of the following Resolution:
BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 92- 43 x? --
ESTABLISHING NEW RATES FOR THE EAGLE COUNTY LANDFILL
WHEREAS, the Board of County Commissioner of the County of Eagle,
State of Colorado (the "Board ") has determined that as nearly as
possible, the cost of operating the Eagle County Landfill should be paid
from user fees rather than taxes; and
WHEREAS, the Citizens of Eagle County have expressed their desire
to support a waste recycling program within Eagle County; and
WHEREAS, the Board has deemed it appropriate to generate funds for
future landfill mitigation and acquisition;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS
OF THE COUNTY OF EAGLE, STATE OF COLORADO:
1. That the rates for the use of the Eagle County Landfill be
established as follows:
Construction Debris
Trash ( Compacted or Loose)
Uncovered Load
Minimum Charge Per Load
Treated Sludge*
Tires:
Separated from normal trash
Not separated
$ 24.50
16.50 per ton
7.50 additional per load
4.50
19.25 per ton
3.75 per tire
4.50 per tire
*(when the Landfill Manager determines that suitable areas are
available for its disposal)
These rates shall include the charge of One Dollar ($1.00) per ton which
is paid quarterly to the Colorado Department of Health.
2. That no car bodies be accepted at any time at the Eagle County
Landfill.
3. That the fees to Senior Citizens (over 65 years) for dumping
their own domestic trash continue to be waived.
4. That no hazardous waste as defined in 40 C.F.R. 261 be
accepted at any time at the Eagle County Landfill.
5. That contaminated soil may be accepted subject to prior
approval and regulation by the Board of County Commissioners.
6. That any material from outside the County not be accepted
unless otherwise approved by the Board of County Commissioners.
7. That the Road and Bridge Supervisor be authorized to waive
landfill fees where he deems it appropriate for community clean -up days
or other civic efforts.
8. That the rates established by this resolution be effective
January 1, 1993, and the previous rates continue until that date.
9. That this Resolution is necessary for the health, safety and
welfare of the citizens of Eagle County, Colorado.
MOVED, READ AND ADOPTED by the Board of County Commissioners of the
Count f Eagle, State of Colorado, at its regular meeting held the
