HomeMy WebLinkAboutR97-112 final release of collateral for Highland WoodsLi Commissioner moved moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 97 - /IC` FINAL RELEASE OF COLLATERAL AND TERMINATION OF THE WARRANTY PERIOD FOR HIGHLAND WOODS SUBDIVISION WHEREAS, on or about August 10, 1993, the Board of County Commissioners of the County of Eagle; State of Colorado (herein- after "the Board "), entered into a Subdivision Improvements Agreement ( "SIA") with Jack D. Beals relative to Highland Woods, A Resubdivision of Lot 33 at Highland Meadows and Lots 34 & 35 at Highland Park ( "Highland Woods Subdivision "); and WHEREAS, on or about November 1, 1993 a Consent to Assignment and Assumption of Certain Obligations of Highland Woods was entered into between Jack D. Beals and Eli Quaknine, David Irwin and Don Everett ( "Subdivider ") and'the Board of County Commissioners of the County of Eagle, State of Colorado ( "the Board "); and WHEREAS, by Eagle County Consent No. 95 -12 the County commenced the warranty period for Highland Woods Subdivision, said warranty period to expire on July 31, 1997; and WHEREAS, both the Subdivider and the Engineering Department state that' the work required under the SIA are complete and acceptable and the Engineering Department recommends full release of the collateral and the termination of the warranty period, see Exhibit "A ", attached hereto and incorporated herein by this reference. Based upon the oral and written recommendations of the County staff, THE BOARD FINDS th;-t the Subdivider's obligations under the SIA have been satisfied. 111111 11111 111111 1111 111111111111 Ilill III IIIII IIII IN 630388 08/12/1997 06:11P B734 P432 1 of 4 R 0.00 D 0.00 Sara J Fisher, Eagle, CO NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE., STATE OF COLORADO: THAT, the Board hereby authorizes the full and final release of collateral and the termination of the warranty period for Highland Woods Subdivision. THAT, this document shall be recorded in the Records of the Eagle County Clerk and Recorder, which shall be evidence that the warranty period for Highland Woods Subdivision has been successfully completed and that the Subdivider's obligations under the SIA are complete, THAT, the improvements associated with Highland Woods Subdivision included the construction of a private driveway and associated landscaping and retaining wall features, therefore, the County will not be accepting maintenance responsibilities associated with these improvements. The improvements are complete and acceptable per the terms and conditions of the SIA. These improvements entail the construction of a private driveway and associated landscape and retaining wall features. The County is not responsible for maintenance of this driveway.
