HomeMy WebLinkAboutR97-012 rules and regulations for ground transportation at airportCommissioner ��_ moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 97 -/R ADOPTING RULES AND REGULATIONS FOR GROUND TRANSPORTATION AT THE EAGLE COUNTY REGIONAL AIRPORT WHEREAS, C.R.S. § §30 -11 -107 (1)(j) and 41 -4-106 grant the power and jurisdiction to the Eagle County Board of Commissioners (hereinafter, "the Board ") to regulate the receipt, deposit, and removal and the embarkation of passengers or property to or from the Eagle County Regional Airport; and to exact and require charges, fees, and tolls; and to lease or assign for operation such space or area, appurtenances, appliances or other conveniences necessary or useful in connection therewith; and to provide rules and regulations governing the use of such airport and facilities and the use of other property and means of transportation within or over the Airport; and to exercise such powers as my be required or consistent in the promotion of aeronautics and the furthereance of commerce and navigation by air; and WHEREAS, the Board previously adopted on October 4, 1982, by Resolution No. 82- 87, "Rules and Regulations Governing the Operation of the Eagle County Airport" (hereinafter RULES AND REGULATIONS), and amended said Rules and Regulations on April 24, 1989, by Resolution No. 89 -52; and WHEREAS, the Board further amended the RULES AND REGULATIONS by adopting specific Ground Transportation Rules and Regulations, on January 15, 1992, by Resolution No. 92 -08; and WHEREAS, the Board amended Section 3 of the Ground Transportation Rules and Regulations to read as set forth in Exhibit "A" attached hereto and incorporated herein, on December 9, 1996; and WHEREAS, the Eagle County Regional Airport continues to attract a volume of traffic that requires supervision, regulation and control to insure the best interest of the County, its citizens, and the beneficiaries of the Airport facilities; and WHEREAS, the Board desires to further amend the Ground Transportation Rules and Regulations to provide for the orderly and equitable operation of ground transportation at the Airport, finding as follows: G:\B OB WIP\AW0RT \GROUNDTR.97 1 1. The costs borne by the County for construction and operation of the Eagle County Regional Airport are significant. 2. The fees and revenues contemplated within the regulations are reasonable; they do not unduly burden business, and they do not constitute a special tax. 3. The assessment of revenue to be collected from Off- Airport Rental Car Agencies constitutes an access fee which is necessary in order to allow the Airport to be self- supporting. 4. Off - Airport Rental Car Agencies use the airport for economic benefit and are thereby obligated to pay their fair share towards the general operation of the Airport. 5. The County has an interest in protecting existing and future revenues from On -Site Rental Car Providers and to deter the relocation of on -site companies due to unfair competitive advantages. 6. On- Airport Rental Car Agencies which are tenants of the County or which are tenants of one of the terminals are providing economic support of the Airport through those contracts apart from access fees imposed by general rules and regulations. WHEREAS, on or about November 15, 1996 a draft of the proposed amended Ground Transportation Rules and Regulations was distributed to ground transportation operators who have served the Eagle County Regional Airport and no substantive comments were received in response. NOW, THEREFORE, BE IT RESOLVED, BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the RULES AND REGULATIONS be and are hereby amended to include the the amended and restated "Ground Transportation Rules and Regulations" attached hereto as Exhibit "B" and incorporated herein by this reference. THAT, the entirety of the RULES AND REGULATIONS, as amended, is hereby readopted. THAT, the "Ground Transportation Rules and Regulations" as hereby amended shall be effective as of January 28, 1997. f THAT, should any section, clause, provision, sentence or work of this Resolution be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of this Resolution as a whole or any parts thereof, other than the part so declared to be invalid. For this purpose, this Resolution is declared to be severable. THAT, the Board hereby finds, determines and declares that this Resolution is necessary for the health, safety and welfare of the citizens of Eagle County. All persons, firms or agencies providing ground transportation to and /or from the Eagle County Regional Airport shall be subject to payment of an annual filing fee of $200 and an access fee or the purchase of an access permit. Any ground transportation provider opting to employ the daily fee shall be exempt from said filling fee. A Daily Fee may be employed for a maximum of ten (10) days. Payment on daily fees will not be applied toward the purchase of a permit at any time. Annual permit fees are as follows: Bus ..... ............................... $300.00 per vehicle Van /Limousine Van #1410 .............................. $250.00 per vehicle Van #11- 25 ........ ........................$150.00 per vehicle Van # 26+ . ............................... $50.00 per vehicle Taxicab Taxicab #1 -10 ............................ $100.00 per vehicle Taxicab #11 + ............................. $50.00 per vehicle Courtesy Van . .............................No per - vehicle Charge A fifty - percent (50 %) reduction in the fees will be given to annual permits issued after the first day of June. A daily fee may be charged to those transportation providers who do not wish to acquire an annual permit, and who serve the Airport on an Don -callO basis, and who provide passenger pickup service to the Airport less than ten (10) days per year per vehicle. The daily fees are as follows: Bus ...... ............................... $40.00 per vehicle Van /Limousine ............................. $30.00 per vehicle Taxicab ... ............................... $15.00 per vehicle Daily fees not paid within fifteen (15) days from due date will be deemed delinquent and further access to Airport will be denied. Delinquent carriers will be notified by certified letter, return receipt requested. Carriers willfully failing to pay fees to County, with habitual past due accounts, or showing other collection problems for Eagle County be required to set up an credit system with the Airport Administration Office. 2. Off - Airport Rental Car Agencies shall enter into an agreement and pay to the County, as outlined in such agreement, fourteen percent (14 %) of all gross revenues derived by said Rental Car Agency from the rental of vehicles to customers picked up by said Rental Car Agency from any point within the Airport. For purposes of this sub- paragraph, gross revenues shall mean all amounts received by the Off - Airport Rental Car Agency, or which the Off - Airport Rental Car Agency is entitled to receive for the rental and servicing of vehicles, to any person picked up by the Off - Airport Rental Car Agency from any point on the Airport, including but not limited to the Airport Terminal Building, any premises leased by the Airport to a third party doing business on the Airport, or from any other location within the Airport. Payment of said amount shall be forwarded before the 20th of each subsequent month to the Airport Administration with an accounting of gross revenue charges. Accurate and timely reporting shall be a prerequisite to car rental companies having continued access to the Airport. G:\B0BWIP\AW0RT \GR0UNDTR.97 5 EAGLE COUNTY REGIONAL AIRPORT Ground Transportation Rules and Regulations (Amended and Restated effective February 1, 1997) The following rules and regulations apply to all commercial ground transportation providers , i.e., owners of all buses, courtesy vans, limousines, vans, taxicabs, and rental car agencies, providing passenger pick -up service for a fee or monetary reward and accessing the Eagle County Regional Airport, and to their agents and employees. Section Definitions Airport Eagle County Regional Airport Bus A vehicle providing ground transportation for a fee, with a seating capacity of at least twenty -one (21) persons, including the driver. Courtesy Van A vehicle providing ground transportation to guests or customers of a hotel, condominium or other lodging business as a courtesy service only, not for hire. Driver /Employee The driver of a ground transportation vehicle and any other employee or agent of an Owner, whether engaged in loading, unloading, administration, counter work or customer service, at the Airport. Limousine /Van A vehicle providing ground transportation for a fee, without a meter, operating and charging on a per -seat basis, with a seating capacity of nine (9) to twenty (20) persons, including driver. Luxury Limousines are limousines providing services solely to individuals, families, or groups on a pre- booked basis. Owner The owner or operator of a bus, courtesy van, limousine, van or taxicab required by these rules and regulations to be permitted. Rental Car Agencies All persons, firms, agencies, or companies providing rental car services to passengers arriving at the Eagle County Airport from any location. Exhibit "B" GABOBWIPAII ORT \GROUNDTR.97 6 Taxicab A vehicle with a meter providing ground transportation for a fee, with a seating capacity of eight (8) or fewer persons, including the driver. Solicitation Any physical or verbal conduct by Owners and their employees and agents to attract attentention of or initiate conversation with potential customers for business purposes. Section II Permits 1. Owners and Drivers of all taxicabs, vans, limousines, buses, courtesy vans, and rental car agencies providing passenger pickup service to the Eagle County Regional Airport shall strictly comply with all Federal, State, County and municipal laws, ordinances, rules and regulations, including the Airport Rules and Regulations, and the written and verbal orders and directives thereunder. 