WHEREAS, at its public hearing /hearings held rnNF 4 97 , the Planning Commission, based on its findings, recommended approval of the proposed Combined Sketch and Preliminary Plan of the ERRING K ACRES Minor Planned Unit Development, with certain conditions; and, WHEREAS, a public hearing was held by the Board of County Commissioners of the County of Eagle, State of Colorado, on ULY 1 1991—; and, WHEREAS, based on the evidence, testimony, exhibits, study of the Master Plan for the unincorporated areas of Eagle County, comments of the Eagle County Department of Community Development, comments of public officials and agencies, the recommendation of the Planning Commission, and comments from all interested parties, the Board of County Commissioners of the County of Eagle, State of Colorado, finds as follows: 1. That proper publication and public notice was provided as required by law for the hearing before the Planning Commission and the Board of County Commissioners. 2. That all criteria of Section 2.06.13(4) (PUD Sketch Plan Application) and Section 2.06.13(5) (PUD Sketch Plan Review) of the Eagle County Land Use Regulations have been considered. Pa j - 3. That there is conceptual evidence that the land has access and can be serviced with water and sewage disposal systems appropriate with the zone district being sought. 4. That the land included in the proposed Sketch Plan is suitable for subdivision. 5. That comments and recommendations from the agencies listed in Eagle County Land Use Regulations, Section 2.17.02(1), have been considered. 6. That the evidence shows that access which is capable of servicing the development from the state highway system to the parcel of land proposed for subdivision can be built by the Applicant. 7. That an environmental impact statement is not required. 8. That the proposed PUD control document is satisfactory (see Exhibit A attached). 9. That an appropriate zone change application has been received. 10. That the proposed Sketch and Preliminary Plan is in conformance with the Master Plan, policies, guidelines, zoning and other applicable regulations. 11. That the area in question possesses the geological, physical and other environmental conditions compatible with the characteristics of the use requested. 12. That the advantages of the use requested outweigh the disadvantages. 01 13. That the area for which the rezoning is requested has changed or is changing to such a degree that it is in the public interest to encourage a new use of density in the area; or 14a. That the proposed rezoning is necessary in order to provide land for a demonstrated community need. 14b. That for the above stated reasons, the proposed rezoning is in the best interest of the health, safety, convenience, order, prosperity, and welfare of the citizens of Eagle County, Colorado. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of the County of Eagle, State of Colorado: THAT, subject to the conditions set forth below, the application submitted by _ ROY FA HT for approval of a Zone District Amendment and of the combined Sketch and Preliminary Plan for the PRINK R•EK A R S Planned Unit Development be and is hereby approved for the following described parcel of land: LOT 3 OF O.R.E.O ACRES SUBDIVISION, DESCRIBED BY PARCEL NUMBER AS 2111- 103 -02 -003. THAT, the following conditions are hereby placed upon this approval: 1. All cash in lieu fees be paid to the Eagle County School District RE 50J are paid by final plat. 2. All off site road impact fees, as determined by the County Engineer, are paid by final plat. 3. All wildlife mitigation fees, as determined by the CDOW, are paid by final plat. M a 4. All recommendations of the CDOW are incorporated into the PUD guide by final plat. M EXHIBIT "A" SPRING CREEK ACRES Planned Unit Development Guide INTENT: The intent of this Planned Unit Development is to provide acreage for the storage of construction materials and equipment while maintaining the existing land uses of ranching, wood lots and single - family residences. Ample open space is provided for both wildlife and passive recreation. Storage areas will be screened from view using berms, fencing, and landscaping. I. USES BY RIGHT A. Lot 1 1. Outside storage of construction materials and equipment including: a. Rocks and stones if stored less than 8' high and screened from the north and the east with the use of either berming, landscaping, or fencing, or any combination thereof as defined by the approved landscaping plan. b. Other construction materials under the same screening requirements such as: 1. Wire 2. Fencing materials 3. Lumber and logs 4. Roofing materials c. Construction equipment such as forklifts, end - loaders, earth movers, trucks, etc., with the