This being a scheduled Public Hearing,the following items were presented to the Board of County
Commissioners for their consideration:
Constituent Input
Chairman McQueeney opened constituent input.
Joanne Rock from Eagle spoke. She referenced some research data she had recently gathered related to
water and forests. She shared key points from the foreword preface in Greg Peter's book National Forest: Stories
from America's Most Important Public Lands.
Chairman McQueeney closed constituent input.
Commissioner Updates
Commissioner Chandler-Henry reminded folks that the Eagle River Watershed Council would be hosting
their annual highway clean-up on April 30th. People could visit ERWC.org for information.
Commissioner Scherr stated that April was the month of many things including National County
Government Month. County government was one of the closest connections to state legislature and policy. He
encouraged anyone with input or ideas on statewide policy to reach out to state policy makers and/or the
commissioners.
Chairman McQueeney stated that it was also Month of the Young Child and Child Abuse Prevention
Month in the month April.
County Manager Updates
Jeff Shroll gave a shout out to the airport team as their season winded down. He also highlighted the Town
of Gypsum Election for mayor and town council taking place today.

Commissioner Chandler-Henry moved to approve the Consent Agenda for April 5, 2022 as presented.
Commissioner Scherr seconded the motion. The vote was declared unanimous.
Business Item
1. Resolution 2022-026 Approving Fare-Free Earth Day for ECO Transit

Executive Summary:
ECO Transit has been working with the Climate Action Collaborative to develop events and activities around Earth
Day.A suggested component of these events is a fare-free travel day on Earth Day,Friday,April 22. Revenue for an
average day in April is generally in the range of$2,000 to $2,300. The ECRTA Board supported the request for a
fare-free Earth Day at their February 9 Board Meeting and it is now being forwarded to the BoCC for final
approval. Staff recommends approval of this resolution as a way to celebrate the positive contributions public
transit makes to the environment.
Ms. Allen expressed excitement for the collaboration. This was a great opportunity to celebrate ECO
Transit's contribution to reducing greenhouse gas emissions and encouraging ridership.
Commissioner Scherr moved to approve the Resolution approving Faire-Free Earth Day for ECO Transit.
Commissioner Chandler-Henry seconded the motion. The vote was unanimous.
Commissioner Chandler-Henry moved to adjourn as the Eagle County Board of County Commissioners
and reconvene as the Eagle County Housing and Development Authority.
Commissioner Scherr seconded the motion. The vote was unanimous.
Eagle County Housing and Development Authority
1. First Amendment to the Eagle County Housing and Development Authority Rental and Occupancy Covenant
(Spring Creek)

Executive Summary:
The developer of the Spring Creek Apartments has asked the Eagle County Housing and Development Authority
("ECHDA")to amend its partnership documents to increase the number of units subject to a property tax
exemption. Additionally, it has requested that ECHDA consents to a change in the owner's Operating Agreement.
Ms. Klosterman stated that the item before the board would amend the rental covenant and operating
agreement related to Spring Creek II in Gypsum. Spring Creek II had a total of 282 units in Phase One. The
Housing Authority was a partner in the property. The agreements were negotiated in 2019 and 2020, and much
had changed since then. The developer requested an amendment to the operating covenant to extend the
affordability of income limits. All rents would be restricted to 80 AMI(Area Median Income). The agreement
would be perpetual.
Tracy Walters with Polar Star Properties explained the reasoning behind the proposed income limit
changes. It was noticed that in most cases any household that had two teachers could not qualify for the units that
were leased. He believed the amendment would eliminate the housing ga .`and allow for more people to qualify
for units. It was a challenge to find affordable workforce housing due to the workforce housing gap and free
market housing.
Ms. Klosterman explained the pros and cons.
Beth Oliver,Deputy Eagle County Attorney, stated that some language was added that the Housing
Authority would monitor compliance with the units that were at 150%AMI.
Commissioner Scherr wondered if the agreement could be amended as the market conditions changed.
Ms. Klosterman stated that it was amenable to react to market conditions.
Commissioner Chandler-Henry moved to approve the First Amendment to the Eagle County Housing
and Development Authority Rental and Occupancy Covenant(Spring Creek)
Commissioner Scherr seconded the motion. The vote was declared unanimous.
2. First Amendment to Addendum to Operating Agreement of Spring Creek II LLC

Executive Summary:

Work Session
1.Vail Children's Choir Update
Executive Summary: Brian Oliver Smith, Founder& Executive Director of the new Vail Children's Choir will share
with the Commissioners how the choir is already making music in the valley and some of their exciting plans and
visions for the choir in the future. Vail Children's Choir is an exciting new 501(3) (C) in the Valley,recently
nominated by VVP as new non-profit of the year, and is using music to help kids Climb Every Mountain. If time
allows, he'll even share some of their recent performance highlights.
