Denial of Subdivision Sketch Plan • • Commissioner C�7 l'� moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO AO/ RESOLUTION NO. 92- I74 �J ,\ DENIAL OF THE SUBDIVISION SKETCH PLAN FILE NO. SU- 294 -90 -S WHEREAS, on or about September 4, 1990, the County of Eagle, U State of Colorado, accepted for filing an application submitted o by I -Plan, Inc. for William Hutzley and Jim Holten (hereinafter "Applicant ") for approval of the Subdivision Sketch Plan for Ruedi Creek Ranch, File No. SU- 294 -90 -S; and, an WHEREAS, the Applicant requested the approval of a Subdivision Sketch Plan which would allow for the development as W follows: The subdivision of 35 lots on 255 acres and as more • o specifically described in Eagle County File No. SU- 294 -90 -S; and, WHEREAS, notice of the Sketch Plan was given to all proper agencies and departments as required by the Eagle County Land Use Regulations, Section 2.17.02(1); and, o WHEREAS, at its public hearings held on October 18, 1990, December 6, 1990 and December 20, 1990, the Planning Commission, based upon its findings, recommended denial of the proposed Subdivision Sketch Plan; and LLI WHEREAS, at its regular hearings of January 8, 1991, March 5, 1991 and March 12, 1991, the Eagle County Board of Commissioners (hereinafter "Board "), considered the Subdivision ,z Sketch Plan, associated plans, and the statements and concerns of �.� the Applicant, the Eagle County Community Development and C Engineering staff, and other interested persons. r,E BASED ON THE EVIDENCE BEFORE IT THE BOARD FINDS AS FOLLOWS: w 1. The proposed Sketch Plan is not in conformance with the o Master Plan, policies, guidelines, zoning P � g g and other r `--+ applicable regulations. 1 --3 t�..s 2. The land included in the proposed Sketch Plan is not cpci- suitable for subdivision, primarily due to wildlife w impacts, road impacts, soils and geological concerns. 3. Comments and recommendations from the agencies listed .<; in Eagle County Land Use Regulations, Section Qi 2.17.02(1), have been considered. 41 • 4. The evidence shows that access which is capable of servicing the development from the state highway system to the parcel of land proposed for subdivision cannot be built by the Applicant to meet applicable County standards NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the application for approval of the Subdivision Sketch Plan for Ruedi Creek Ranch Sketch Plan be and is hereby denied. THE BOARD further finds, determines and declares that this Resolution is necessary for the health, safety and welfare of the inhabitants of the County of Eagle, State of Colorado.