screening requirements defined by the approved landscaping plan. 2. Inside storage with the following limitation: a. The total cumulative square footage for buildings cannot exceed 10% of the lot area. b. Buildings can be either wood, concrete, or metal, and either modular or built on site. Natural colors should be used. 3. One single - family dwelling unit not to exceed 3,500 square feet. 4. Open Space B. Lot 2 1. One single - family dwelling unit not to exceed 3,500 square feet. 2. Open Space 3. Wood lot only within the storage envelopes shown on the final plat. 4. Outside storage of construction materials and equipment only within the storage building envelopes as shown on the final plat and screened by using berming, landscaping, or fencing as defined by the approved landscaping plan. 5. Log storage and cutting. 6. Ranching activities within the ranching building envelopes as shown on the final plat and only if livestock is fed and watered from outside sources. a. SPECIAL USES Any of the uses listed below for the lots listed below and only when municipal water is available. A Special Use Permit per Section 2.09 of the Eagle County Land Use Regulations shall be obtained for all of the uses listed below. A. Lot 1 1. Nursery40,000 square foot maximum. 2. Construction office4,000 square foot maximum. 3. General services establishments including: a. Automobile repair garage b. Laundry and dry cleaning plant c. Shop for blacksmith, cabinetry, glazing, plumbing, machining, printing, publishing, or sheet metal. 4. Sales, rental, storage, service, or repair of a. Aircraft b. Automobiles c. Trailers and recreational vehicles d. Trucks e. Snowmobiles Wholesale establishments including sale of a. Appliances b. Automotive and vehicular equipment c. Beverages d. Building materials e. Not to exceed 10 RV's at one time. C. Lot 3 1. Nursery- 20,000 square feet maximum. OPEN SPACE Open space shall be as shown on the final plat map and shall be for the common use of the owners and leasees of the lots within the PUD. No development shall take place within the open space with the following exceptions: A. Necessary drainage structures; all future crossings of Spring Creek must be designed for the 100 -year flood. B. Access drives. C. The following recreational equipment: picnic tables, barbecue grills, and horseshoes. D. Any crop planted for wildlife, foliage, and vegetation. E. Defined by the wildlife mitigation plan. VI. LANDSCAPING AND EROSION A. The Spring Creek corridor shall be protected in its natural state with the only exceptions stated in Section V of this guide. 9622 /pudguide/pg.4 B. A landscape plan shall be required prior to the placing of any storage materials on Lot 1 or Lot 2. The landscape plan shall at the minimum: 1. Screen, with the use of berming, fencing, and / or landscaping, all contractor storage areas from Spring Creek Road and from the access road along the northern boundary of Lot 1. 2. Be prepared by a qualified landscape designer per Section 2.07.07 (7) of the ECLUR and be approved by the staff of the Eagle County Community Development. C. An erosion control plan, along with a drainage plan and grading plan, shall be required to be approved and completely constructed prior to to any new activities or uses not currently in place. VII. SIGNAGE A. Lot I 1. Individual business signs shall not exceed 16 square feet per sign or 32 square feet per street frontage total. 2. All signs shall be constructed and supported by natural materials such as wood and stone. 3. No sign shall extend above the planes formed by intersecting imaginary lines from the lot lines to the setback lines, at a height of 25 feet or to the top of the tallest building on the lot, whichever is greater, per Section 2.11 of the ECLUR. 4. All signs shall meet the General Requirements in Sections 2.11 of the Eagle County Sign Code. B. Lots 2 and 3 shall be allowed only address signs per Section 2.11 of the ECLUR. 11 • ' t D 1 �' All structures shall be designed to be compatible with other units in the area, yet to avoid uniformity and lack of variety. Natural colors should be used. IX. LOT COVERAGE 1. Not more than approximately 60% of the designated building envelope of any lot shall be covered with impervious materials. X. LIGHTING A. All operational and security lighting shall be oriented laterally and downward into the storage areas. B. The number of light sources should be limited whenever possible, however, lower intensity sources close to the area to be lit are preferred over one remote intense source. C. The height of light fixtures shall be limited to 20 feet. 9622 /pudguide/pg.5 The applicable parking standards of the Eagle County Land Use Regulations shall apply to all uses within the PUD.
