HomeMy WebLinkAboutC21-233 Walking Mountains Science Center Climate Action Collaborative FIRST AMENDMENT TO AGREEMENT BETWEEN EAGLE COUNTY, COLORADO AND WALKING MOUNTAINS SCIENCE CENTER THIS FIRST AMENDMENT (“First Amendment”) is effective as of the first day of May, 2021 by and between Walking Mountains Science Center, a Colorado non-profit corporation (hereinafter “Consultant” or “Contractor”) and Eagle County, Colorado, a body corporate and politic (hereinafter “County”). RECITALS WHEREAS, County and Consultant entered into an agreement effective the first day of January, 2021, for certain Services (the “Original Agreement” C21-052); and WHEREAS, the Original Agreement contemplated that the Consultant would perform certain duties with compensation in an amount not to exceed $136,500; and WHEREAS, County and Consultant desire by this First Amendment to expand the scope of Services and compensation as set forth in the Original Agreement. FIRST AMENDMENT NOW THEREFORE, in consideration of the foregoing and the mutual rights and obligations as set forth below, the parties agree as follows: 1.The Original Agreement shall be amended to include additional Services as described in Exhibit A-1, which is attached hereto and incorporated herein by reference. 2. The compensation for the additional Services set forth in Exhibit A-1 shall not exceed an additional $35,574 and paragraph 5 shall be amended to describe the total maximum compensation under the Original Agreement and this First Amendment of $172,074. 3.Capitalized terms in this First Amendment will have the same meaning as in the Original Agreement. To the extent that the terms and provisions of the First Amendment conflict with, modify or supplement portions of the Original Agreement, the terms and provisions contained in this First Amendment shall govern and control the rights and obligations of the parties. 4.Except as expressly altered, modified and changed in this First Amendment, all terms and provisions of the Original Agreement shall remain in full force and effect, and are hereby ratified and confirmed in all respects as of the date hereof. 5. This First Amendment shall be binding on the parties hereto, their heirs, executors, successors, and assigns. Administrative support services are needed to serve the 30+ organization partners of the Climate Action Collaborative and deliver on our accelerated Climate Action Plan (CAP) goals. This need was identiied in 2020 but was not requested due to COVID-related budget concerns. Support services include facilitation of presentations and discussions, notes and documentation, project supports, education and outreach, and progress tracking and reporting for the seven community sector teams: Buildings, Waste, Energy Supply, Transportation, Water, Education and Outreach, and Local Governments. An additional sector team focused on Natural Climate Solutions is starting in 2021. Walking Mountains staff will work in 2021 to understand how the CAC partners can share the cost of additional CAC staff moving into 2022 and beyond. Support for Eagle County’s Community Development Department - 30 hours per month Main Point of Contact: Community Development Director with Support from Vance Gabossi, Chief Building Oficial. Task 1: Eagle County Building Resolution 2021 Amendment (the “Amendment”) Education: Description: The Amendment was initiated in 2020 by the Sustainable Communities Department based on guidance provided by the Eagle County Board of County Commissioners (the “BoCC”) as a irst step towards implementing the Climate Action Plan’s recommended greenhouse gas reduction targets for buildings. The Amendment includes adding requirements for building permits to meet Appendix U: Solar Readiness, Electric Building Power Supply, and an increase to snowmelt calculations to further decentivize the use of heated driveways. Electric vehicle charging readiness, although initially considered for this Amendment, is instead included in an amendment to the Eagle County Land Use Regulations (the “ECLUR”). The Amendment is still in draft form. Walking Mountains Science Center will provide educational support to assist in the seamless implementation of the Amendment as well as the future amendment to the ECLUR regarding electric vehicle readiness. Educational support will be in coordination with Eagle County Building Division, and include a variety of methods to help building permit applicants understand and comply with the Amendment. The Eagle County Building Division is expected to support this effort through product review, general guidance on deliverable implementation, and assisting with educational opportunity advertising. Deliverables & Deadlines: 1. Guidance Documents: a. Deliverable: Four “how to comply” guidance documents including a general Amendment overview, Solar Readiness, Electric