2. Each vehicle providing passenger pickup services for a fee to the Airport must have a permit from the Airport Manager which allows operation at the Eagle County Regional Airport. The Owners of permitted vehicles are sometimes hereinafter called PERMITTEES and are entitled to conduct commercial ground transportation business at the Airport during the period the permit is valid and in accordance with these rules and regulations. a. A permit is not transferrable from one vehicle to another except in the case of the destruction or sale, and replacement, of the permitted vehicle proved to the satisfaction of the Airport Manager in its sole discretion. b. All information as may be required on the application for a permit shall be submitted prior to issuance of the permit and shall be promptly updated as changes occur. C. Permits must be displayed on the front windshield on the driver's side at all times. Permits displayed in any other location will be deemed invalid. Any commercial vehicle accessing the Eagle County Airport without a correctly displayed permit will be deemed to be unpermitted. d. Should a permitted vehicle require windshield replacement, the Airport Manager shall issue a new permit only after the old permit has been turned in to the Administration Office. To avoid an additional Access Fee, this exchange must occur and the new permit be affixed to the correct location prior to the vehicle's access to the Airport. Exhibit 'B" G:\BOBWIP\AIRPORT \GROUNDTR.97 7 e. The Permit Year shall run from December 1 of each calendar year through November 30 of the following calendar year. 3. Each PERMITTEE shall file and keep current, with the Airport Manager, a list of all of its drivers' names, dates of birth and current Colorado Driver's license numbers and any other information required by the Airport Manager as part of the permitting process. 4. All drivers of permitted vehicles must have and carry a current, valid Colorado license for his /her class of operation. 5. All vehicles operated by PERMITTEE for passenger conveyance must have current complying PUC and /or ICC inspections and markings displayed as PUC directs. A current copy of a certificate of authority shall be kept on file with the Airport Manager. 6. Non - profit churches, schools, agencies or political subdivisions of the State of Colorado and agencies or military services of the United States shall be exempt from this permitting process, but must otherwise comply with these regulations. 7. Insurance. PERMITTEE shall maintain a comprehensive general liability insurance policy and automobile insurance coverage with limits not less than $150,000 per person, $600,000 per occurrence and $150,000 property damage. Eagle County, Eagle County Air Terminal Corporation (hereinafter ECAT, the operator of Terminal A, and Vail /Beaver Creek Jet Center, Inc. (hereinafter VBCJC), the operator of Terminal B, shall all be endorsed on said policy as additional insureds. PERMITTEE shall furnish a certificate to the County, ECAT, and to VBCJC, prior to commencing operations, evidencing that said insurance is in full force and effect during the term of the permit and that the County, ECAT, and VBCJC shall be notified, in writing, by the insurer at least ten (10) days prior to any cancellation of said policy. PERMITTEE shall maintain the statutorily required workman's compensation insurance coverage on all employees. 8. Indemnification. PERMITTEE shall execute a written indemnification agreement. PERMITTEE shall indemnify, defend and save the County, ECAT, and VBCJC, and their respective agents, officers, and representatives and employees harmless from and against any and all judgments, penalties, liability or loss, including costs and reasonable attorney's fees resulting from claims or court actions, whether civil, criminal or in equity, arising directly or indirectly out of acts of PERMITTEE, its agents, employees or servants or through any injury or casualty occurring on the Airport as a result of said loss. 9. The Board of County Commissioners has delegated authority to the Airport Manager to act on its behalf in administering the Airport, regulating the use of the facilities and Exhibit 'B" G:\130BWIP\AIRPORT \GROUNDTR.97 8 j services of the Airport, determining and collecting use charges therefor, and in carrying out such other duties and responsibilities as may be determined. Section III Ground Transportation Access Fees 1. All persons, firms or agencies providing ground transportation to and /or from the Eagle County Regional Airport shall be subject to payment of an annual filing fee of $200 and an access fee. 2. There is a Daily Access Fee and an Annual Access Fee. Any ground transportation provider qualified for and opting for the Daily Access Fee shall be exempt from the filing fee. 3. The Daily Access Fee applies to those transportation providers who elect to not pay the Annual Access Fee with respect to a vehicle, which vehicle is used to serve the Airport on an "on- call" basis, and which vehicle is used to provide passenger pickup service to the Airport on fewer than ten (10) calendar days per during a Permit Year. A Daily Access Fee for a vehicle may be paid for a maximum of ten (10) calendar days during a Permit Year; additional access in the Permit Year requires payment of the Annual Access Fee. Payment of Daily Access Fees will not be applied toward the payment of the Annual Access Fee at any time. Delinquent carriers will be notified by certified letter, return receipt requested. 