Resolution flU BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 96 - - / cq g: S RESOLUTION GRANTING A SPECIAL PERMIT FOR TEMPORARY HOUSING FOR Ron Brown, Canyon Woods /21700 Hwy-G FILE NO. T -29 -95 WHEREAS, the Board of County Commissioners of the County of Eagle, State of Colorado ( herinafter the "Board"); is authorized to grant temporary housing permits, pursuant to Chapter II, Section 2.07.09 of the Eagle County Land Use Regulations; and WHEREAS, Ron Brown (hereinafter the "Applicant "), applied to the Eagle County Department of Community Development for a temporary housing permit on July 1, 1995, within the PUD Zone District; and WHEREAS, based on the evidence, testimony, exhibits, study of the Master Plan for the unincorporated areas of Eagle County, - comments of the Eagle County Department of Community Development, comments of public officials and agencies, the recommendation of the Planning Commission, and comments from all interested parties, the Board of County Commissioners of the County of Eagle, State of Colorado ( "the Board "), finds as follows: 1. That proper publication and public notice was provided as required by law for the hearings before the Planning Commission and the Board. 2. That the proposed use of the temporary housing permit conforms to the requirements of Section 2.07.09 of the Eagle County Land Use Regulations. 3. That the proposed special use will be compatible with existing uses in the area. 4. That for the above - stated and other reasons, the proposed zoning is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Eagle County. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the Board hereby approves a special permit for temporary housing for Ron Brown, provided the following conditions are met: 1. Fisher Eagle County Clerk & Recorder 0.00 Ril Ni 2. The u )of the temporary housing ice was approved by the property owner's association and is not a violation of the subdivision covenants. 3. 'Certificate of Occupancy for the single family residence shall be withheld until the temporary housing unit is converted back to storage. THAT, should Applicant not comply with any or all of the conditions,. the temporary housing permit shall be revoked. THAT, the Board of County Commissioners directs the Department of Community Development to provide a_copy of this. Resolution,to the Applicant. THAT, the Board hereby finds, determines and declares that this Resolution is necessary for the health, safety and welfare of the citizens of'Eagle County.