Vehicle Charging Readiness, and DocuSign Envelope ID: D8593418-1EF3-4567-83BC-68DC5C8F218E Power Supply. Each document will have two rounds of review, if needed, prior to inalization. The guidance documents will be visually appealing and match Eagle County’s branding as requested by the Eagle County Communications Department. Walking Mountains Science Center and Eagle County to be jointly responsible for broad distribution as appropriate. Coaching support contact information to be included on each guidance document and direct customers to Walking Mountains Science Center. Coaching will occur on an as needed basis. b. Deadlines: i. First Drafts: July 2021 ii. Second Drafts: August 2021 iii. Final Drafts: September 2021 2. Training Events: a. Deliverable: Five recorded training events planned, facilitated and shared broadly by Walking Mountains Science Center. Training events may occur through the US Green Building Council local chapter events / training series or planned separately as appropriate. Walking Mountains Science Center will create the agenda, recruit speakers, and elicit Eagle County Building Division feedback on training topic needs. b. Deadline: Five training sessions over the contract term to be spread out appropriately to ensure high participation by the building community. Task 2: Assist with Eagle County Comprehensive Plan (the “Plan”) speciically for Climate and Resilience Drafting Support Description: As of April 2021, the Plan is still in the irst phase of development, the research and analysis phase. Walking Mountains Science Center will support the drafting of the Plan sections as they relate to the Climate Action and Resiliency Plans. Deliverables & Deadlines: 1. Comprehensive Plan Support: a. Deliverable: Help research, write and review various sections of the Plan focused on climate action and resilience. Requests for assistance may be generated from the Plan’s Project Lead or support staff. b. Deadline: Response within 5 working days of request on an ongoing and as needed basis during the contract term until the Plan is considered by the Planning Commission. Task 3: ECO Build Program Updates: Description : The ECO Build Eficient Building Code was developed by Eagle County staff in 2005 and became regulatory in September 2006. The intent was to encourage cost-effective sustainable building methods to create durable, energy eficient residential structures that conserve natural resources, promote the eficient use of building materials, and improve indoor air quality. Building permit applicants illed out a checklist that included sections on water conservation, recycling, EXHIBIT A-1 DocuSign Envelope ID: D8593418-1EF3-4567-83BC-68DC5C8F218E materials, energy, renewable energy, and innovations, and submitted along with the building permit application. County staff provided an on-site inspection to verify. Based on square feet of the structure, a number of points were required, or applicants could pay a fee in lieu. Over time the ECO Build checklist requirements were replaced by standard building code adoptions. The current ECO Build program is limited to calculation and collection of fees for exterior energy uses for snowmelt systems, pools, and hot tubs. Fees are exempted if renewable energy system(s) are installed on-site which generate the equivalent of 50% of the energy needed for the use. Eagle County Sustainable Communities staff is reviewing the ECO Build program to determine applicability, alignment with other efforts in the region, and next steps. Walking Mountains Science Center support is requested to support this effort through existing program evaluation, case study research and program recommendations. Deliverables & Deadlines: ECO Build Program Report 1. Eagle County ECO Build Program Evaluation: a. Deliverable: Assist, as directed by Eagle County Sustainable Community Department staff, with evaluation of existing ECO Build Program. The evaluation documentation will have two rounds of review, if needed, prior to inalization. This will act as the irst chapter of the ECO Build Program Report. b. Deadline: June 2021 2. Case Study Research: a. Deliverable: Research other energy offset and fee programs within the region and document indings in a brief but comprehensive report. The report will have two rounds of review, if needed, prior to inalization. This will act as the second chapter of the ECO Build Program Report. b. Deadline: July 2021 3. ECO Build Program Recommendations: a.Deliverable : Provide recommendations for the next phase of ECO Build program to align with CAP goals based on evaluation, case study research, and any other information collected during the process. The recommendations will have two rounds of review, if needed, prior to inalization. This will act as the third and inal chapter of the ECO Build Program Report. b.
