HomeMy WebLinkAboutR92-159 amendment to Streamside PUD PD-105-90-AN fl D Commissioner`; moved adoption of the following Resolution: RESOLUTION OF THE COUNTY OF EAGLE, STATE OF COLORADO C'J RESOLIITION NO. 92-- 45 APPROVAL OF AMENDMENT OF THE STREAMSIDE AT VAIL PLANNED UNIT DEVELOPMENT FILE NO. PD- 105 -90 -A WHEREAS, on or about April 16, 1990, the County of Eagle, State of Colorado, accepted for filing an application submitted by Marriott Ownership Resorts, Inc. (hereinafter "Applicant ") for amendment of the Streamside at Vail Planned Unit Development, Eagle County, Colorado (hereinafter the "PUD"), File No. PD- 105 -90 -A; and WHEREAS, the Applicant requested the amendment of the PUD for the purposes of: a. Modifying the "Evergreen Building" envelope; b. Reducing the number of units from 54 to 39 in the Evergreen Building; C. Reducing the total parking requirement of Streamside from 304 to 300 spaces; and WHEREAS, notice of the proposed amendment was mailed to all owners of property located within and adjacent to the PUD and was duly published in a newspaper of general circulation throughout the County concerning the subject matter of the application and setting forth the dates and times of hearings for consideration of the application by the Planning Commission and the Board of County Commissioners of County of Eagle, State of Colorado (hereinafter the "Board "); and WHEREAS, at its public meeting held June 6, 1990, the Planning Commission, based upon its findings, recommended approval of the proposed PUD Amendment; and J9t bOO 3-5•x4 P-505 11:''1 �,'':;�� 16:41 PG 1 OF .S P% EC DOC: J� °NaNETTE PN_ZLLIP:: EAL-LE COUNTY CLERK, COLORADO 0.00 0,00 WHEREAS, at its public meeting hearing of June 18, 1990, the Board considered the PUD Amendment application, associated plans and the statements and concerns of the Applicant and the Eagle County staff. Based on the evidence, testimony, exhibits, review of the Eagle County Master Plan, the recommendation of the Planning Commission and staff, and comments from all interested parties, the Board finds as follows: 1. The proposed amendment to the Streamside at Vail Planned Unit Development is consistent with the efficient development and preservation of the entire PUD. 2. The proposed amendment does not affect in a substantially adverse manner either the enjoyment of the land abutting upon or across the street from the PUD or the public interest. 3. The proposed amendment shall not solely confer a special benefit upon any person. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the application submitted by Marriott Ownership Resorts, Inc. for amendment of the Streamside at Vail Planned Unit Development be and is hereby granted subject to the following conditions: 1. No woodburning devices will be allowed in individual units or in the common area of the Evergreen Building. 2. The outdoor firepit is limited to open fires between May 1st and November 1st. 3. A filter fabric construction fence be in place between the construction area and the Gore Creek during construction activity. 4. Prior to the issuance of any building permit, a geotechnical report with specific foundation recommendations must be submitted to the County for review. The Board finds, determines, and declares that this Resolution is necessary for the health, safety, and welfare of the inhabitants of the County of Eagle, State of Colorado.
