RESOLUTION NO. 97 - (30
A RESOLUTION TO CORRECT CERTAIN PROVISIONS
OF
EAGLE COUNTY RESOLUTION NO. 92 -46
AS CONCERNS EAGLE COUNTY'S
SPRING CREEK CONDITIONAL WATER RIGHTS
WHEREAS, by Eagle County Resolution No. 92 -46, Eagle County,
by and through its Board of County Commissioners (hereinafter
"County "), disclaimed any interest in certain agreements
previously entered into by Eagle County concerning Spring Creek
as a potential source of water for the Eagle County Regional
Airport; and
WHEREAS, the County at this time desires to correct certain
statements found in Eagle County Resolution No. 92 -46, as these
statements exceed the purpose of Resolution No. 92 -46, which sole
purpose was to address the effect of certain subordination
agreements that the County had negotiated with several Spring
Creek water users; and
WHEREAS, the County at this time desires to reaffirm and
clarify its interests in its Spring Creek conditional water
rights.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the County here desires to correct the following
statement as found in Eagle County Resolution 92 -46 as this
statement is contrary to the County's position as concerns its
Spring Creek conditional water rights:
The County is not diligently pursuing and does not plan
to pursue construction of a water system from Spring
Creek.

THAT, the County desires to correct any statement which
appears in Eagle County Resolution No. 92 -46 which states that
Eagle County no longer has any interest in its Spring Creek
conditional water rights.
THAT, the County has and continues to diligently pursue
development of its Spring Creek conditional water rights.
THAT, all other provisions of Eagle County Resolution 92 -46,
which address the effect of certain subordination agreement that
the County had negotiated with several Spring Creek water users,
remain in full force and effect.
THAT, a copy of this Resolution shall be recorded in the
records of the Eagle County Clerk and Recorder_
THAT, this Resolution is necessary for the public health,
safety and welfare of the citizenry of the County of Eagle, State
of Colorado.
