IN RE THE MATTER OF THE APPLICATION OF
WOLCOTT VILLAGE —_ --
EXTENSION OF THE SKETCH PLAN
RESOLUTION ALLOWING EXTENSION FOR A PERIOD OF
SIX (6) MONTHS
WHEREAS, on March 1, 1994, by Eagle County Resolution No. 94-
27, the Eagle County Board of County Commissioners ( "Board ")
approved the Sketch Plan (hereinafter "Sketch Plan ") of Wolcott
Village; and
WHEREAS, on November 14, 1996, the staff of the Eagle County
Department of Community Development, informed the developers of
Wolcott Village (hereinafter "Appellant ") that the Sketch Plan for
Wolcott Village had expired; and
WHEREAS, pursuant to Section 2.16 of the Eagle County Land Use
Regulations, the Appellant appealed staff's decision to the Eagle
County Board of County Commissioners; and
WHEREAS, on January 21, 1997, the Board heard testimony as to
why the Sketch Plan should be extended and the pending Preliminary
Plan application found valid; and
WHEREAS, interested parties and members of the public were
allowed to make statements and present evidence to the Eagle County
Board of County Commissioners; and
WHEREAS, the Eagle County Board of County Commissioners has
reviewed and considered the evidence, comments and arguments
presented at said hearings.
NOW, THEN, BE IT RESOLVED BY THE BOARD OF COUN'T'Y COMMISSIONERS
OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, based on the testimony, exhibits, comments of the Eagle
County Department of Community Development, and the testimony,
comments and argument from all interested parties, the Board hereby
makes the following findings:
1. Appellant has shown good cause as to why the Sketch Plan
approval should be extended in that:
a. the Sketch Plan was approved on March 1, 1994;
b. the Preliminary Plan was submitted for approval a short
time later in August of 1994;
C. the Planning Commission considered the proposed
Preliminary Plan on November 2, 1994;
d. the Planning Commission tabled the Preliminary Plan
application indefinitely, subject to the Appellant obtaining
state highway access permit, which tabling was incompatible
with §2.25.01(1) of the Eagle County Land Use Regulations
which allows tabling for no more than six months;
e. the Appellant obtained his access permit on or about
December 19, 1994, satisfying the condition imposed by the
Planning Commission, but the Planning Commission did not
consider the Preliminary Plan again.
2. Extending approval of the Wolcott Village Sketch Plan
promotes the efficient development and preservation of the entire
planned unit development and does not affect, in a substantially
adverse manner, the enjoyment of land abutting the Wolcott Village
and the public interest.

3. The Appellant is responsible for proceeding with
Preliminary Plan consideration such that the pending Preliminary
Plan application shall be submitted to the Eagle County Board of
County Commissioners for its consideration of approval, in
accordance with the Eagle County Land Use Regulations, prior to the
expiration of the Sketch Plan.
THAT, the Eagle County Board of County Commissioners hereby
approves the request for an extension of the Sketch Plan, for a
period of six months, until July 21, 1997, and finds that the
pending Preliminary Plan application, submitted in August of 1994
is still valid.
THAT, this resolution is necessary for the health, safety and
welfare of the citizens of Eagle County.
MOVED, READ AND ADOPTED by the Board of County Commissioners
of the County of Eagle, State of Colorado, at its regular meeting
