BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 95- 1
RESOLUTION APPROVING THE 1995 FISCAL YEAR BUDGET
FOR THE OFFICE OF THE DISTRICT ATTORNEY,
FIFTH JUDICIAL DISTRICT, STATE OF COLORADO
Whereas, §29 -1 -110, C.R.S. requires the Board of County
Commissioners of the County of Eagle, (hereinafter referred to as
the "Board "), to adopt a budget setting forth the expenditures of
the various county offices, departments, boards, commissioners and
other spending agencies for fiscal year 1995, beginning January 1,
1995, and ending December 31, 1995; and
WHEREAS, a public meeting on the proposed 1995 budget for the
County of Eagle was held on November 21, 1994; and
WHEREAS, the Board had made provisions within the 1995 budget
for the Office of the District Attorney, Fifth Judicial District,
State of Colorado, of which Eagle County is a part, in the amount
of $789,547.00, exclusive of additional revenue the District
Attorney may collect, representing a 2.7 percent increase from the
approv d 1994 budget of $769,077.00; and
WHER S, this final budget figure of $789,547.00 was derived
at by applying a credit for 1994 Unspent Revenue to the gross
adjusted County obligation amount of $815,891.00; and
WHEREAS, pursuant to §20 -1 -302, C.R.S., the District Attorney
is entitled to collect and receive the necessary expenses of
maintaining an office for the transactions of his official
business, in part from Eagle County; and
WHEREAS, all legal requirements have been fully complied with
and performed in the premises.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, based on the statutorily required proration, the Board
hereby approves the budgeted amount of $789,547.00 for the Office
of the District Attorney, Fifth Judicial District, State of
Colorado, of which Eagle County is a part, for the 1995 fiscal
year.
THAT, the share of said budget to be paid by Eagle County
shall be as follows:
1. District Attorney Salary (36% by caseload) $ 10,080.00
2. Staff /Operating Budget (45% by population) 351,626.00
3. 1994 Unspent Revenue Credit (45 %) (8,930.00)
4. Part -time attorney (100% for Eagle County) 11,183.00
TOTAL EAGLE COUNTY OBLIGATION: $363,959.00
THAT, Jack D. Lewis, the Eagle County Budget Officer, is
hereby requested and directed to immediately transmit a copy of
this Resolution to the officer of employee of the County of Eagle
whose duty it is to draw warrants or orders for the payment of
money, said warranty shall be issued in four (4) equal payments at
the beginning of each calendar quarter.
THAT, the Board hereby finds, determines and declares that
this Resolution is necessary for the public health, safety and
welfare of the residents of the County of Eagle, State of Colorado.
MOVED, READ AND ADOPTED by the Board of County Commissioners
