Home My WebLink AboutR86-046 application to operate solid waste disposal site and facilityCommissioner moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 86- i1k1- RESOLUTION APPROVING THE APPLICATION OF EAGLE COUNTY FOR A CERTIFICATE OF DESIGNATION TO OPERATE A SOLID WASTE DISPOSAL SITE AND FACILITY NORTH OF WOLCOTT, COLORADO WHEREAS, pursuant to Sections 30 -20 -101, et seg., C.R.S., application has been made by the County of Eagle, State--of Colorado, for a Certificate of Designation to. conduct a sanitary landfill operation on approximately 179 acres of land owned by the United States Bureau of Land Management (BLM) and located approximately one -half mile northeast of the existing Eagle County Landfill in portions of Sections 2 and 11, Township 4 South, Range 83 West of the 6th principal meridian, within unincorporated Eagle County; and WHEREAS, the Eagle County Planning Commission considered the aforementioned application at its regular meeting of May 21, 1986, and recommended approval of the issuance of a Certificate of Designation subject to certain conditions as set forth in the Planning Commission's record of proceedings therefor; and WHEREAS, the Board of County Commissioners of the County of Eagle, State of Colorado (hereinafter the "Board "), at its regular meeting of May 27, 1986, held a public hearing on the aforementioned application, pursuant to statute, at which time the Board received evidence from the Eagle County Department of Community Development; and WHEREAS, at said public hearing the Board further received a letter dated December 11, 1985, from the Colorado Department of Health recommending approval of the proposed sanitary landfill operation subject to certain conditions as set forth in the above - referenced letter; and f WHEREAS, notice of the said public hearing was - duly published in the Eagle Valley Enterprise in accordance with law; and WHEREAS, after full consideration of the relevant evi- dence, the Board does find: 1. That the use of the land for the proposed sanitary landfill operation complies with Section 2.09.01 of the Eagle County Land Use Regulations, 1982, as amended, and conforms to the Eagle County Master Plan. , 2. That water to the proposed sanitary landfill opera- tion will be provided by hauling, with sewage to be handled through the use of sanilet or other sealed vault type privies. 3. That the access road to the proposed sanitary landfill operation has already been upgraded. 4. That the proposed sanitary landfill operation is located in an isolated area and will be fenced to minimize wind blown trash. 5. That an operations and closure plan detailing all technical aspects of the proposed sanitary landfill operation has been prepared by Fox Consultants, Inc. 6. That the proposed sanitary landfill operation will be located in the only area of unincorporated Eagle County where deep bedded shales are present. NOW, THEREFORE, be it resolved by the Board of County Commissioners of the County of Eagle, State of Colorado: THAT, a Certificate of Designation be issued to the County of Eagle, State of Colorado, to conduct a sanitary landfill operation at the following location, to wit: Sixth Principal Meridian Township 4 South, Range 83 West Section 2: SE1 /4 SW1 /4, NEl /4 SW1 /4 SW1 /4, S1 /2 SW1 /4 SW1 /4, W1 /2 SW1 /4 SE1 /4 Section 11: NE1 /4 NW1 /4, N1 12 NW1 /4 NW1 /4, W1 /2 NW1 /4 NE1 /4, NW1 /4 SE1 /4 NW1 14 containing approximately 179.36 acres THAT, approval and issuance of the aforementioned Certif- icate of Designation shall be and is subject to the following -2- stipulations and /or conditions precedent that the applicant is deemed to accept by conducting said sanitary landfill operation: a) that an area shall be designated and made available for the storage of large trash bins used by trash collection companies, subject to the prior approval of BLM. b) that the sanitary landfill operation shall be conducted and operated in accordance with the Operations and Closure Plan prepared by Fox Consultants, Inc. c) that no liquids, including sludges or semi -solid sludges, shall be accepted for disposal at the sanitary landfill operation without prior approval of the Colorado Department of Health and the Board. d) that all groundwater monitoring wells shall be tested each quarter. The results of that analysis shall be submitted to the Colorado Department of Health follow- ing each sampling period. e) that all applicable permits of the Colorado Air Pollution Control Division and the Colorado Water Quality Control Division shall be obtained prior to the construc- tion and /or operation of any activities for which they are required. THAT, the applicant by acceptance of the Certificate of Designation agrees that said Certificate is subject to revoca- tion by the Board if the applicant fails to comply with this Resolution, any of the aforementioned stipulations and /or conditions as delineated herein, and /or any other rules, requirements, or regulations as adopted by the Board from time to time pursuant to Section 30 -20 -101, et seq., C.R.S. Box 850, Eagle, CO 81631 -This certificate is issued subject to the laws of the State of Colorado and especially under the provisions of Title 30, Article 20, Colorado Revised Statutes, as well as Res ution No. , adopted by the Board of County Commissioners on 2e,__ , 1986. -This certificate of designation may be temporarily suspended or revoked, after reasonable notice and public hearing, for failure of this site and facility to comply with all applicable laws, resolu- tions, and ordinances, or to comply with the provisions of C.R.S. Title 30, Article 20, or any rule, regulation or resolution adopted pursuant thereto. -Any change in operating procedure, or deviation from the applica- tion as submitted to the Board of County Commissioners and approved by the same, requires Board of County Commissioners' approval prior td implementing such change or deviation.
