WHEREAS, on or about June 15. 1995, the County of Eagle, .
State of Colorado, .accepted for filing an application submitted by
Harold Leonard (hereinafter "Applicant") for approval of the
Subdivision Preliminary Plan for the Pa_rkside @ E1 Jebel
Subdivision, File No. SU-336-95-P; and
WHEREAS, on August 15, 195, the Board of County
Commissioners of Eagle County, Colorado, approved the Subdivision
Sketch Plan for the Parkside @ E1 Jebel Subdivision, File No. SU-
336-95-P, subject to certain conditions; and
• WHEREAS, at its public hearing/hearings held August 3.
1995, the Planning Commission, based upon its findings,
recommended approval of the proposed Subdivision Preliminary Plan,
with certain conditions; and --
WHEREAS, a public hearing was held by the Board of County
Commissioners of the County of Eagle, State of Colorado, on
August 15, 1995, 1995, to consider this Preliminary Plan
application; and ~ .
WHEREAS, based on the evidence, testimony, exhibits, study
of the Master Plan for the unincorporated areas of Eagle County.,
comments of the Eagle County Department of Community Development,
comments of public officials and agencies, the recommendation of
the~Planning Commission, and comments from all interested parties,
the Board of County Commissioners of the County of Eagle, State of
Colorado, finds as follows:
1. That proper publication and public notice was
provided as required by law for the hearing before
the Planning Commission and the Board of County
Commissioners. ~
2. That information required by•the Board of County ~
Commissioners at Sketch Plan is applicable. ~

APPROVAL OF THE SUBDIVISION PRELIMINARY PLAN

WHEREAS, on or about June 15. 1995, the County of Eagle,
State of Colorado, accepted for filing an application submitted by

Commissioners at Sketch Plan is applicable.
3. That the proposed Preliminary Plan is in conformance
with the Sketch Plan and that the proposed
subdivision conforms to all applicable regulations,
policies and guidelines.
4. That comments and recommendations from the agencies
listed in the Eagle County Land Use Regulations,
Section 2.17.02(1), have been considered.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of the County of Eagle, State of Colorado:
THAT, subject to the conditions set forth below, the
application submitted by Harold Leonard for approval of a
Preliminary Plan for the Parkside @ E1 Jebel Subdivision be~and is
hereby approved for the following described parcel of land:
EXHIBIT A
THAT, the following conditions are hereby placed upon this
approval:
1. The County shall not accept the road for maintenance until
such time as the entire road is completed through other
properties to the west. The Final Plat shall include plat
notes concerning the ultimate intent of the road and a
small scale map displaying that intent as well as the fact
that the County will not accept the road for maintenance
until it is completed;
2. A minimum 4 foot earth berm and landscape barrier shall be
shall be installed and maintained by the applicant. On-
street parking will be restricted with signage provided by
the applicant;
3. Plat items:
a) Remove all setback references from the plat including
the "building envelopes"; ~ _
b) The Land Use Table shall contain addressing;
c) Each internal lot line shall have a minimum 7.5' of
drainage and utility easement on both sides of the
line. The external lot lines shall have a minimum of
a 10' drainage and utility easement;
d) The Planning Commission Certificate shall read
"Roaring Fork Planning Commission".
THAT, the Parkside @ E1 Jebel Preliminary Plan submitted
under this application and hereby approved, does not constitute a
"Site Specific Development Plan" as that phrase is defined and.
used in C.R.5. 24-68-101, et seq.

Principal Meridian, County of Eagle, State of Colorado, being more Particularly
described as follows:
Note:
The basis of bearings for this description shall be S88°10'46"E (assumed) between
Corner No. 3 of said Tract 39 and the closing corner of Section 3 Township 8 South,
Range 87 West, both U.S. G.L.O. brass caps found in place.
Commencing at Corner No. 3 of said Tract 39, a G.L.O. brass cap found in place along
the North line of said Tract 39, S88°07'00"E,1297.39 feet to the Point of Beginning,
thence continuing along the North line of said Tract 39, S88°07'00"E, 374.50 feet; thence
S02°07'41"E, 343.16 feet to the Northerly right-of--way line of the County Road;
