PD- 337 -95 -S2 F Am WHEREAS,.on or about August 31 1 , 1995, the County of Eagle, State of Colorado, accepted for filing an application submitted by Summit Habitats, Inc. (hereinafter "Applicant ") for approval of the Planned Unit Development Sketch Plan for Knudson Ranch PUD File No. PD 337 95 - S2 ; and, WHEREAS,.the Applicant requested the approval of a Planned Unit Development (PUD) Sketch Plan which would allow for development as follows: 26 single family attached dwelling units on a common lot as illustrated on the alMroved site Flan, dated November 13, 1995 and, WHEREAS, notice of the Sketch Plan was given to all proper agencies and departments as required by the Eagle County Land Use Regulations, Section 2.17.02(1); and, WHEREAS, at its public hearing held November 1, 1995, the Planning Commission, based upon its findings, recommended approval-of the proposed PUD Sketch Plan, with certain conditions; and WHEREAS, at its regular hearing of November 14, 1995, the Eagle County Board of Commissioners-(hereinafter "Board "), considered the PUD Sketch Plan, plans, and the. C: statements and concerns of the Applicant, the Eagle County Community Development and Engineering staff, and other interested persons. BASED ON THE EVIDENCE BEFORE IT, and with the modifications imposed by the conditions hereinafter described, THE BOARD FINDS AS FOLLOWS: 1) The Knudson Ranch PUD is in general conformance with the Master Plan, Open Space Plan, policies, guidelines, zoning and other applicable regulations as identified above; In addition, a 1041 permit for extension of water and sewer service is required and will be considered in conjunction with the Preliminary Plan application. 2) The land is suitable for subdivision with the conditions as recommended by staff; 3) Comments and recommendations from the agencies listed in Section 2.17.02(1) have been considered; 4) The parcel of land proposed for subdivision has access to the.state highway system, however, road improvements must be made to be capable of servicing the development. 5) Resulting development will be consistent with the Master Plan objectives; 6) The area around the development can be planned to be in substantial harmony with the proposed PUD; 7) The adjacent and nearby communities will not be detrimentally affected by the proposed PUD; 8) The PUD can be completed within a reasonable period of time, which shall be determined prior to final approval of the PUD; 9) The proposed industrial development has been justified; not applicable 10) The streets can be improved to be adequate to support the anticipated traffic and the development will not overload the streets outside the planned area; 11) Proposed utility and drainage facilities can be improved to be adequate for the population densities and type of development 12) An employee housing plan is not applicable. P" C C NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the application for approval of the Planned Unit Development Sketch Plan for Knudson Ranch PUD be and is hereby granted, subject to compliance with the following conditions: 1. A maximum of 26 single family attached dwelling units on a common lot, with no more than three units per structure or building. 2. The Preliminary Plan shall include design standards and a landscape plan which illustrates visual continuity and consistency with the Arrowhead PUD. 3. The Preliminary Plan shall include a reclamation plan for the cut slope above the units. 4. A feasibility analysis for utilizing the on -site spring for landscape irrigation. 5. A detailed wildlife mitigation plan and Wildlife Mitigation Agreement with the Colorado Division of Wildlife shall be submitted with the Preliminary Plan. THAT, the Sketch Plan submitted under this application and hereby approved, does not constitute a "site specific development plan" as that phrase is defined and used in C.R.S. Section 24 -68 -101, et seq. Sketch Plan approval is expressly conditioned on the County's authority to impose further restrictions or limitations on the PUD which are necessitated by impacts which are not yet recognized or which are more severe than realized under the review given at the hearings on the Sketch Plan. THE BOARD further finds, determines and declares that this Resolution is necessary for the health, safety and welfare of the inhabitants of the County of Eagle, State of Colorado. 3 C C i MOVED, READ AND ADOPTED by the Board of County Commissioners of the County of Eagle, State of Colorado, at its regular meeting held the 4 L day of e me&,- , 19-q-C. nunc pro tunc to the 14th day of November, 1995.