4. Off- Airport Rental Car Agencies, which are agencies doing business from a site not on the Airport and do not have a principal business site (independent building, exterior booth, or interior counter) on the Airport, shall enter into an agreement and pay to the County, as outlined in such agreement, an access fee of fourteen percent (14 %) of all gross revenues derived by said Rental Car Agency from the rental of vehicles to customers picked up or transferred to its business site for the purpose of renting a vehicle by said Rental Car Agency or its agent from any point on the Airport, including but not limited to any terminal building, any hangar, and any premises leased by the Airport to a third party doing business on the Airport. Payment of said amount shall be forwarded before the 20th of each subsequent month to the Airport Administration with an accounting of gross revenue charges. Accurate and timely reporting shall be a prerequisite to car rental companies having continued access to the Airport. 4. On Airport Rental Car Agencies, which are agencies doing business from a principal business site on the Airport (independent building, exterior booth or interior counter), shall enter into an agreement and pay to the County, as outlined in such agreement, an access fee of six percent (6 %) of all gross revenues derived by said Rental Car Agency from the use of vehicles contracted for, delivered, or rented to the customer at the Airport, regardless of where or by whom the payment is made or where the vehicle is returned. Payment of said amount shall be forwarded before the 20th of each subsequent month to the Airport Administration with an accounting of gross revenue charges. Accurate and timely reporting shall be a prerequisite to car rental companies having continued access to the Airport. The access fees of On- Airport Rental Car Agencies who are tenants of the County or of either of the terminal operators shall be six percent (6 %) of all gross revenues, or as otherwise provided in the contracts governing their concession, and shall be paid in accordance with those contracts. 5. As used herein, the term "Gross Revenues" shall mean the total amount actually charged to the customer, including Exhibit 'B" GABOB W IP\AIRPORT\GROUNDTR.97 10 A. any sums received from the customer for acceptance of personal accident or personal effects insurance (or any other insurance now or hereafter offered on Rental Car Agency's rental car agreement), B. any amounts billed to and paid by customers for waiver by the Rental Car Agency of its rights to recover from customers for damage to the vehicle rented, C. any charges for automobiles originally rented from facilities at the Airport exchanged at any point in the Eagle Valley or Vail Valley areas, and D. any charges for optional equipment such as cellular telephones, luggage or ski racks, infant seats, etc. The term "Gross Revenues" shall not include 1. the amounts of any federal, state, or municipal sales taxes, now or hereafter levied or imposed, separately stated on the rental agreement and collected from customers of the Rental Car Agency, 2. any sums received by the Rental Car Agency from customers for damage to automobiles or the Agency's property, or for loss, conversion, or abandonment of such automobiles, 3. any sums received by reason of the Rental Car Agency's disposal of capital assets and /or trade fixtures. 6. Interest shall be assessed on delinquent access fees beginning ten (10) days after the fee is due and payable and computed at the rate established pursuant to §39 -21 -110, CRS. Carriers failing to timely pay access fees to the County, with habitual past due accounts, or showing other collection problems for Eagle County, in the sole discretion of the Airport Manager, will be denied a permit or will be required to establish credit by letter of credit, bond, prepayment, escrow or other means. Exhibit "B" G:\BOBWIP\AWORT\GROUNDTR.97 11 Section IV Driver /Employee Conduct 1. Drivers /Employees shall remain in their vehicles or at their work stations at all times, except: a. when eating, or using terminal bathroom or telephone facilities (and thereafter shall promptly return to his /her vehicle or workstation without lingering in the terminal or in front of the terminal). b. when assisting the loading and unloading of passengers and their baggage; or, C. when picking up delayed baggage. 2. No Driver /Employee of any ground transportation company may porter passenger baggage unless (i) curbside porter service is not reasonably available, (ii) the passenger has, without solicitation from the Driver /Employee, requested such assistance, and (iii) leaving an unattended vehicle for this purpose would not cause or aggravate traffic congestion; or unless the Driver /Employee is claiming and delivering delayed baggage under contract. Such exceptions shall not be performed until permission is obtained from the Airport Manager or his designee. 