APPROVAL OF THE PLANNED UNIT DEVELOPMENT
SKETCH PLAN FOR COTTONWOOD
FILE NO. PD- 296 -90 -S
WHEREAS, on or about December 19, 1990, the County of Eagle,
State of Colorado, accepted for filing an application submitted
by Faith Partners (hereinafter "Applicant ") for approval of the
Planned Unit Development Sketch Plan for Cottonwood File
No. PD- 296 -90 -S; and,
WHEREAS, the Applicant requested the approval of a Planned
Unit Development (PUD) Sketch Plan which would allow for the
development as generally described in Exhibit A and more
specifically described in the Sketch Plan application; and,
WHEREAS, notice of the Sketch Plan was given to all proper
agencies and departments as required by the Eagle County Land Use
Regulations, Section 2.17.02(1); and,

WHEREAS, at its public hearings held on February 6, February
14, and February 20, 1991, the Planning Commission, based upon G
its findings, recommended approval of the proposed PUD Sketch
Plan, with certain conditions; and G _
WHEREAS, at its regular hearing of February 26, 1991, the
Eagle County Board of Commissioners (hereinafter "Board "),
considered the PUD Sketch Plan, associated plans, and the
statements and concerns of the Applicant, the Eagle County
Community Development and Engineering staff, and other interested
persons.
BASED ON THE EVIDENCE BEFORE IT, and with the modifications
imposed by the conditions hereinafter described, THE BOARD FINDS
AS FOLLOWS:
I
1. The proposed Sketch Plan is in conformance with the
Master Plan; to the extent applicable, with the Edwards
Sub -Area Plan; and with policies, guidelines, zoning
and other applicable regulations. Furthermore, the
resulting development will not be inconsistent with the
Master Plan objectives. Specifically with regard to
the Master Plan, the Board further finds the
development of this project as proposed:
a. to have a full range of public services available.
b. to have a significant economic determinant to the
Edwards area and to the County generally.
C. to have minimized any negative effects on the
social and natural environment.
d. to be capable of being phased in order to address
current and anticipated market conditions.
2. The land included in the proposed Sketch Plan is
suitable for subdivision.
3. Comments and recommendations from the agencies listed
in Eagle County,Land Use Regulations, Section
2.17.02(1), have been considered.
4. The evidence shows that access which is capable of
servicing the development from the state highway system
to the parcel of land proposed for subdivision can be
built by the Applicant.
5. The area around the development can be planned to be in
substantial harmony with the proposed PUD.
6. No adjacent and nearby communities will be
detrimentally affected by the proposed PUD.
7. The PUD can be completed within a reasonable period of
time, to be determined prior to final approval of the
PUD.
8. The proposed commercial development within the proposed
PUD is justified.

9. The streets, as proposed, are adequate to support the
anticipated traffic, and the development will not
overload the streets outside the planned area.
10. Proposed utility and drainage facilities, upon their
conformance to the conditions set forth herein, are
adequate for population densities and the type of
development proposed.
11. The employee /affordable housing plan is acceptable.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the application for approval of the Planned Unit
Development Sketch Plan for Cottonwood be and is hereby granted,
subject to compliance with the following conditions:
1. (a) Development area R -7
Development area R -7 should be changed to
open space.
(b) Development area R -9
The geographic area of R -9 shall be further
reduced and designated as open space. The
North boundary of R -9 shall be amended to
generally follow the existing power line
alignment. The density of R -9 shall be a
maximum of 10 dwelling units per acre.
(c) Development area R -10
The density of development area R -10 shall be
reduced to a maximum of 1 unit per acre. The
"knob" area shall be designated as open
space. Specific location of lot lines and
building envelopes shall be reviewed by the
Colorado Division of Wildlife.
(d) Development area R -11
The geographic area of R -11 shall be further
reduced and designated as open space along
the North boundary line. The density shall
be a maximum of 12 dwelling units per acre.

(e) Development Area R -12
The density of development area R -12 shall be
limited within the range of 250 units. The
following information shall be provided with
the Preliminary Plan:
1) phasing plan
2) visual impact analysis
3) architectural and landscape guidelines
including, but not necessarily limited
to:
- height limitations
-roof and siding materials
-color
4) provision of a multi - purpose trail
easement
5) dedicated public access to the river
6) on -site day care.and recreation
facilities
7) noise control /safety fence along the
railroad
8) an acceptable affordable /employee
housing proposal
2. Additional site specific wildlife mitigation shall
be developed by the applicants wildlife
consultant, reviewed by the Colorado Division of
Wildlife and submitted with the Preliminary Plan.
3. All utilities shall be underground.
4. The PUD guide shall include restrictions on
installation of wood burning devices that are
consistent with adopted wood burning regulations
and architectural /design guidelines that consider
visual quality.
5. Access to the National Forest shall be considered
at Preliminary Plan and consideration given to
public agency comment, specifically the Colorado
Division of Wildlife and the U.S. Forest Service.
6. A 1041 Permit for water and sewer line extensions
shall be required.
7. The golf course fairways along I -70 should be
designed to play East to West.
8. The site for the golf course maintenance facility
must be shown on the Preliminary Plan.
9. Bus stops and bike paths shall be designed into
the road system for the North and South Parcel.

10. The access road for the North parcel shall be
designed to a 30 MPH County Road Standard. Four
to six foot paved shoulders are required for a
bicycle path.
11. The Hillcrest Road bridge shall be upgraded to
provide access to parcel R -12 and evaluated to
determine feasibility of lane separation.
12. The applicant shall submit to the Department of
Community Development a revised sketch plan to
illustrate modifications as approved by Eagle
Board of County Commissioners.
13. Provide proof adequate water as requested by the
State Engineer in a letter to Eagle County dated
February 21, 1991.
14. Evaluate any potential conflicts with the proposed
Edwards reservoir.
THAT, the Sketch Plan submitted under this application and
hereby approved, does not constitute a "site specific development
plan" as that phrase is defined and used in C.R.S. Section
24 -68 -101, et seq. Sketch Plan approval is expressly conditioned
on the County's authority to impose further restrictions or
limitations on the PUD which are necessitated by impacts which
are not yet recognized or which are more severe than realized
under the review given at the hearings on the Sketch Plan.
THE BOARD further finds, determines and declares that this
Resolution is necessary for the health, safety and welfare of the
inhabitants of the County of Eagle, State of Colorado.
