NOVEMBER 7, 1995, A QtJBSTI:ON

AND EXPENDITORE LJX[TATl:ONS
WHEREAS, the County of Eagle is a growing county in need of
additional capital improvement projects and enhanced county
services; and
WHEREAS, the Board of County Ccmnissioners finds and
dete:r:mines that the fundamental intent and purpose of Article X,
Section 20 of the Colorado Constitution is to errpower voters to
make decisions regarding the County's revenue and expenditure
limitations unrelated to any specific tax increase of dollar amount
of new revenue; and
WHEREAS, the Board of County Carmissioners of the County of
Eagle finds and detennines that it is in the best interests of the
County to request the electors voting in the General Election, to
be held November 7, 1995, to authorize an increase in revenue and
expenditure limitations for 1994 and each subsequent year ,without
any increase in tax rates, in the manner provided by law; and .
WHEREAS, because of a healthy econany and increased
development, the County has already exceeded its revenue
limitations for 1994, and that same development has caused the need
for increased gove:rnmental services; and
WHEREAS, the Board of county Corrmissioners finds and
dete:r:mines that such requested authorization is permitted nnder
Article X, Section 20 of the COlorado constitution; and

WHEREAS, the Board of County corrmi.ssioners in the interest of
long-tenn Connty efficiency and in saving cost to the taxpayers,
that the matter be referred to the voters in the fonn provided for
herein and Resolution No. 95-87 should be repealed.
Nrn, 'mEREFORE, BE IT RESOLVED BY '!HE BOARD, OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COIDRAOO:
THAT, the following ballot question is hereby certified to
the Eagle Connty Clerk and Recorder and shall be suhnitted to the
electors voting in the General Election to be held on November 5,
1995: '
SHALL EAGLE COUNTY, WI'IHOur ANY INCREASE IN THE PROPER'IY TAX
MILL LEVY OR SALES TAX RATES, BE AUIHORIZED 'It) COLLECT, REmIN AND
EXPEND ALL REVENUES AND aI'HER FUNDS COLLECI'ED' DURING 1994 AND EACH
SUBSEQUENT YEAR NOIWITHSTAND~ ANY STATE ~aa4NCLUDING '!HE
LIMITATIONS OF ARTICLE X, SECI'ION 20 OF '!HE COIDRADO CONSTITUTION,"
(CCMJIONLY KNOWN AS '!HE TABOR AMENDMENT)

THAT, upon approval of the above question by majority of the
registered electors voting thereon, the' Connty of Eagle shall be
authorized to increase its revenue and expenditure limitations for
1994 and each subsequent year, without any increase in the property
tax mill levy and use and sales tax rates. '!he Connty of Eagle
shall further be authorized to receive and expend state grants; and
to ,receive and expend sales tax, use tax and property tax revenues
for capital projects and other connty services without limiting the
amount of other revenues that may be collected and spent by the
County of Eagle.
Pursuant to the provisions of ~1-40-106 (2) C.R.S. 'the connty
Clerk and the Board of County corrmi.ssioners sitting as the title
board shall set the ballot title of this measure by resolution
prior to September 12, 1995.
Resolution No. 95-87 is hereby repealed.
