BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 92 - / 41 Z
CONCERNING THE ASSIGNMENT OF ANY COUNTY HELD TAX LIEN UPON
PAYMENT OF THE CURRENT REDEMPTION PLUS THE ASSIGNMENT FEE
WHEREAS, the Eagle County has in its possession or under its
control certificates of puchase resulting from the sale of a tax
lien on real property, mobile homes and patented mining claims for
the nonpayment of general taxes; and
WHEREAS, pursuant to 39 -11 -122, C.R.S., Eagle County has the
right to sell, assign or transfer such certificates in such manner,
at such times and on such terms as may be determined by the Board
of County Commissioners; and
WHEREAS, the Treasurer of Eagle County desires to sell, assign
or transfer such certificates to any person who desires to purchase
said certificates; and
WHEREAS, the Eagle County Treasurer has a duty to collect all
general taxes, the sale, assignment or transfer of said
certificates of purchase would be in the County's interest.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, upon the recommendation of the Eagle County Treasurer,
any certificates of purchase in the County's possession or under
its control resulting from the sale of a tax lien on land for the
nonpayment of general taxes may by assigned, sold, or transfered
by the Eagle County Treasurer in a manner and at such time as she
deems fit provided said taxes are not in excess of $5,000.00.
THAT, the Eagle County Treasurer may sell, assign, and
deliver any such certificate to any person who desires to purchase
the same, upon payment to the EAgle County Treasurer of the amount
for which said tax lien was bid in by the Eagle County with
interest and costs acrued thereon from the date of the sale,
together with a fee for making such assignment, as provided in
section 30 -1 -102, and for the taxes assessed thereon since the date
of such sale provided said taxes are not in excess of five thousand
dollars ($5,000.00). or for such sum as the Eagle County Board of
Commissioners at any regular or special meeting may decide and
authorize.

HOWEVER, the Eagle County Treasurer shall not sell any
certificate of purchase issued upon any real estate upon which
taxes in excess of five thousand dollars ($5,000.00) are due unless
and until the sale of said certificate and the terms of said sale
are approved by the Eagle County Board of Commissioners after
notice of said proposed sale and the terms thereof have been
published in at least one issue of a newspaper published regularly
in Eagle County. Only then may the Eagle County Treasurer sell,
assign, and deliver any such certificate to any person who desires
to purchase the same, upon payment to the Eagle County Treasurer
of the amount for which said tax lien was bid in by the Eagle
County with interest and costs acrued thereon from the date of the
sale, together with a fee for making such assignment, as provided
in section 30 -1 -102, and for the taxes assessed thereon since the
date of such sale or for such sum as the Eagle County Board of
Commissioners at any regular or special meeting may decide and
authorize.
THAT, thereafter, the Treasurer shall execute and deliver such
instruments as may be necessary fully to convey all of the right,
title and interest of the Eagle County in or to such certificates.
MOVED, READ AND ADOPTED by the Board of County Commissioners
of the County Eagle, State of Colorado, at its regular meeting
held the _ 2 day of October, 1992.