3. Solicitation of ground transportation services is strictly prohibited. Whistling, hawking, and light- flashing are deemed unprofessional solicitation. Drivers /Employees shall not attempt to solicit business through the use of salutations or greetings. Any solicitation made by advertisement attached to a vehicle is not allowed, provided that this does not prohibit identifying names and logos on vehicles. Clipboards, signboards, or any other means of advertising or displaying business logos is prohibited. Displays of available services or business availability is prohibited except for signage for terminal tenants which has been approved by the terminal operator and conforms to applicable County sign rules. Any displays deemed to be prohibited solicitation under these rules and regulations by the Airport Manager will be removed from view immediately and permanently. 4. Luxury Limousine Driver /Employees waiting for customers who have made pre- arranged reservations for services shall arrange to meet said customers in the designated Luxury Limousine greeting area, if any, of each respective terminal. Solicitation, either through the use of visual aids, props, or verbal communication from this area is prohibited. Driver /Employees greeting prebooked customers shall have proof of pre- arranged reservations. Exhibit 'B" G:\BOBWIP\AWORT\GROUNDTR.97 12 5. Driver /Employees waiting for customers who have made pre- arranged reservations for services shall arrange to meet said customers in the designated commercial transportation greeting area of each respective terminal, if any. Solicitation, either through the use of visual aids, props, or verbal communication from this area is prohibited. Driver /Employees greeting prebooked customers from these greeting areas shall have proof of pre- arranged reservations. Each Owner may have no more than one employee located in the greeting area to direct prebooked customers to their waiting vehicles. 6. Fights, foul language, gestures, threats, threatening displays or any loud or rude displays are prohibited. 7. Horseplay, games and contests are prohibited. 8. Use or possession of alcoholic beverages or controlled substances is prohibited by Drivers /Employees while on duty, and while in or around Owner vehicles and facilities on the Airport. Consumption of alcoholic beverages within the terminal is prohibited except on the premises of a food and beverage vendor. 9. Drivers /Employees must be clean and neatly attired and groomed. 10. All ground transportation vehicles must be at all times clean (internal and external), sanitary and free from trash and debris. 11. Should a Driver /Employee disagree with a directive by a terminal operator or the Airport Manager (or his /her designee), he /she shall be obligated to comply immediately with the directive, but he /she or the Owner may thereafter file a written protest with the Airport Manager within seven (7) days. The protest will be resolved by the Airport Manager. If the Driver /Employee or Owner desires to appeal a directive made by the Airport Manager, it can do so by writing a letter to the County Administrator within seven (7) days stating the reasons that the decisin is unfair or improper. The County Administrator may ask for additional information and may hold a conference of the interested persons before making a judgment, which judgment shall be final. Section V Traffic Regulations from the Terminal Area Regulations within this section shall apply to the operation and parking of all motor vehicles. Exhibit "B" GABOB WIPVdRPORT \GROUNDTR.97 13 r`s 1. All vehicles shall be operated from only those areas specifically designated for passenger unloading, staging, stacking (queuing) and loading as identified on the maps of Terminal A (ECAT's terminal) attached hereto as Exhibit A and of Terminal B (VBCJC's terminal) attached hereto as Exhibit B. 2. Shaded areas on Exhibit B, including the terminal, are controlled by VBCJC. Commercial operations in those areas is limited to passenger pickup and drop -off in the area immediately in front of the terminal doors, except by separate arrangement with VBCJC. 3. Passenger Drop -Off. Referring to Exhibit A (ECAT), all departing passengers in commercial ground transportation vehicles must be delivered to the east of the Terminal in the drop -off area. Referring to Exhibit B (VBCJC), all departing passengers in commercial ground transportation vehicles must be delivered in front of the Terminal in the Areas marked Areas 1, 2 and 3. The term Odeparting passenger0 identifies a passenger who is involved in departing the Airport in a commercial airline aircraft. Parking (unattended vehicles) is not permitted in these areas. Attended vehicles (operative vehicles with a licensed Driver /Employee inside) in these areas are limited to the time required to unload passengers and baggage. No stopping and waiting is allowed in either area. 4. Taxicabs, limousines, buses, vans, and courtesy vans operating on the Eagle County Regional Airport and which are waiting to pick -up arriving passengers shall park in the pick -up area of Exhibit A or Area 3 on Exhibit B, except by separate agreement with VBCJC or the Airport Manager. 