OF THE
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 9~-~_
APPROVAL OF AMENDMENT OF
THE BLUE LAKE PLANNED UNIT DEVELOPMENT
FILE NO. PD-207-94-A
WHEREAS, on or about November 11, 1994, the County of Eagle, State
of Colorado, accepted for filing an application submitted by the Blue
Lake Owner's Association (hereinafter "Applicant") for amendment of the
Blue Lake Planned Unit Development Control Document, E1 Jebel, Colorado
(hereinafter the "PUD"), File No. PD-207-94-A; and
WHEREAS, the Applicant requested the amendment of the PUD for the
purposes of amending the Control Document to permit uses not previously
allowed, clarify language and resolve a rear setback discrepancy between
the Control Document and the R-10 Zone District ;
and
WHEREAS, notice of the proposed amendment was mailed to all owners
of property located within and adjacent to the PUD and was duly published
in a newspaper of general circulation throughout the County concerning,
the subject matter of the application and setting forth the dates and
times of hearings for consideration of the application by the Planning
Commission and the Board of County Commissioners of County of Eagle,
State of Colorado (hereinafter the "Board"); and
WHEREAS, at its public meeting held March 16, 1995, the Roaring Fork
Planning Commission, based upon its findings, recommended approval with
conditions of the proposed PUD Amendment; and
WHEREAS, at its public meeting hearing of May 2, 1995, the Board ~
considered the PUD Amendment application, associated plans and the
statements and concerns of the Applicant and the Eagle County staff.
Based on the evidence, testimony, exhibits, review of the Eagle }..;.,
County Master Plan, the recommendation of the Planning Commission and
staff, and comments from all interested parties, the Board finds as
follows:

staff, and comments from all interested parties, the Board finds as
follows:

. 1. The proposea amendment to the Blue Lakc Planned Unit
Development is consistent with the efficient development and
preservation of the entire PUD.
2. The proposed amendment does not affect in a substantially
adverse manner either the enjoyment of the land abutting upon
or across the street from the PUD or the public interest.
3. The proposed amendment shall not solely confer a special
benefit upon any person.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS
OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the application submitted by the Blue Lake Owner's Association
for amendment of the Blue Lake Planned Unit Development be and is hereby
granted subject to the following conditions:
The PUD Control Document should include:
1. Language to the effect that the "Community Center building is
owned and operated by the Blue Lake Property Owner's
Association for the purpose holding events of civic or public
nature and benefit and not for personal or private gain. All
public, private, parochial and independent schools which
provide education comparable to or in substitution of that
provided in grades 1-12 are hereby specifically excluded.";
2. Professional office space of any kind should be considered by
Special Review only;
3. The R-10 Zone District listing the rear yard setback as 12.5'.
4. Another application to amend the PUD Guide as well as an
Amended Final Plat should be submitted to allow for the parking
and pavement use within Community Center Zone District or
within a zone district of its own. Items to be addressed
should include, but not necessarily be limited to, pavement
area measurements, pavement condition and design, drainage,
compaction tests, possible SIA and collateral issues, lighting,
signage and an irrigation pipe easement.
The Board finds, determines, and declares that this Resolution is
necessary for the health, safety, and welfare of the inhabitants of the
County of Eagle, State of Colorado.
MOVED, READ AND ADOPTED by the Board of County Commissioners of the
Count of Eagle, State of ~Q lorado, at its regular eeting held the
