HomeMy WebLinkAboutMinutes 06/06/2022 PUBLIC HEARING June 06, 2022 Present: Jeanne McQueeney Chairman Matt Scherr Commissioner Matt Peterson Assistant County Attorney Absent: Kathy Chandler-Henry Commissioner This being a scheduled Public Hearing,the following items were presented to the Board of County Commissioners for their consideration: Planning File - Eagle County Room 1.Planning File: 451 and 453 Pine Marten,AFP-9245-2022 • Michael Sylvester, Community Development xri , Executive Summary: The applicant wishes to consolidate 451 Pine Marten Way and 453 Pine Marten Way by vacating the lot line between them. The applicant also proposes to remove the two existing building envelopes on the two lots, and create a new building envelope in the center of the resulting lot. Location: 451 and 453 Pine Marten Way Applicant(s): Marc and Lucy Footlik Representative: Anne Gunion Staff Planner: Michael Sylvester,Associate Planner Staff Engineer: Taylor Ryan, Matt Peterson: Assistant County Attorney The Applicants intend to vacate the lot line between 451 Pine Marten Way(Lot 11,Block 1 of Cordillera Subdivision,Filing 36) and 453 Pine Marten Way(Lot 10,Block 1 of Cordillera Subdivision,Filing 36)to combine the lots Additionally,the building envelopes on both lots will be removed and a new building envelope in the center of the resulting lot will be created. The Property is in the Cordillera Subdivision PUD("PUD"); therefore,the PUD Guide dictates the zoning of the Property. The PUD Guide states that building envelopes may be amended by submitting an amended final plat to Eagle County for either administrative approval or approval through a public hearing. Per the PUD,the administrative approval process is only available to applicants who have obtained written approval from all adjacent property owners within 75 feet of their property. The Applicants have not obtained such approval, so the public hearing process is required. The Property was originally platted in 1999 as a part of the Cordillera Subdivision, Filing 36, as Lot 10 and Lot 11. The subject lots are a part of Planning Parcel T,which includes "single-family residential"as a designated use according to the PUD Guide. Currently,both lots are vacant and the Applicants intend to use the combined lot for one single family home. Mr. Sylvester attended the meeting virtually. Anne Gunion, representative for the applicant, introduced Marc Footlik,the owner of the two parcels. She explained that the applicant wished to combine his two lots and vacate the lot line to provide a more central 1 06/06/2022 building envelope. She believed staff did an excellent job of reviewing the request and believed it met the required criteria. Mr. Sylvester presented a vicinity map which identified the two lots within the Cordillera PUD. The lot lines between lots 10 and 11 would be vacated. The new building envelope would be limited to 22,499.5 square feet which was in line with the Cordillera PUD guide. The application was received on April 5, 2022 and reviewed under Sections 5.290 as well as Section 5.210 and referred to 21 referral agencies and one public comment was received in favor of the proposal. He reviewed the standards and indicated that the application met all the standards for an Amended Final Plat and staff recommended approval of file no. AFP 9245-2022. Chairman McQueeney opened and closed public comment, as there was none. Commissioner Scherr believed the file was straightforward and he had no questions. Chairman McQueeney agreed with Commissioner Scherr and believed the application met the standards. Commissioner Scherr moved to approve the Amended Final Plat for 451 and 453 Pine Marten Way, Eagle County File No. AFP 9245-2022, authorizing the Chair to sign the Plat. Commissioner McQueeney seconded the motion. Of the two voting commissioners,the vote was declared unanimous.
