RESOLUTION
OF THE
BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO

APPROVAL OF SPECIAL USE PERMIT - Vail Associates, Inc.
FILE NO. - ZS- 236 -86
WHEREAS, Vail Associates, Inc. did file an application
with the Eagle County Department of Community Development on or about
January 16, 1986 , within the Resource Zone District; and
WHEREAS, a public hearing was held by the Board of County
Commissioners of the County of Eagle, State of Colorado, on February 25,
1986 ; and
WHEREAS, based on the evidence, testimony, exhibits, study of the
Master Plan for the unincorporated areas of Eagle County, comments of the
Eagle County Department of Community Development, comments of public offi-
cials and agencies, the recommendation of the Eagle County Planning Commis-
sion, and comments from all interested parties, the Board of County Commis-
sioners, of the county of Eagle, State of Colorado, finds as follows:
1. That proper publication and public notice was provided as
required by law for the hearing before the Planning Commission and the Board
of County Commissioners.
2. That the proposed special use conforms to the requirements of
Section 2.09 of the Eagle County Land Use Regulations.
3. That the proposed land use will be compatible with existing
uses in the area.
4. That for the above - stated and other reasons, the proposed
zoning is in the best interest of the health, safety, morals, convenience,
order, prosperity and welfare of the citizens of Eagle County.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners
of the County of Eagle, State of Colorado:
THAT the application of Vail Associates, Inc. , File No. ZS- 236 -86
for approval of a special use of expansion of an existing ski area within the
Resource Zone District in the following described unincorporated area of Eagle
County be approved:

THAT the following conditions shall be placed upon this approval and
that violation of any condition shall be the basis for revocation of the permit:
1) The approval of Category III recognizes the conceptual
nature of the plan for Category III. The more specific
plan to be developed by Vail Associates for Category III
shall be reviewed by the Board of County Commissioners at an
advertised Public Hearing in 5 years. At that time, the
Board may adopt additional conditions concerning the develop-
ment of the Category III area.
2) Vail Associates shall commit to and participate in a joint
effort with the Town of Vail, Eagle County and other applic-
able agencies in developing a parking and transportation
plan for the County's review within 2 years. Vail Associate's
participation shall include a fair share economic committ-
ment to the task force, the studies and report production.
The County will hold a public hearing within the time frame
and may, at that time, impose additional conditions of ap-
proval regarding these issues.
THAT the Board of County Commissioners directs the Department of
Community Development to provide a copy of this Resolution to the applicant.
MOVED, READ, AND ADOPTED by the Board of County Commissioners of
the County of Eagle, State of Colorado, at its meeting held the
day of 19A, nunc pro tunc to the 25th day of
February 1986 .
