activity may occur on the Hidden Valley Pit site until such
time as the applicant submits the following information and /or
permits to the Community Development Department:

a. A revised legal description and site plan of the 29.2
acre approved permit boundary to be submitted, one copy
24" x 36" and one copy 1111 x 17 ".
b. A copy of the approved MLRB and /or DMG Mining Permit for

the 29.2 acre site;
C. Fire protection plan or service contract from the fire

district;
d. A Storm Water Management Plan (SWMP);

e. Spill Prevention and Control Counter Measures (SPCC);

f. A Dust Suppression Plan, including a fugitive dust plan,
a
mud - tracking pmitigation and diesel emission mitigation;

g. Air Emission Permit;

h. Any required County permits.

The application for state approvals /permits and submission of
plans for state administration (Storm Water Management Plan,
�..
Spill Prevention and Control Counter Measures, Dust

Suppression Plan, Air Emission Permit) must be submitted to

the County's Environmental Health Department simultaneously
�m m
with submission to the state. This applies also to revisions
to such applications /plans and to applications for amendments
to such approvals /permits.
4.
The boundary of the Hidden Valley Pit site must be permanently
staked and no encroachment outside of the boundary will be
permitted for any of the uses approved for the Hidden Valley
Pit site;
5.
This Special Use Permit supersedes the Uses by Right in the
Resource Zone District except as may in the future be approved
by the Board of County Commissioners through the Special Use
Permit process; provided, however, that agricultural uses,
utility distribution facilities and water diversion
structures /ditches as shown on the Site Plan shall be
considered to be a part of this Special Use Permit.
6.
Maximum production permitted under this Special Use Permit is .
50,000 tons per calendar year, with a maximum production of
500,000 tons.

7.
Permitted t'` " °s and Activities on the H` " ----- en Valley Pit site:
a. Site preparation including road construction /access
improvements, topsoil removal and stockpiling, overburden
removal and stockpiling.
b. Aggregate mining and stockpiling, washing, crushing,
conveying, loading, and hauling of aggregate material
mined from the site; importation of raw material to the
Hidden Valley Pit site is not permitted.

C. Drainage improvements such as culverts, sediment ponds
and water tanks /storage. Water storage uses shall

include pumps and surface and subsurface pipelines.

d. Utility lines, including telephone, electricity, propane,
water, generators, and fire protection equipment and

supplies may be placed above or below ground.
e. Reclamation activities such as grading, seeding,

planting, mulching, fertilizing and irrigation.

f. One dwelling unit for caretaker or night watchman may be
placed on the site upon issuance of a temporary housing
permit, ISDS Permit and building permit. The housing

shall be of a temporary nature and be removed at the

expiration of this permit.

g. One scale house and office not to exceed 1,000 square

h. Only equipment that is necessary for the daily /on -going

operation and maintenance of the gravel operation may
remain on the site; the site may not be utilized as a
contractors storage yard without specific amendment to
this permit.
i. Parking of employee or visitor vehicles, as well as
company vehicles required for on -site operations.
j._ Storage of mining and construction equipment and supplies
necessary for the on -going operation of the gravel pit
may occur, however adequate screening is required.
8.
Permitted uses and activities on the balance of the parcel
(170 acres, more or less) are agricultural uses and other uses
by right defined in the regulations governing the Resource
Zone District.
9. B &B Excavating, Inc. (or the successor operator of the Hidden
Valley Pit site) must submit the annual report required by the
Colorado Division of Minerals and Geology to the Department of
Community Development simultaneously with its submission to
the state.
10. Only B &B Excavating, Inc. (or the successor operator of the
Hidden Valley Pit site) employees and trucks, and those of
B &B's contractors, shall be used to haul materials from the
site; no "over- the - counter" or retail sales of gravel or
gravel products will be allowed.

11.
Lighting on-the Hidden Valley Pit site--shall be limited to
flush moun'` `3, down -cast lighting loc2 d on the scale
house /offices rand the caretaker unit. 'Temporary (up to 60
days) security lighting may be installed upon written
complaint to the Eagle County Sheriff of vandalism, theft or
other criminal activity. A copy of the complaint must be
received by the Department of Community Development prior to
the temporary lighting being used, and if the temporary
lighting is necessary for more than 60 days, it must be
approved by the Board of County Commissioners in a public
hearing after proper public notice is provided.
12.
Limitations on hours of operation are'7:30 am to 5:00 pm
Monday through Friday during Mountain Standard Time and 7:30
am to 5:30 pm during Mountain Daylight Savings Time. Further,
no loaded or unloaded trucks may ingress or egress the Hidden
Valley Pit site 30 minutes prior to, nor 5 minutes after,
scheduled school bus passes.
13.
Operations shall not be permitted at the following times:
a. New Years Day e. Thanksgiving Day
b. Memorial Day f. Christmas Eve
C. July Fourth g. Christmas Day
d. Labor Day h. The day before the first day of
each session of rifle hunting
season
14.
The Hidden Valley Pit site operations must comply with the
Eagle County Industrial and Commercial Performance Standards,

or more stringent standards subsequently adopted.

