WH EREAS , on or about September 28, 1993, pursuant to C.R.S.
30 - 28 - 137, the Board of County Commissioners of the County of
Eagle, State of Colorado ( "Board "), entered into a Subdivision
Improvements Agreement ( "Agreement ") with Basalt Trade Associates
( "Subdivider ") as a condition of final plat approval of Summit
Vista, Lot 1, Resubdivided as Sopris View Apartments; and
WHEREAS, in order to guarantee the faithful completion of
certain public improvements required under the Agreement, the Board
accepted collateral sufficient in the judgment of the County
Attorney to guarantee the completion of public improvements
associated with Parcel II; and
WHEREAS, by Eagle County Resolution No. 93 -147 the Board
commenced the two warranty period for Parcel II, and set the
expiration date to December 6, 1995; the Board further retained
$1,750.00, or ten percent of the original cost estimate, which was
to be held for the duration of the warranty period; and
WHEREAS, Subdivider has represented that the subdivision
improvements for Parcel II have satisfactorily survived the
warranty period; and
WHEREAS, BASED upon the written recommendations of the
Department of Enffineering (see Exhibit A, attached hereto and
incorporated herein by this reference) the Board finds that the
warranty period for Parcel II only, has been successfully completed
and that the full release of the collateral is appropriate.

THAT, the Board hereby authorizes the full and final release
of collateral in the amount of $1,750.00
THAT, this resolution shall be recorded in the Records of the
Eagle County Clerk and Recorder, which shall be evidence that the
warranty period for II of the Sopris View Apartments has
been successfully completed and that the Subdivider's obligations
under are complete, in regards to Parcel II only.
MOVED, READ AND ADOPTED by the Board of County Commissioners
of the County of Eagle, State of Colorado, this I?EX, day of
December, 1995.

RE: Sopris View Apartments, Parcel II
Was over to . the Sopris View Apartments on Tuesday, November 14,
1995 to review this project. The warranty period for Parcel II is
up soon and I saw no -problems with the public structure and
landscaping in this phase. Would suggest releasing the collateral
for Parcel II warranty period. The County will not take over
maintenance of any roads or structures. most of the public
improvements were installed in an "Access, Landscaping, Parking,
Utility and Drainage Easement."
