COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 92 - 4r0
APPROVAL OF PERMIT TO CONSTRUCT the EAGLE'S NEST SEWER LINE
to serve Portions of the VAIL SKI AREA,
IN ACCORDANCE WITH SECTION 6.04,
EAGLE COUNTY ADMINISTRATIVE REGULATIONS

WHEREAS, the Board of County Commissioners, in its capacity
as the Eagle County Permit Authority conducted a public hearing
on June 23, 1992, after publication and notice as required by

law, to consider an application submitted by Vail Associates,
Inc. ( "Applicant ") to conduct the following activity of state
interest:
Major extension of existing sewage treatment system

(hereinafter referred to as the "Application "); and
WHEREAS, the Board of County Commissioners considered all
the evidence, exhibits and arguments presented, including com-
e) ments from the Northwest Colorado Council of Governments, the
Colorado Division of Wildlife, the Office of the State Engineer,
the United States Forest Service, the Colorado Department of
-t`� Health, Water Quality Control and the Upper Eagle Valley Consoli-
U U dated Sanitation District.
WHEREFORE, based on the evidence presented at the hearing,
the Permit Authority makes the following findings with regard to
the Application:
1. This is not a proposal for a "new domestic water or
-�! sewage treatment system ": the development will utilize the
cs4 existing Vail sewage treatment plant.
JA 2. The proposed development does not conflict with the
approved Eagle County Master Plan and the Vail Comprehensive Plan
- or any Federal or State land use or water plans.

3. The proposed development will not adversely affect

'' either surface or subsurface water rights of upstream or down -

4. Area *community development and population trends
• demonstrate a need for this extension for wastewater collection
and treatment.
5. Appropriate easements can be obtained for the associ-
ated outfall sewer proposed in this application.
6. The benefits of the proposed sewer line outweigh any
losses of any natural resources or agricultural lands rendered
unavailable as a result of the project.
7. The proposed development will not decrease the quality
of peripheral downstream surface or subsurface water resources
below that designated by Colorado Water Quality Control Commis-
sion as established on May 22, 1979, and effective July 10, 1979,
or more stringent standards subsequently adopted, if non -point
source water pollution control techniques are properly
implemented.
8. The proposed development and its associated collector
system will not violate Federal or State air quality standards.
9. The proposed development will not significantly deteri-
orate aquatic habitats, marshlands and wetlands, groundwater
recharge areas, steeply sloping or unstable terrain, forest and
woodlands, critical wildlife habitat, big game migratory routes,
calving grounds, migratory ponds, nesting areas and the habitats
of rare and endangered species, public outdoor recreation areas,
and unique areas of geologic, historic or archaeological impor-
tance if the construction is in accordance with the application
submitted and the staff recommendations are implemented.
10. The proposed development will not significantly degrade
existing natural scenic characteristics, create blight, nor cause
other nuisance factors such as excessive noise or obnoxious
odors, if the construction is in accordance with the application
submitted and the staff recommendations are implemented.
11. The proposed development will not create an undue
financial burden on existing or future residents within the
development area and the source development area.
12. The development site of the proposed Eagle's Nest Sewer
Line is not subject to significant risk from earthquakes, floods,
fires, snowslides, landslides, avalanches, rock slides or other
disasters which could cause a system operation breakdown.
13. The construction of structures, buildings, and improve-
ments associated with the proposed development will not sig-
nificantly impact existing or proposed communities within the
development area and source development area.
NOW, THEREF•, BE IT RESOLVED BY THE •RD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the permit to construct the Eagle's Nest Sewer Line in
accordance with the Eagle County Administrative Regulations,
Section 6.04, "Major Extensions of Existing Domestic Sewage
Treatment Systems" be approved.
THAT, the Board hereby finds, determines and declares that
this Resolution is necessary for the health, safety and welfare
of the citizens of Eagle County.
MOVED, READ AND ADOPTED by the Board of County Commissioners
of the County o Eagle, State of Colorado, at its regular meeting