B &B Excavating, Inc. (or its successor operator) will educate

all drivers ingressing or egressing the site on the following:

a. The prohibition of the use of Jake Brakes on the Colorado

River Road, except in emergency situations where property
damage or damage to life and limb may occur.

b. Speed limitations on Coffee Pot Road, Colorado River Road

and Highway 6 at the I -70 Dotsero ramps.

C. A schedule for vehicle and equipment maintenance must

occur so that both noise levels and safety factors are

considered. This includes muffler noise from trucks.

The Department of Community Development will complete an

annual review (site inspection) to assure compliance with all
conditions and representations related to the approval of this

special use.

17.
The number of truck trips will not exceed 170 per day, however
at no point may the total vehicle passes exceed 7,800
annually.
18. B &B Excavating, Inc. (or its successor operator) shall develop
and maintain a detailed policy guide and procedure manual
outlining fire, health, emergency, safety and welfare of
employees and surrounding residents and visitors to the area.

This guide p�3,11 be formulated with the -Ad of the surrounding

property owner, as well a submission of "a copy of the guide to
the Department of Community Development. B &B will meet, upon
request, with local residents to discuss concerns.
19. All material representations made by the Applicant in the
application and public meeting shall be adhered to and
considered conditions of approval, unless otherwise amended by
other conditions.
20. Visual impact will be mitigated in the following manner:
a. Disturbed areas will be reclaimed as soon as practicable,
with vegetation species and densities designed to blend with
the surrounding area. The required reclamation plan will
provide additional detailed information regarding reclamation.
b. If visible from surrounding areas,_ buildings shall be
painted with colors designed to minimize visual intrusion onto
the surrounding area.
21.
B &B Excavating, Inc. (or the successor operator of the Hidden
Valley Pit site) will participate in the cost of maintenance
aand
improvements to Colorado River Road necessary to mitigate
m
the impact of the additional truck traffic generated by the
proposed special use. The impact will be assessed by an

inspection of Colorado River Road by the County Road & Bridge

Department prior to commencement of the special use, with
a
annual inspections at the conclusion of each year's

operations.

Hauling operations will not be permitted during the frost

season when the road bed is determined to be unstable for

truck traffic. The frost season normally occurs in March or

April. The Eagle County Road & Bridge Department shall make

to the Eagle County Engineering Department on the bridge over

Creek for the purpose of determining its load rating and

maintenance requirements.
24.
To improve turning movements for trucks, B &B Excavating, Inc.
(or the successor operator of the Hidden Valley Pit site) will
fund an engineering study for the purpose of improving the
access at the intersection of Coffee Pot Road and Colorado
River Road. Improvements to the intersection recommended by
the study and approved by the Eagle County Engineering
Department, such as widening or adjustment of the Coffee Pot
Road or the cattle guard, must be constructed at the expense
of B &B Excavating, Inc. (or the successor operator of the
Hidden Valley Pit site) prior to the.commencement of the
special use. In the event that the study recommends
replacement of the Deep Creek bridge, the cost of the
planning, engineering and constructing the bridge will be
borne by a group comprised of the B &B Excavating, Inc. (or the

successor operator of the Hidden Vallev,Pit site), Eagle
County, an( ther industrial and comme "al users of the
bridge.
25. Traffic signs for Colorado River Road and Coffee Pot Road made
necessary by the proposed special use will be designated by
the Eagle County Engineering Department, installed by the
Eagle County Road & Bridge Department, and paid for by B &B
Excavating, Inc. (or the successor operator of the Hidden
Valley Pit site).
26. B &B Excavating, Inc. (or the successor operator of the Hidden
Valley Pit site) will improve Coffee Pot Road from Colorado
River Road to the entrance of the proposed special use at its
expense. This portion of the road will be widened to a
minimum of 22' wide travel lanes with 2' shoulders except in
those areas where a narrower width may be necessary for
environmental,.right -of -way,. or other design considerations
acceptable to the Eagle County Engineering and Road and Bridge
Departments. The surface will be chemically treated road
base. The chemical treatment will be applied twice annually
at a rate 0.5 gallons per square yard.
27. Gravel hauling will be suspended for four hours during each
check -in time and check -out time for the opening and closing
sessions of Anderson Camps, provided that there be no more
than 8 suspensions during a calendar year, and provided
further that the Camp gives both the Department of Community
Development and B &B Excavating, Inc. (or the successor
operator of the Hidden Valley Pit.site)) a schedule of those
check -in and check -out times for which it desires suspension
reasonably in advance of those times.
THAT, the Board of County Commissioners directs the Department of
Community Development to provide a copy of this Resolution to the
Applicant.
THAT, the Board hereby finds, determines and declares that this
Resolution is necessary for the health, safety and welfare of the
citizens of Eagle County.
