RESOLUTION REGARDING CONSOLIDATED HEARING ON PETITIONS
RELATING TO LAND IN THE EBY CREEK MESA SUBDIVISION
AND ORDER OF THE BOARD REGARDING EQUALIZATION OF THE
LAND IN SAID SUBDIVIS,IOON

BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 86 -E- '
WHEREAS, the Board of County Commissioners of Eagle
County, Colorado, organized as a Board of Equalization for the
purpose of adjusting, equalizing, raising or lowering the
assessment and valuation of real and personal property within
this County, fixed and made by the County Assessor for the
year 1986; and
WHEREAS, the Board of Equalization consolidated on its
own motion and without objection by the petitioners in CBOE
Docket numbers 86 -1, 86 -7, 86 -10, 86 -13, 86 -16, and 86 -17 for
hearing, all those petitions relating to vacant land in Eby
Creek Mesa Subdivision; and
WHEREAS, the taxpayers presented the petitions of appeal
to the County Assessor's valuation for the year 1986, claiming
grounds for relief thereunder stating the property described
in such petition was assessed too high, as more specifically
stated in said petitions; and
WHEREAS, the Board has made its findings on the evidence,
testimony and remonstrances and is now fully informed in the
premises.
THE BOARD OF EQUALIZATION FINDS:
THAT no unusual condition is present as provided for in
§ 39 -1 -104, C.R.S., to allow the Assessor to change the base
year level of value applied to property in 1985.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Eagle County, acting as the Eagle County
Board of Equalization,
ordered as follows:
that the Eagle County Assessor is
1. To return all property which was subject to an
appeal to the 1985 assessment.
2. For the purposes of Equalization, the Assessor is
directed to return all lands in the Eby Creek Mesa Subdivision
to the same assessment level as 1985.
2. No change is directed as to houses or other improve-
ments in the subdivision.
BE IT FURTHER RESOLVED that a Petition denied in part by
the Board of Equalization can be appealed to the Board of
Assessment Appeals, or the 5th Judicial District Court, Eagle
County, Colorado, within thirty (30) days of the entry of such
decision, § 39 -8 -108, C.R.S. 39 -8 -108, C.R.S. The appeal
forms and instructions for appeal to the Board of Assessment
Appeals can be obtained from: Board of Assessment Appeals,
Department of Local Affairs, 1313 Sherman Street, Room 518,
Denver, Colorado 80203.
MOVED, READ AND ADOPTED by the Board of County Commis-
sioners of the County of Eagle, State of Colorado, in its
capacity as the County Board of Equalization, at its regular
meeting held the � day of July, 1986.
