RESOLUTION
OF THE
WHEREAS, a public hearing was held by the Board of County
Commissioners of the County of Eagle, State of Colorado, on
September 10, 1991; and
WHEREAS, based on the evidence, testimony, exhibits, study
comments of the Eagle County Department of Community Development,
comments of public officials and agencies, the recommendation of
the Eagle and Colorado Valley Planning Commission, and comments
from all interested parties, the Board of County Commissioners of
the County of Eagle, State of Colorado, finds as follows:
1. That an environmental impact statement is not
required.
2. That information required by the Board of County
Commissioners at Sketch Plan is applicable.
3. That the proposed PUD control document is
satisfactory as amended (see Exhibit A attached).
4. That an appropriate zone change application has
been received.
5. That the proposed rezoning is consistent with the
Master Plan.
6. That the area in question possesses the
geological, physical and other environmental
conditions compatible with the characteristics of
the use requested.

DEVELOPMENT PRELIMINARY PLAN

WHEREAS, on
or about July 1, 1991, the County of Eagle, State
of Colorado,
accepted for filing an application submitted by
I -Plan, Inc.
on behalf of William Donlon (hereinafter
"Applicant ")
for approval of the Preliminary Plan of the Donlon
Ranch Planned
Unit Development, File No. PD- 300 -91 -P; and
WHEREAS, a public hearing was held by the Board of County
Commissioners of the County of Eagle, State of Colorado, on
September 10, 1991; and
WHEREAS, based on the evidence, testimony, exhibits, study
comments of the Eagle County Department of Community Development,
comments of public officials and agencies, the recommendation of
the Eagle and Colorado Valley Planning Commission, and comments
from all interested parties, the Board of County Commissioners of
the County of Eagle, State of Colorado, finds as follows:

7. That the advantages of the use requested outweigh
the disadvantages.
8. That the area for which the rezoning is
requested has changed or is changing to such a
degree that it is in the public interest to
encourage a new use or density in the area.
9. That for the above stated reasons, the proposed
rezoning is in the best interest of the health,
safety, convenience, order, prosperity, and
welfare of the citizens of Eagle County, Colorado.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of the County of Eagle, State of Colorado:
THAT the application submitted by I -Plan, Inc., for
William Donlon for a Preliminary Plan of the Donlon Ranch
Planned Unit Development for the following described parcel of
land:

be and is hereby granted with the following conditions:
1. The "domestic well" permit should be exchanged for up
to 3 household use only well permits. This should be
done prior to issuance of a building permit and is
intended to avoid impacts due to water line
construction and well operation and maintenance
problems.
2. All disturbed areas must be revegetated, including the
County Right of Way, prior to Final Plat application or
collateral will be required.
3. An easement must be described in the Final Plat for the
irrigation ditch that traverses the South end of parcel
A.
4. A plat note must state that the individual sewage
disposal systems must be designed by a Registered
Professional Engineer.
5. This approval is for one single family dwelling on each
parcel. The caretaker unit has been denied. The PUD
Guide must be amended to reflect this approval.
6. The building envelope for parcel B shall be further
reduced and placed in the tree cover to minimize the
encroachment into the open meadow. The revised
building envelope shall be reviewed with the Final
Plat.

THAT the Board of County Commissioners directs the
Department of Community Development to enter this amendment on
the appropriate page(s) of the Official District Map and record
the change in the Office of the Eagle County Clerk and Recorder.

a) Agricultural including farm, garden, greenhouse, nursery.,
orchard, woodlot, and customary accessory uses including
buildings for shelter enclosure of animals or property
accessory to the use of the lot for residential
and fences, hedges, walls, and similar landscape features•
Livestock grazing shall be limited to four horses or equal
on each lot and will be confined to fenced corrals not to
exceed 25,000 square feet and not to encroach onto the 50
foot high water mark setback. Dogs must be kept in kennels
or in fenced yard.

MINIMUM SETBACKS
All dwellings and accessory buildings shall be located within the
building envelopes.
MAXIMUM BUILDING HEIGHT: 35 Feet

The open space areas (outside the building envelopes) shall serve
the purpose of providing park, agricultural, recreation or
conservation opportunities. Construction within open space is
limited to foot paths, bridges, irrigation structures, erosion
protection devices, utilities and outdoor recreation facilities,
including corrals for livestock, picnic areas and gazebos.
