COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 9_f-__el_
DENIAL OF THE SUBDIVISION SKETCH PLAN
FILE NO. SU- 326 -94 -S
WHEREAS, on or about June 1, 1994, the County of Eagle, State
of Colorado, accepted for filing an application submitted by Isom
& Associates, Inc. for Robert S. Curreri (hereinafter "Applicant ")
for approval of the Subdivision - Sketch Plan for
The Curreri Subdivision, File No. SU- 326 -94 -S; and,
WHEREAS, the Applicant requested the approval of a Subdivision
Sketch Plan which would allow for the development as follows: The
subdivision of a 1.712 acre parcel into 3 lots, and as more
specifically described in Eagle County File No. SU- 326 -94 -S; and,
WHEREAS, notice of the Sketch Plan was given to all proper
agencies and departments as required by the Eagle County Land Use
Regulations, Section 2.17.02(1); and,
WHEREAS, at its public hearings held on December 7, 1994, The
Eagle and Colorado Valley Planning Commission, based upon its
findings, recommended denial'of the proposed Subdivision Sketch
Plan; and
WHEREAS, at its regular hearings on December 20, 1994,
the Eagle County Board of Commissioners (hereinafter "Board "),
considered the Subdivision Sketch Plan, associated plans, and the
statements and concerns of the Applicant, the Eagle County
Community Development and Engineering staff, and other interested
persons.
BASED ON THE EVIDENCE BEFORE IT, THE FINDS AS FOLLOWS:
a) The Sketch Plan is in general conformance with the
Edwards Sub -Area Master Plan and The Eagle County Open
Space Plan, however, it is not in complete conformance

with the Master Plan and other policies, guidelines,
zoning and other applicable regulations concerning sewage
disposal and cluster subdivisions;
b) The land is not suitable for subdivision as proposed;
C) Comments and recommendations from the agencies listed in
Section 2.17.02(1) have been considered;
d) The applicant has provided evidence that the parcel of
land proposed for subdivision has access to the state
highway system capable of servicing the development.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the application for approval of the Subdivision Sketch
Plan for The Curreri Subdivision Sketch Plan be and is hereby
denied.
THE BOARD further finds, determines and declares that
this Resolution is necessary for the health, safety and welfare of
'the inhabitants of the County of Eagle, State of Colorado.
MOVED, READ AND ADOPTED by the Board of County Commissioners
