RESOLUTION NO. 97 -__Zc
AUTHORIZING THE DIRECTOR OF THE
EAGLE COUNTY DEPARTMENT OF SOCIAL SERVICES
TO
EXECUTE SMALL PROVIDER CONTRACTS
AND
INDIVIDUAL PROVIDERS OF SERVICE
UNDER THE FAMILY PRESERVATION
AND
JUVENILE WRAP PROGRAM
WHEREAS, the Eagle County Department of Health and Human
Services ( "ECHHS ") does from time to time have Small Provider
Contracts submitted to them under the Eagle County Family
Preservation Program, individual mental health providers under the
Human Service Grant Program and the Juvenile WRAP Program; and
WHEREAS, Small Provider Contracts for purposes of this
resolution are those providers of goods and services not exceeding
a total value of three thousand dollars ($3,000.00) in a single
fiscal year.
WHEREAS, the Director of the ECHHS would be the person most
likely to execute these contracts on behalf of the ECHHS; and
WHEREAS, the form of the contract to be signed by the Director
is attached hereto as Exhibit A; and
WHEREAS, the Director seeks authority from the Board of County
Commissioners to execute these contracts; and
WHEREAS, the Board is desirous to designate the Director of
the ECHHS as its authorized representative to execute said
contracts.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the Board hereby adopts the form agreement for Small
Provider Contracts as the same is set forth in Exhibit A attached
hereto.

THAT, the Board hereby designates the Director of the Eagle
County Department of Health and Human Services as its duly
appointed representative and agent to execute said contracts for
the Family Preservation Program, individual mental health providers
under the Human Service Grand Program and the Juvenile WRAP Program
on behalf of the Board.
MOVED, READ AND ADOPTED by the Board of County Commissioners
of the County of Eagle, state of Colorado, at its regular meeting

PURCHASE OF SERVICE CONTRACT
EAGLE COUNTY PROGRAM
THIS CONTRACT, made this day of , 1997, by and between the Eagle
County Department of Health and Human Services, hereinafter called " ECHHS" and

(tax ID or Social Security number), hereinafter called "Contractor ".
2. This Contract will be effective from , 1997 until 1997.
ECHHS agrees to purchase and Contractor agree to provide
to children and families in accordance with the service described
paragraph 4.
4. ECHHS agrees to purchase and Contractor agrees to fiunish Units of Service at an
hourly rate of for for a maximum amount of this contract of
5. The parties agree that the Contractor's relationship to the county is that of an independent
contractor.
6. The parties agree that payment pursuant to this Contract is subject to and contingent upon the
continuing availability of fund for the purpose thereof.
7. ECHHS agrees:
a. to determine child eligibility and, as appropriate, to provide information regarding
rights to fair hearings
b. to provide contractor with written prior authorization, on a child or family basis, for
services to be purchased.
c. to provide Contractor with referral information including name and address of family,
social, medical and educational information as appropriate to the referral.
d. to assess and collect fees as appropriate.
e. to monitor the provision of contracted service.
f. to pay Contractor after receipt of billing statements for services rendered satisfactorily
and in accordance with this Contract.
8. Contractor agrees:
a. not to assign any provision of this Contract to a subcontractor.
b. Not to charge clients any fees relation to services provided under this Contract.

c. to hold the necessary license(s) which permits the performance of the service to be
purchased.
d. to comply with the requirements of the Civil Rights Act of 1964 and Section 504,
Rehabilitation Act of 1973 concerning discrimination on the basis of race, color, sex, age,
religion, political beliefs, national origin, or handicap.
e. to provide the service described herein at cost not greater than that charged to other
persons in the same community.
f. to submit a billing statement in a timely manner, no later than 45 days after services.
Failure to do so may result in nonpayment.
g. to safeguard information and confidentiality of the child and the child's family in
accordance with rules of the Eagle County Department of Health and Human Services.
h. to provide ECHHS with reports on provision of service as follows:
> Within 30 days of enrollment or participation, submission of a treatment plan
for the child/child's family with specific objectives and target dates. The treatment plan is
subject to county approval.
> At monthly intervals thereafter, submit reports that include progress and barriers
in achieving provisions of the treatment plan.
I. to provide access for any duly authorized representative of the ECHHS until the
expiration of five (5) years after the final payment under this Contract, to examine any financial,
program, and other records of the Contractor involving transactions related to this Contract.
j. within the limits of, and without expanding or multiplying the limits of governmental
immunity, indemnify Eagle County, State of Colorado against any liability and loss against all
claims and actions based upon or arising out of damage or injury, including death, to persons or
property caused or sustained by Contractor's performance of this Contract.
9. Termination: Either part may terminate this Contract by thirty (30) days prior notification in
writing.
