BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 95- ~'
A RESOLUTION SUBMITTING
TO THE REGISTERED ELECTORS VOTING
IN THE GENERAL ELECTION, TO BE HELD
NOVEMBER 7, 1995, A QUESTION
CONCERNING AN INCREASE IN REVENUE
AND ERPENDITURE LIMITATIONS
WHEREAS, the County of Eagle is a growing county in need of
additional capital improvement projects and enhanced county
services; and
WHEREAS, the Board of County Commissioners finds and
determines that the fundamental intent and purpose of Article X,
Section 20 of the Colorado Constitution is to empower voters to
make decisions regarding the County's revenue and expenditure
limitations unrelated to any specific tax increase of dollar amount
of new revenue; and
WHEREAS, the Board of County Commissioners of the County of
Eagle finds and determines that it is in the best interests of the
County to request the electors voting in the General Election, to
be held November 7, 1995, to authorize an increase in revenue and
expenditure limitations for four (4) years beginning with 1994,
without any increase in tax rates, in the manner provided by law;
and
WHEREAS, because of a healthy economy and increased
development, the County has already exceeded its revenue
limitations for 1994, and that same development has caused the need
for increased governmental services; and
WHEREAS, the Board of County Commissioners finds and
determines that such requested authorization is permitted under
Article X, Section 20 of the Colorado Constitution.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the following ballot question is hereby certified to
the Eagle County Clerk and Recorder and shall be submitted to the
electors voting in the General Election to be held on November 5,
1995:
SHALL EAGLE COUNTY BE AUTHORIZED TO DELAY UNTIL NOVEMBER 3,
1998 A VOTE UPON AND ALL BALLOT QUESTIONS ARISING UNDER ARTICLE X,
SECTION 20 OF THE COLORADO CONSTITUTION, EXCEPT•FOR PETITIONS,
BONDED DEBT, PROPERTY, SALES OR USE TAX INCREASES OR CONSTITUTIONAL
PROVISIONS; TO KEEP AND SPEND ALL REVENUES COLLECTED BY THE COUNTY
THROUGH 1998 REGARDLESS OF ANY LIMITATION CONTAINED IN ARTICLE X,
X, SECTION 20 OF THE COLORADO CONSTITUTION; AND TO THEREAFTER
UTILIZE 1998 FISCAL YEAR SPENDING AND REVENUES AS THE BASES UPON
WHICH THE SUBSEQUENT YEAR'S SPENDING AND REVENUE SHALL BE LIMITED
PURSUANT TO ARTICLE X, SECTION 20 OF THE COLORADO CONSTITUTION.
NOTHING IN THIS QUESTION CAN BE CONSTRUED TO REMOVE THE
REMAINING RESTRICTIONS OF ARTICLE X, SECTION 20 OF THE COLORADO
CONSTITUTION WHICH IS COMMONLY KNOWN AS AMENDMENT ONE AND/OR THE
TABOR AMENDMENT. THE REMAINING RESTRICTIONS ARE:
* VOTER APPROVAL OF ALL NEW TAXES AND TAX RATE INCREASES;
* VOTER APPROVAL FOR NEW OR ADDITIONAL COUNTY OF EAGLE
DEBT;
* ALL AD VALOREM PROPERTY TAX RESTRICTIONS REMAIN IN FULL
FORCE AND EFFECT;
* NO IMPOSITION OF A COUNTY
* ALL ELECTION REQUIREMENTS
REAL ESTATE TRANSFER TAX; AND
REMAIN IN EFFECT

THAT, upon approval of the above question by majority of the
registered electors voting thereon, the County of Eagle shall be
authorized to increase its revenue and expenditure limitations for
the following four years, without any increase in the property tax
mill levy and use and sales tax rates. The County of Eagle shall
further be authorized to receive and expend state grants; and to
receive and expend sales tax, use tax and property tax revenues for
capital projects and other County services without limiting the
amount of other revenues that may be collected and spent by the
County of Eagle. And thereafter shall use 1998 fiscal year
spending and revenues as the basis upon which the subsequent year
spending and revenues shall be limited pursuant to Article X,
Section 20 of the Colorado Constitution, commonly known as the
Tabor Amendment.
Pursuant to the provisions of §1-40-106(2) C.R.S. the County
Clerk and the Board of County Commissioners sitting as the title
board shall set the ballot title of this measure by resolution
prior to September 12, 1995.
