HomeMy WebLinkAboutR86-043 amendment to beaver creek metro district fire codeCommissioner moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 86- '`It APPROVING CERTAIN AMENDMENTS TO THE BEAVER CREEK METROPOLITAN DISTRICT FIRE CODE WHEREAS, the Board of County Commissioners of the County of Eagle, State of Colorado (hereinafter the "Board "), has previously adopted Resolution Nos. 82 -7, 83 -36 and 84 -54, approving the fire code and certain amendments thereto adopted by the BEAVER CREEK METROPOLITAN DISTRICT; and WHEREAS, the Beaver Creek Metropolitan District by its Board of Directors did on April 15, 1986, adopt a certain amendment contained in Exhibit A attached hereto and made a part hereof by this reference, to its previously adopted fire code; and WHEREAS, the Beaver Creek Metropolitan District by its Board of Directors did on October 16, 1984, adopt a certain amendment contained in Exhibit B and attached hereto and made a part hereof by this reference, to its previously adopted fire code; and WHEREAS, § 32- 1- 1002(1)(d), C.R.S., provides no fire code shall apply in unincorporated portions of any county unless the governing body of the county adopts a resolution stating that such code shall be applicable in an unincorporated area of the county. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of the County of Eagle, State of Colorado, THAT the aforesaid amendments set forth on the attached Exhibit A and Exhibit B are hereby approved and shall be applicable within the boundaries of the Beaver Creek Metropolitan District. Loughran yam/ _ This Resolution passed by 15n of County Commissioners of the County Colorado. -2- vote of the Board of Eagle, State of Exhibit A Beaver Creek Metropolitan District Fire Code FIRE PROTECTION /LIFE SAFETY STANDARDS The following paragraph shall be added to this section: b. All residential units shall install a fully monitored fire detection panel, to include fire and fire trouble zones. The system type shall be noncoded, continuous ring, locking alarm. EXHIBIT A 2. OWNERSHIP AND OPERATION OF FACILITIES 2.1 Policy. The District is responsible for the maintenance, repair and replacement of all aspects of the monitor system serving each structural unit. 3. USE OF MONITOR SYSTEM 3.1 Permit. No unauthorized person shall make any connection with the monitor system without first obtaining a written permit from the District. 3.2 Protection from Damage. No unauthorized person shall maliciously, willfully, or negligently break, damage, destroy, uncover, deface or tamper with any structure, appurtenances or equipment which is part of the monitor system. 3.3 Violations of Rules and Regulations. 3.3.1 Any person found to be violating any of the provisions of this Resolution shall be served with written notice stating the nature of the violation and providing a reasonable time limit for satisfactory correction thereof. 3.3.2 In the event any person continues any violation beyond the time limit provided above, the District may discontinue the communications system, except the monitor system, upon written notice of at least five (S) days. 3.3.3 Any person violating any of the provisions of this Resolution shall become liable to the District for any expense, loss or damage occasioned by reason of such violation, including any attorney's fees incurred by the District. 4. CONNECTIONS AND SERVICE 4.1 Mandatory System. Each structural unit within the District shall connect to the District's monitor system, and no structural unit shall receive a certificate oir permit of occupancy, either temporary or other, unless said unit is connected to such a system. 4.2 motional System. Each structural unit may, but shall not be required to connect to the District's communications system. Fire Safety - 1.4 EXHIBIT 4.3 Connections. 4.3.1 owners shall make application therefor in writing to the Secretary of the District setting forth the name and post office address of the owner, the legal description of the owner's structural unit and the services desired by the applicant, whether monitor system only or the entire communications system. 4.3.2 Applications shall be made only in the name of the owner of the structural unit. 4.3.3 a) Applications for fire and life safety monitoring shall be made at the same time application is made for building permit. b) A fee as itemized in Appendix B shall accompany each application for connection to the fire and life safety monitoring system. 4.3.4 A fee as— itemized in Appendix A shall accompany each application for connection to the system for cable - television services. These payments shall be made to the Secretary of the District to cover the cost of connection as well as to compensate the District for its previous investment in the system. 4.3.5 Upon receipt of said application, together with the required accompanying data, material and fees, the Secretary shall, upon finding the same in order and in accord with this Resolution, grant the application for connection to the system and cause the tap and service connection to be made with the system. 4.3.6 Change in Customer's Equipment or Service. No change in the customer's equipment or service shall be made without the prior approval of the District being first obtained in writing. 4.3.7 Rates and Charges. See Appendix C and Appendix D. The fee schedules may be changed by the Board at any time following notice and hearing. Fire Safety - 1.5 4.3.8 Billing. Statements shall be rendered to the owner on a monthly basis in advance and may be billed along with charges for use of the system. Regular service charges shall begin when the building is partially ready for occupancy as evidenced by a certificate of occupancy issued by Eagle County. In the event that a building is partially ready for occupancy, only the completed portion shall be assessed the regular service charge. a) Bills will be mailed the same day of each monthly period and shall be payable within twenty -five (25) days from the date appearing on the statement. All bills which are not paid within twenty -five (25) days from the date appearing on the statement are delinquent, and the District shall have the right to assess an interest charge of 2 percent per month on the unpaid balance. b) Communications service including the monitor system may be discontinued by the District, in the event of any delinquency, following hearing and notice. Such hearing shall be held by the District at a regular meeting of the Board of Directors, at which time the customer shall have the opportunity to present evidence of payment to the Board. 4.3.9 Liability for Payment. The structural unit, the property owner and the occupant are deemed equally liable for charges of the District. The District is not bound by any agree- ments made between landlords and tenants. The District shall bill on a per building basis excepting structural units which are residential multiple living units, and suci, bill shall be sent to the address of the owner of the building according to the records of the Eagle County Assessor. 4.3.10 Payment of Tap Fees. The District is not bound by agreements f between vendors and vendees of structural or commercial units with respect to payment of tap fees. It shall be the responsibility of the vendee to ascertain whether tap fees have been paid by the vendor.
