FILE NO: - ZS- 233 -85 WHEREAS, Eagle- Gypsum Ltd. did file an application with the Eagle County Department of Community Development on or about October 15, 1985 , within the Industrial Zone District; and WHEREAS, a public hearing was held by the Board of County Commissioners of the County of Eagle, State of Colorado, on December 10 , 1985 ; and WHEREAS, based on the evidence, testimony, exhibits, study of the Master Plan for the unincorporated areas of Eagle County, comments of the Eagle County Department of Community Development, comments of public officials and agencies, the recommendation of the Eagle County Planning Commission, and comments from all interested parties, the Board of County Commissioners of the County of Eagle, State of Colorado, finds as follows: 1. That proper publication and public notice was provided as re- quired by law for the hearing before the Planning Commission and the Board of County Commissioners. 2. That the proposed special use conforms to the requirements of Section 2.09 of the Eagle County Land Use Regulations. in the area. 3. That the proposed land use will be compatible with existing uses NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of the County of Eagle, State of Colorado: That the application of Eagle- Gypsum, Ltd., File No...ZS- 233 -85 for approval of a special use to construct and operate a gypsum wall board manufacturing plant within the Industrial Zone District in the following described unincorporated area of Eagle County be approved: See attached legal description r a THAT the following conditions shall be placed upon this approval and that violation of any condition shall be the basis for revocation of the permit: 1. A water augmentation plan may be required. 2. A detailed drainage plan, which should specifically show the settling ponds and the effluent treatment areas, is required prior to building permit. 3. A discharge permit may be needed from the State Water Quality Control Division. 4. An emissions permit may be required from the State Department of Health - Air Quality Control Division. 5. A fugitive dust control plan will be required prior to building permit. 6. A state Highway access permit is required. 7. A detailed landscaping plan showing size, quantity, species, and location of plant materials is required. (The large ever- green trees located on the northeast side of the proposed building should be preserved). 8. A Standard Avigation Easement is required, between Eagle County and applicant, prior to building permit. 9. A crossing agreement is needed from Denver and Rio Grande Western. 10. Volume of sound generated shall be within the limits specified in Section 2.07.07 - Industrial Performance Standards - of the Eagle County Land Use Regulations. THAT the Board of County Commissioners directs the Department of Community Development to provide a copy of this Resolution to the applicant.
