HomeMy WebLinkAboutR86-016 amendment to special use permit Elgia LaGrow7 RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION No. 86 16 APPROVAL OF AMENDMENT TO SPECIAL USE PERMIT - Elgia La Grow FILE NO. - ZS- 179 -85 WHEREAS, Elgia LaGrow did file an application for amendment with the Eagle County Department of Community Development on or about August 15, 1985 , within the Resource Zone District; and WHEREAS, a public hearing was held by the Board of County Commissioners of the County of Eagle, State of Colorado, on November 26 1985 and WHEREAS, based on the evidence, testimony, exhibits, study of the Master Plan for the unincorporated areas of Eagle County, comments of the Eagle County Department of Community Development, comments of public officials and agencies, the recommendation of the Eagle County Planning Commission, and comments from all interested parties, the Board of County Commissioners of the County of Eagle, State of Colorado, finds as follows: 1. That proper publication and public notice was provided as required by law for the hearing before the Planning Commission and the Board of County Commissioners. 2. That the proposed special use amendment conforms to the require- ments of Section 2.09 of the Eagle County Land Use Regulations. 3. That the proposed land use will be compatible with existing uses in the area. 4. That for the above stated and other reasons, the proposed zoning is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Eagle County. NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of the County of Eagle, State of Colorado: THAT the application of Elgia LaGrow , File No. ZS- 179 -85 . for approval of an amendment to allow a caretaker's unit at the existing special use of salvage yard and car impoundment within the Resource Zone District � t L } in the following described unincorporated area of Eagle County be approved: See Attached Legal Description THAT the following conditions shall be placed upon this approval and that violation of any condition shall be the basis for revocation of the permit: 1. All conditions of the original special use permit remain in full force and effect. 2. A building permit shall be applied for and obtained for the care- taker's unit. At the time of the issuance of the building permit, a County- approved water supply and septic system is required. 3. The area to be used for storage shall be limited to increments of 5 acres. The first 5 acres shall be fenced and used until full. At such times there is no more room within the first 5 acres, a second 5 acres shall be fenced and then may be used. This phasing plan shall continue, if needed, in 5 acre increments until the en- tire 39 acres is used. 4. LaGrow Road shall be maintained and watered or otherwise treated for dust control. 5. The property shall be properly signed, following the Eagle County Land Use Regulations pertaining to signs. The signs shall be as follows: a. One approach sign not to exceed 8 (eight) square feet in size nor 8 (eight) feet in height. b. One identification sign not to exceed 64 square feet in size, set back from the property line as required in the Land Use Regulations. THAT the Board of County Commissioners directs the Department of Community Development to provide a copy of this resolution to the applicant.
