RESOLUTION NO. 86y
APPROVAL OF SPECIAL USE PERMIT - E1 Jebel West Commercial /Bruin Creek
Nursery
FILE NO: - ZS- 228 -85
WHEREAS, Floyd Crawford did file an application with the
Eagle County Department of Community Development on or about February
14, 1986 , within the Commercial General Zone District; and
WHEREAS, a public hearing was held by the Board of County
Commissioners of the County of Eagle, State of Colorado, on March 25,
1986 and
WHEREAS, based on the evidence, testimony, exhibits, study of
the Master Plan for the unincorporated areas of Eagle County, comments of
the Eagle County Department of Community Development, comments of public
officials and agencies, the recommendation of the Eagle County Planning
Commission, and comments from all interested parties, the Board of
County Commissioners of the County of Eagle, State of Colorado, finds as
follows:
1. That proper publication and public notice was provided as
required by law for the hearing before the Planning Commission and the
Board of County Commissioners.
2. That the proposed special use conforms to the requirements
of Section 2.09 of the Eagle County Land Use Regulations.
3. That the proposed land use will be compatible with existing
uses in the area.
4. That for the above - stated and other reasons, the proposed
zoning is in the best interest of the health, safety, morals, convenience,
order, prosperity, and welfare of the citizens of Eagle County.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Com-
missioners of the County of Eagle, State of Colorado:
THAT the application of Floyd Crawford , File No. ZS- 228 -85 ,
for approval of a special use of greater than 22,000 square feet of
commercial development within the Commercial General Zone District
in the following described unincorporated area of Eagle County be approved:

THAT the following conditions shall be placed upon this approval
and that violation of any condition shall be the basis for revocation of
the permit:
1) The interior roads (i.e. Favre Lane and Gillespie Drive)
shall be paved, at the applicant's expense, when the average daily traffic
(ADT) on either road exceeds 200 cars, or when the ADT exceeds 100 cars
on the access to Highway 82.
2. An access permit will be needed from the State Highway
Department in regards to the proposed right turn in /right turn out on
Highway 82. At such time as the State Highway access permit is approved,
then Eagle County will begin the process to vacate the public right -of-
way through this area.
3. This proposed Special Use Permit, if approved, should be
reviewed by Eagle County in 5 years to determine if the closure of the
Highway 82 right in /right out access will be necessary.
4. All signing in this Master Plan area shall conform to
Eagle County's sign code, and shall have the required Eagle County sign
permit.
THAT the Board of County Commissioners directs the Department of
Community Development to provide a copy of this Resolution to the applicant.

the County of Eagle, State of Colorado, at its meeting held the

LEGAL DESCRIPTION
A parcel of land located in Lot 15, Section 34, Township
7 South, Range 87 West of the Sixth Principal Meridian, all
in Eagle County, Colorado; said parcel being more particularly
described as follows:
Beginning at a point on the Northerly Right -of -Way Line
Of State Highway No. 82, from which the Southwest Corner of
said Section 34 bears N.83 059'44 "W. 3607.10 feet distant;
thence approximately 379.57 feet along said Northerly Right -
of -Way Line and along the arc of a curve to the left with a
radius of 5770.00 feet, the chord of which bears N.64 °48'1211;x.
379.50 feet; thence N.00 015130 "E. 553.32 feet; thence
N.90 000'00 "E. 906.30 feet; thence S.04 032152 "W. 224.86 feet;
thence N.87 °34'11 "W. 527.99 feet; thence 5.02 °14119 "W.
513.50 feet to the point of beginning.
Said parcel contains 7.80 acres, more or less.