8. All Driver /Employees shall comply with all traffic control and parking signage. Unless otherwise marked, the speed limit on the Airport is 20 mph. 9. Vehicles must park and operate in designated areas as outlined in these rules and regulations or as otherwise designated by the Airport Manager. Vehicles parked in designated commercial areas must be in the process of loading or unloading passengers. Vehicles may not be staged in parking areas. Vehicles parked or operating other than outlined will be considered in violation of the Ground Transportation Rules and Regulations. Section VI Penalties 1. Owners and Drivers /Employees violating any of the Airport Rules and Regulations or these Airport Ground Transportation Rules and Regulations will be subject to criminal Exhibit "B" GA\BOB WIP\AIRPORT \GR0UNDTR.97 14 or traffic prosecution or civil penalties as provided by other applicable Colorado law, in addition to any penalties provided for herein. Every Driver /Employee offense also will be deemed a violation by the Owner for whom the Driver /Employee works. 2. Infractions will be cumulative. Drivers /Employees receiving three (3) written notices of infractions during a Permit Year will be denied access to the Airport for one calendar year from date of the third notice. Each Driver /Employee notice will also be recorded as a Owner's infraction. After the cumulation of six (6) written infraction notices for any Owner, the Owner may be denied access for one calendar from the date of a written expulsion notice. 3. Permits may be suspended for violations considered especially serious, including but not limited to the following: a. Commission of a violent act against another person or active participation in a violent incident on the Airport. b. Conviction of a misdemeanor or felony for conduct occurring on the Airport. G. Conviction or guilty plea on a charge of careless or reckless driving on the Airport. d. Driving a taxicab, limousine, bus or courtesy van while under the influence of alcohol or drugs, or driving the same while ability is impaired by alcohol or drugs on the Airport. e. Operation of vehicles without proper PUC and /or ICC markings, without current PUC and /or ICC inspections or in an unsafe condition on the Airport. f. Violating PUC or ICC regulations with respect to fare and meter displays. g. Failing to pay fees to County when due. h. Damaging property, equipment, improvements or facilities on the Airport owned by any person. Behavior indicating disregard of life, health or safety of persons on the Airport. 4. Should an Owner or Driver /Employee disagree with a written notice of violation of these rules and regulations he /she or the Owner may file a written protest with the County Administrator within seven (7) days of the date the notice of violation was mailed or delivered. The County Administrator may ask for additional information and may hold Exhibit 'B" WBOB WMAIRP ORIIGROUNDTR.97 15 a conference of the interested persons before making a judgment, which judgment shall be final. The County Administrator shall make his /her decision within fourteen (14) days of receipt of the protest, which decision shall be final. Exhibit "B" G:\BOBWIP\AIRPORT\GROUNDTR.97 16 5. Appeals to the Board of County Commissioners may be taken by any person aggrieved by the decision of the County Administrator based upon or made in the course of the administration of the provisions hereof. Such appeals must be made within thirty (30) days after the date the County Administrator's decision is mailed or delivered. The Notice of Appeal will be filed with the Clerk of the Board of County Commissioners and shall include the following information: a) Appellant's name and postal, b) The date of the decision appealed from and a copy of the decision, c) Any applicable rules or regulations pertaining to the decision being appealed from, d) Brief factual description setting forth the particulars and reasons for the appeal, and e) Any other information as may be required by the Board of County Commissioners. Upon receipt of a Notice of Appeal, the Clerk shall schedule the appeal for hearing before the Board, which hearing shall not be later than thirty (30) days from the time of receipt. Written notice of the date, time and place of the hearing shall be given not later than twenty (20) days prior to the date of hearing to the appellant by mail to the address shown on the Notice of Appeal. Not later than ten (10) days before the scheduled hearing, any and all exhibits, testimony and evidence of whatsoever kind to be relied upon by the appellant shall be delivered to the Clerk. At the hearing the Board shall consider all of the evidence transmitted to the Clerk and any additional evidence which it deems appropriate. Within twenty (20) days from the date of the hearing the Board shall issue its written ruling affirming, modifying or reversing the decision which is the subject of the appeal and a copy of the ruling shall be mailed to the appellant.
