PD- 353 -96 -S WHEREAS, on or about May 15 , 196 , the County of Eagle, State of Colorado, accepted for filing an application submitted by Colorado Pacific Construction (hereinafter "Applicant ") for approval of the Planned Unit Development Sketch Plan for Mountain Shadows Condominiums File No. PD- 53-96-S ; and, WHEREAS, the Applicant requested the approval of a Planned Unit Development (PUD) Sketch Plan which would allow for the development as follows: 72 Multi - Family dwelling units in three buildings on 5 acres ; and, WHEREAS, notice of the Sketch Plan was given to all proper agencies and departments as required by the Eagle County Land Use Regulations, Section 2.17.02(1); and, WHEREAS, at its public hearing/hearings held on July 3 & August 7. 1996, the Planning Commission, based upon its findings, recommended approval of the proposed PUD Sketch Plan, with certain conditions; and 1111111111111111111111111111111111111111111111111111111111111111111111111 614341 02/11/1997 02:54P B718 P368 370 1 of 5 R 0.00 D 0.00 N 0.00 Eagle, Colorado Page 1 of 5 C J'. P"I WHEREAS, at its regular hearings of August 20, September 17 & October 1 1996, the Eagle County Board of Commissioners (hereinafter 'Board "), considered the PUD Sketch Plan, associated plans, and the statements and concerns of the Applicant, the Eagle County Community Development and Engineering staff, and other interested persons. BASED ON THE EVIDENCE BEFORE IT, and with the modifications imposed by the conditions hereinafter described, THE BOARD FINDS AS FOLLOWS: The proposed Sketch Plan is in conformance with the Master PIan; to the extent applicable, with the Edwards Sub -Area Plan ; and with policies, guidelines, zoning and other applicable regulations. Furthermore, the resulting development will not be inconsistent with the Master Plan objectives. Specifically with regard to the Master Plan, the Board further fmds the development of this project as proposed: a. to have a full range of public services available. b. to have a significant economic determinant to Edwards and to the County generally. ® Page 2 of 5 C. to have minimized any negative effects on the social and natural ® 0 environment. ® v m ®n a d. to be capable of being phased in order to address current and anticipated market conditions. _0 . �o v ®0 w 2. The land included in the proposed Sketch Plan is suitable for subdivision. ®mm ®n m 3. Comments and recommendations from the agencies listed in Eagle County =� = Land Use Regulations, Section 2.17.02(1), have been considered. ®m o 4. The evidence shows that access which is capable of servicing the ®� development from the state highway system to the parcel of land proposed ®N m for subdivision can be built by the Applicant. ®mm _ w 5. The area around the development can be planned to be in substantial ° harmony with the proposed PUD. —W cm Page 2 of 5 6. No adjacent and nearby communities will be detrimentally affected by the proposed PUD. 7. The PUD can be completed within a reasonable period of time, to be determined prior to final approval of the PUD. 8. The proposed commercial development within the proposed PUD is justified. 9. The streets, as proposed, are adequate to support the anticipated traffic, and the development will not overload the streets outside the planned area. 10. Proposed utiliiy and drainage facilities, upon their conformance to the conditions set forth herein, are adequate for population densities and the type of development proposed. 11. The employee housing plan is acceptable. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY m COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: � L -® �=r 0 o AMU o :' THAT, the application for approval of the Planned Unit Development Sketch Plan �W w for Mountain Shadows Condominiums be and is hereby granted, subject to compliance o with the following conditions: —mm —v Hinz w ® 1. The PUD Guide needs further detailing and restrictions including but not o necessarily limited to the following: a) Lighting of common space b) Building Height = 37' to the mid point of the roof N x c) 2.75 parking spaces per unit s d) Lot Cover by buildings = 20% Rr ° e) Impervious cover = 60% f) Floor area Ratio = 45% 2. Provisions of ownership and maintenance of common facilities should be detailed; Page 3 of 5 C1 3. Provisions for a homeowner's association should be developed including stipulations for the rental of units and per bedroom occupancy of units by adults as proposed; 4. Items of concern identified by the Eagle River Watershed Plan shall be addressed in detail; 5. The necessary agreements to co- develop the Riverwalk Open Space to the north shall be finalized; 6. Bridge construction scheduling, maintenance and insurance shall be finalized as well as the necessary agreements with relevant property owners; 7. The development shall be renamed so as to avoid any possible confusion with other projects in the County; ® u 8. County Engineer's concerns shall be addressed in detail including but not necessarily limited to: -m a) State Highway Access Permit prior to Final Plat approval, ®a im b) Traffic study, ®GO w c) Hydrology, hydraulics and soils reports, ®m m d) Identify high watermark and 100 -year FP, ®� z e) Detailed storm and melt water filtration and discharge plan. ®Nm =0 m 9. Letters from utility providers stating that the development can be served =r m ®� o including an ability to serve letter from Upper Eagle Regional Water ®� m Authority documenting the amount of water and current capacity to the ®� Division of Water Resources which shall be copied to the County; ®� 10. The community building and play area shall be designed and built with °o consideration given to the suggestions and requirements of the State — o Department of Human Services, Office of Child Care Services. Parking for the day care center employees shall be dedicated. THAT, the Sketch Plan submitted under this application and hereby approved, does not constitute a "site specific development plan" as that phrase is defined and used in �^ C.R.S. Section 24 -68 -101, et seq. Sketch Plan approval is expressly conditioned on the County's authority to impose further restrictions or limitations on the PUD which are necessitated by impacts which are not yet recognized or which are more severe than realized under the review given at the hearings on the Sketch Plan. Page 4 of 5 THE BOARD further finds, determines and declares that this Resolution is necessary for the health, safety and welfare of the inhabitants of the County of Eagle, State of Colorado.
