OF THE
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 9Y -_,y
APPROVAL OF THE
COMBINED SKETCH AND PRELIMINARY PLAN OF THE
CHADWICK MINOR PLANNED UNIT DEVELOPMENT
(INCLUDING ZONE DISTRICT AMENDMENT ZC- 00017)
WHEREAS, on or about October 7, 1997 , the County of
Eagle, State of Colorado, accepted for filing an application
submitted by Beaver Creek Housing, LLC (hereinafter
"Applicant ") for approval of the PUD Combined Sketch and
Preliminary Plan of the Chadwick Planned Unit Development, File
No. PDSP -00004 ; and,
WHEREAS, approval of the Application would allow for the
development of i5 Parking Spaces and Open Space to x lusiv ly
serve the RiverEdae Housing Project(PDF 00007); and,
WHEREAS, pursuant to Section 2.06.13(9) (Minor Planned Unit
Development) of the Eagle County Land Use Regulations, Sketch
Plan and Preliminary Plan may be combined; and

WHEREAS, at its public hearing /hearings held November 5,
1997 , the Planning Commission, based on its findings,
recommended approval of the proposed Combined Sketch and
Preliminary Plan of the- Chadwick Minor Planned Unit
Development, with certain conditions; and,
WHEREAS, a public hearing was held by the Board of County
Commissioners of the County of Eagle, State of Colorado, on
November 17 , 1997; and,
WHEREAS, based on the evidence, testimony, exhibits, study
of the Master Plan for the unincorporated areas of Eagle County,
comments of the Eagle County Department of Community Development,
comments of public officials and agencies, the recommendation of
the Planning Commission, and comments from all interested
parties, the Board of County Commissioners of the County of
Eagle, State of Colorado, finds as follows:
1. That proper publication and public notice was provided
as required by law for the hearing before the Planning
Commission and the Board of County Commissioners.
2. That all criteria of Section 2.17.02(3) (PUD Sketch
Plan Application) and 2.06.13(5) (PUD Sketch Plan
Review)of the Eagle County Land Use Regulations have
been considered:
Section 2.17.02(3) (PUD Sketch Plan Application)
a) The proposal is in conformance with the Master Plan,
policies, guidelines, zoning and other applicable
regulations;
b) The land is suitable for subdivision as proposed;
c) Comments and recommendations from the appropriate
agencies have been received;

d) The land has access to the State Highway System.
Section 2.06.13(5) (PUD Sketch Plan Review)
1) The resulting development is consistent with the Master
Plan objectives;
2) The PUD, as proposed, is in substantial harmony with
the area around it;
3) Adjacent and nearby communities will not be
detrimentally affected by the proposed PUD;
4) The PUD can be completed in a reasonable period of
time;
5) Commercial and industrial development is not an issue;
6) The streets are adequate to support traffic from the
development;
7) Utility and drainage facilities are adequate;
8) Employee housing is not an issue.
3. That all criteria of Section 2.06.13(7) (PUD
Preliminary Plan Review) and Section 2.18.02(3) (PUD
Preliminary Plan Review) of the Eagle County Land Use
Regulations have been considered:
Section 2.06.13(7) (PUD Preliminary Plan Review)
1) An Environmental Impact Statement has been waived;
2) All information requested or required has been
submitted;
3) An application for zone change has been filed;
4) The PUD control document has been submitted.(see
Exhibit A attached)

Section 2.18.02(3) (PUD Preliminary Plan Review)
a) Conformance with Sketch Plan is not an issue;
b) The Preliminary Plan is in conformance with the Eagle
County Land Use Regulations, Policies, and Guidelines;
c) All reports have been submitted, and the guidelines and
recommendations of agencies considered.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of the County of Eagle, State of Colorado:
THAT, subject to the conditions set forth below, the
application submitted by Beaver Creek Housing, LLC for
approval of a Zone District Amendment and of the combined Sketch
and Preliminary Plan for the Chadwick Planned Unit Development
be and is hereby approved for the following described parcel of
land:

THAT, the following conditions are hereby placed upon this
approval:
1. The Applicant will provide a public access trail to the
Eagle River, either through the RiverEdge Housing Project or
the Chadwick PUD.
2. A clarification of `no permitted uses, (other than open
space), including the portion across the Eagle River, of the
property will be made to the PUD guide and the Final Plat.
The remainder of the site shall remain open space, excluding
passive recreation structures and uses.

3. Any fees, as determined by the Eagle County School District,
County Engineer, and Colorado Department of Wildlife for
cash -in -lieu dedications /off site impacts, shall be paid
before approval of the Final Plat.
THAT, the Combined Sketch and Preliminary Plan submitted
under this application and hereby approved, does not constitute a
"Site Specific Development Plan" as that phrase is defined and
used in C.R.S. 24 -G8 -101, et seq.
THAT the Board of County Commissioners directs the
Department of Community Development to enter its amendment on the
appropriate page(s) for the Official District Map and record the
change in the Office of the Eagle County Clerk and Recorder.

Commissioners of the County of Eagle, State of Colorado, at its
meeting held the day of 191Z, nunc

The purpose of this PUD Guide is to ensure orderly use of the property in
accordance with the standards, restrictions and regulations which govern the use of
land within the Chadwick Planned Unit Development.
The Chadwick PUD is a single lot limited use development which will serve as a
location for parking and accessory uses to Riveredge.
A. Fifteen parking spaces to serve the adjacent Riveredge property.
B. Accessory uses and structures to the Riveredge property, limited to
recreational uses and structures commonly associated with
residential uses. This may include, but not be limited to, swingsets,
playground structures, barbecue and picnic grounds, and pedestrian
trails.
