HomeMy WebLinkAboutR97-155 final release of collateral for Bentgrass Phase II) Commissioner moved adoption of the ttollowing Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 97- /55 FINAL RELEASE OF COLLATERAL AND TERMINATION OF THE WARRANTY PERIOD FOR CORDILLERA SUBDIVISION, FILING 20 BENTGRASS, PHASE II WHEREAS, pursuant to C.R.S. 30- 28 -37, the Board of County Commissioners of the County of Eagle, State of Colorado ( "County ") entered into a Subdivision-Improvements Agreement dated October 24, 1995, (Agreement ") with Stag Gulch Partners and Bentgrass Limited Liability Company ( "Subdivider ") as a condition of final plat approval for Cordillera Subdivision, Filing 20, Bentgrass, Phase II; and WHEREAS, the Subdivider provided the County with collateral in the form of check #2579, in the amount of $160,494.58. WHEREAS, by Eagle County Consent No. 95 -42, the County commenced the warranty period for Cordillera Subdivision, Filing m 20, Bentgrass, Phase II, said warranty period to expire on December 6, 1997; the Board further retained $16,049.46, or ten percent of �d a the original cost estimate, which amount was held for the duration LL of the warranty period; and �m aWHEREAS, both the Subdivider and the Engineering Department �.. state that the work required under the Agreement is complete and � m m acceptable and the Engineering Department recommends full release �m m of the collateral and the termination of the warranty period, see �� m Exhibit "A ", attached hereto and incorporated herein by tlis rom— ® m reference. Based upon the oral and written recommendations of the County staff, THE BOARD FINDS that the Subdivider's obligations �10 a under the Agreement have been satisfied. o —v � o � U — Y � p � W =n n �co1 �d h =t LL � m �vm �mm �mm ea �mm �.. . _gym N �mv m �•r`+ o �mN NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the Board hereby authorizes the full and final release of collateral and the termination of the warranty period for Cordillera Subdivision, Filing 20, Bentgrass Phase II. THAT, this document shall be recorded in the Records of the Eagle County Clerk and Recorder, which shall be evidence that the warranty period for Cordillera Subdivision, Filing 20, Bentgrass Phase II has been successfully completed and that the Subdivider's obligations under the Agreement are complete. THAT, the Chairman of the Board of the Eagle County Commissioners hereby directs the Eagle County Treasurer to issue a warrant to Stag Gulch Partners, the Subdivider, in the amount of $16,049.46. THAT, the roads in Cordillera Subdivision, Filing 20, Bentgrass Phase 'II will be maintained by the Cordillera Metropolitan District. Appears that all of the improvements have successfully completed the warranty period. I would suggest releasing the collateral held for both projects and closing out the Subdivision Improvements Agreements.
