APPROVAL OF THE PLANNED UNIT DEVELOPMENT
SKETCH PLAN FOR M allace/MCDonald PUD
j WHEREAS, on or about April 1, 19 97 the County of Eagle, State of Colorado, accepted
for filing an application submitted by JABDOC (hereinafter "Applicant") for approval of the
Planned Unit Development Sketch Plan for Wallace/McDonaLd nr File No. -PDS -00003 ;
and,
WHEREAS, the Applicant requested the approval of a Planned Unit Development (PUD)
Sketch Plan which would allow for the development as follows:

WHEREAS, notice of the Sketch Plan was given to all proper agencies and departments as
required by the Eagle County Land Use Regulations, Section 2.17.02(1); and,

WHEREAS, at its public hearing/hearings held Mav 7, 1997 , the Planning Commission,
based upon its findings, recommended approval of the proposed PUD Sketch Plan, with certain
conditions; and
WHEREAS, at its regular hearing/hearings of —M--ay 27. 1997 , the Eagle County Board of
Commissioners (hereinafter 'Board "), considered the PUD Sketch Plan, associated plans, and the
statements and concerns of the Applicant, the Eagle County Community Development and
Engineering staff, and other interested persons.
BASED ON THE EVIDENCE BEFORE IT, and with the modifications imposed by the
conditions hereinafter described, THE BOARD FINDS AS FOLLOWS:
The proposed Sketch Plan is in conformance with the Master Plan; to the extent
applicable, with the Edwards Sub -Area Plan ; and with policies, guidelines,
zoning and other applicable regulations. Furthermore, the resulting development
will not be inconsistent with the Master Plan objectives.
2• The land included in the proposed Sketch Plan is suitable for subdivision as
proposed.
3. Comments and recommendations from the agencies listed in Eagle County Land
Use Regulations, Section 2.17.02(1), have been considered.
4. The evidence shows that access which is capable of servicing the development from
the state highway system to the parcel of land proposed for subdivision can be built
by the Applicant.
5. The area around the development can be planned to be in substantial harmony with
the proposed PUD.
6. No adjacent and nearby communities will be detrimentally affected by the proposed
PUD.
7. The PUD can be completed within a reasonable period of time, to be determined
prior to final approval of the PUD.

8. There is no proposed commercial development within the proposed PUD that needs
justification.
9. The streets, as proposed, are adequate to support the anticipated traffic, and the
development will not overload the streets outside the planned area.
10. Proposed utility and drainage facilities, upon their conformance to the conditions set
forth herein, are adequate for population densities and the type of development
proposed.
11. The employee housing plan is acceptable in as much as the proposal contains an
attainable component.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the application for approval of the Planned Unit Development Sketch Plan for _
Wallace/MCDonald PUD be and is hereby granted, subie ct tQ compliance with the following
conditions:
1. The County Engineer's identified issues shall be addressed:
a. Access easement agreements through adjacent property must be provided.
b. Level of service calculations and the impacts on the entrance at Hwy 6 should be
provided.
a. The street system must be designed an d built to the "Local Street" standard.
b. Documentation should be provided demonstrating adequate drainage facilities. A
detention basin may need to be provided.
c. The proposed 75 foot setback from the Eagle River should be shown.
d. Part of this site is within FIRM Zone A: Area of 100 -year flood; factors not
determined. This flood area should be shown on the plan.
2. Pursuant to the letter from Western Ecosystems, Inc., additional wildlife and habitat
analyses shall be performed including Riparian Ecosystem Analysis. Included
should be a proposed Wildlife Mitigation Agreement.
3. The applicant shall contact the Eagle County Soil Conservation District concerning
requirements for the submittal of-
a. Soil survey description.
b. Wetlands delineation.
c. Vegetation description.

4. In so far as possible, the street scape and other design concerns shall be addressed as
follows:
a. The front setbacks and building orientations shall be as vaned as possible;
b. Some of the dwelling units shall have side - loaded garages;
c. Single - family units with accessory dwelling units shall be considered;
d. Some of the driveways should be shared;
e. Side setbacks shall be as vaned as possible;
5. The PUD Guide shall further address:
a. For the purposes of this PUD, a "cluster" standard shall be specifically defined.
b. Floor Area restrictions shall be proposed;
c. Building height restrictions shall be proposed that promote the two -story massing
intent;
d. Other typical PUD Guide issues not previously addressed including but not
necessarily limited to:
* Primary and secondary or special uses;
* Signage;
* Fencing;
* Lighting;
* Parking;
* Storage;
* Temporary uses;
* Building mass;
* Open space maintenance.
6. An adequate access easement shall be shown to the east end of the parcel.
7. Public access along and in the River shall be specifically allowed;
8. The proposed public path through the property shall be 20' wide and construction of
the surface shall be the responsibility of the developers.
9. The applicant shall cause the supplying water district to comply with the statutory
requirements outlined in the letter from the Office from the State Engineer.
THAT, the Sketch Plan submitted under this application and hereby approved, does not
constitute a "site specific development plan" as that phrase is defined and used in C.R.S. Section
24 -68 -101, et seq. Sketch Plan approval is expressly conditioned on the County's authority to
impose further restrictions or limitations on the PUD which are necessitated by impacts which are
not yet recognized or which are more severe than realized during the review given at the hearings
on the Sketch Plan.
THE BOARD further finds, determines and declares that this Resolution is necessary for
the health, safety and welfare of the inhabitants of the County of Eagle, State of Colorado.
