This being a scheduled Public Hearing,the following items were presented to the Board of County
Commissioners for their consideration:
Commissioner Updates
Commissioner McQueeney spoke about the progress being made on the affordability of healthcare.
There was a bill moving through the legislation right now that had bipartisan support and was being carried
locally by State House Representative Dylan Roberts and State Senator Kerry Donovan. Also,next Tuesday there
would be a parade for Mental Health Awareness Month. The group was meeting at 9:30 a.m. at Second Street
and Broadway for anyone wanting to participate.
Chairman Scherr mentioned that Commissioner Chandler-Henry was away on vacation. He also
mentioned that the Vail Symposium had kept their programming alive throughout this pandemic. The
programming had been virtual and free.
County Manager Updates
Jill Klosterman reminded everyone to be kind and empathetic with one another as things change,whether
it was with or without masks. The county's Five Star Program has closed. She thanked all the businesses that
participated. On another note, the county was collecting photos for the county's community engagement project.
People were invited to submit photos by going to visteagleco.com.
COVID-19 Update
Birch Barron,Eagle County Emergency Management Director and Heath Harmon,Eagle County Director
of Public Health, were present.
Mr. Barron shared what he hoped to be his final COVID update. He expressed excitement to present a
final update. The disease levels were continuing to drop. Of the people still getting infected, 84%were
unvaccinated, and 62%of the entire community had been vaccinated. There were still vaccine clinics going on
for younger age groups. He expressed appreciation for those willing to wear masks and asked that people support
one another moving forward.

Mr. Harmon expressed thanks to all the community members for their support during the last 15 months.
The county was now at the point of rescinding the public health order. The community had risen to the challenge,
and it was heartwarming to see everyone coming together. Rescinding the public health order did not mean the
virus was going to go away. The best pathway forward was to continue vaccinating. The situation would be
monitored and updates would be provided moving forward.

Commissioner McQueeney moved to approve the Consent Agenda for May 18, 2021, as presented.
Commissioner Scherr seconded the motion. Of the two voting Commissioners,the vote was declared
unanimous.

Business Items
1. Resolution 2021-029 Termination of the Eagle County COVID-19 Local Disaster Declaration
Rhea Siverkorn, Administration
Executive Summary: Eagle County Emergency Management proposes that the Eagle County Board of
Commissioners rescind the COVID-19 Local Disaster Emergency Declaration on May 27th, 2021. This date
will coincide with the revocation of Eagle County Public Health& Environment's COVID-19 Standing Public
Health Order. Emergency Public Health Orders and the Local Disaster Emergency Declaration have been
important administrative and policy tools to fight the spread of COVID-19 and increase access to state and
federal resources. As adoption of the COVID-19 vaccine increases, Eagle County is seeing a significant
decrease in the risk of severe disease and death from COVID-19 in our community. While this virus will still be
present in our county for some time,the proposed expiration of the Local Disaster Emergency recognizes that
emergency authorities are no longer necessary to protect the health and safety of Eagle County.

Commissioner McQueeney moved to terminate the Eagle County COVID-19 Local Disaster
Declaration.
Chairman Scherr seconded the motion. Of the two voting Commissioners,the vote was declared
unanimous.
Work Session - Eagle County Room
1. Arrowhead Roundabout Funding Discussion with the Arrowhead Board of Directors

Executive Summary: The Arrowhead Board of Directors would like to discuss the funding of the proposed
Arrowhead roundabout that will replace the existing access at Highway 6 and Arrowhead Drive. It is anticipated
that they will be requesting funding from Eagle County.
Planning Files - Eagle County Room
1. TABLING: LR-9147-2021 - Freedom Park Recycling Center
Ben Gerdes, Engineering Department
Executive Summary: We will table this file to June 1.
The proposal, submitted by Eagle County, is to create a recycling center in Edwards, CO for improved
sustainability, efficiency, and security. The proposal includes a fenced area, security infrastructure, one
cardboard compactor, one container for commingled containers, one for paper products, and one for compost.
Mr. Gerdes stated that the file would be tabled because public comment had been received between the
board and planning commissioner hearings, and staff wanted to have the full board present to hear the file.
Commissioner McQueeney moved to table file no. LR-9147-2021, Freedom Park Recycling Center
until June 1, 2021.
Chairman Scherr seconded the notion. Of the two voting Commissioners,the vote was declared
unanimous.
2. Kudel PUD Final Plat(aka Edwards Riverfront Estates) -PDF-9117
Steve O'Connor,Planning
Executive Summary: The applicant is seeking approval for the Kudel PUD Final Plat(aka Edwards Riverfront
Estates) a 1.455 +/- acre,4 lot residential PUD plat located at 35427 Highway 6, Edwards Area.
Mr. O'Connor presented the file. The subdivision improvements agreement would be reviewed
separately. At this time,no public comments had been filed. The PUD was approved in July of 2020. Staff
received the Final Plat application on August 31, 2020. The property was zoned Planned Unit Development

and was accessed by a private drive from US Highway 6. Mr. O'Connor indicated that the application was in
conformance with all the standards.
Beth Oliver, Deputy Eagle County Attorney spoke about the issues with the CDOT special use permit
and sidewalk. A condition (two)2 was added to address the issue.
Mr. O'Connor reviewed each of the standards and indicated that staff recommended approval with
conditions. The Final Plat was accompanied by the SIA(Subdivision and Off-Site Improvements Agreement).
Commissioner McQueeney moved to approve with conditions,the Edwards Riverfront Estates Final
Plat, Eagle County file no. PDF-91 17.
Chairman Scherr seconded the motion. Of the two voting Commissioners,the vote was declared
unanimous.
3. Subdivision and Off-Site Improvement Agreement for the Edwards Riverfront Estates Final Plat
Nicole Mosby, Engineering
Executive Summary: The Kudel PUD,which has been renamed to the Edwards Riverfront Estates,was
approved by the Board of County Commissioners on July 21,2020. The Final Plat for the Edwards River Front
Estates is scheduled for Board approval on May 18, 2021. In conjunction with the approval of the Final Plat,
the developer is required to enter into this Subdivision and Off-Site Improvements Agreement to govern the
construction of and collateralization of public improvements and landscape improvements for the PUD. The
developer has provided the required collateral for the public and landscape improvements in the form of a letter
of credit in the amount of$157,260.00
Beth Oliver,Deputy County Attorney provided some background. This file did not require any public
comment.
Commissioner McQueeney moved to approve the Off-Site Improvement Agreement for the Edwards
Riverfront Estates Final Plat.
Chairman Scherr seconded the motion. Of the two voting Commissioners,the vote was declared
unanimous.
