This being a scheduled Public Hearing,the following items were presented to the Board of County
Commissioners for their consideration:
Commissioner Updates
Commissioner Scherr reminded local business owners who had struggled through COVID restrictions to
look into the Bridge Grant Program.
Commissioner McQueeney spoke about the importance of celebrating the New Year safely. She recognized
the efforts of those working so hard in the resort community to keep people safe.
Chairman Chandler-Henry thanked the snow plow drivers on this heavy snow day for keeping the roads
safe. She also thanked the search and rescue teams,and reminded everyone that backcountry skiing was extremely
unsafe right now.
County Manager Updates
Jeff Shroll thanked Jill Klosterman,Eagle County Finance Director and Kelley Collier,Deputy County
Manager for the amazing amount of work they'd done in the last week or so getting the Bridge Grant ready and the
checks out the door. He also thanked the CMC faculty for their help on the grant process.
COVID49 Update
Heath Harrmon spoke about the new range goals. Vaccinations were essential to keep moving towards
cutting the disease spread. This was the third week in the vaccine introduction. He reviewed the vaccine phasing
plan. Next week there would be a second dose implemented. He acknowledged that the vaccine plan was a work
in progress. The county would continue to provide updates,and tracking tools would be available on the county
website by the end of the week. He thanked Vail Health for their work in implementing the first round of vaccines.
The goal was to get the vaccines to the local healthcare providers.

Commissioner McQueeney moved to approve the Consent Agenda for December 29,2020,as presented.
Commissioner Scherr seconded the motion. The vote was declared unanimous.

1. Resolution 2020-101 Amended Annual Appointments to the Mental Health Advisory Committee
Kim Goodrich,Public Health and Environment
Executive Summary:Chris Montera, formerly the CEO of Eagle County Paramedics resigned his appointment
on the Mental Health Advisory Committee upon accepting a position out of state.Jim Bradford,the new COO
and CEO of Eagle County,was asked by the current MHAC members to fulfill the remainder of this term and
graciously agreed to serve on behalf of the Emergency Services community.

Commissioner Scherr moved to approve the resolution amending the Annual Appointments to the
Mental Health Advisory Committee.
Commissioner McQueeney seconded the motion. The vote was declared unanimous.
2. Resolution 2020-102 Concerning an Appointment to the Eagle Valley Library District Board of Trustees
Executive Summary:This resolution appoints Kim Nelson to another five year term on the Eagle Valley Library
Board of Trustees.
Commissioner McQueeney moved to approve the Resolution concerning the appointment to the Eagle
Valley Library District Board of Trustees.
Commissioner Scherr seconded the motion. The vote was declared unanimous.
3.The Board of County Commissioners will meet as necessary to review and take action on any issues related to
the COVID-19 Local Disaster Emergency.
Chairman Chandler-Henry stated that there was nothing before the board to consider.

Planning File
1.Minor Type B Subdivision Applications- 185 Elk Track Rd-SMB-9121-2020 and SMB-9127-2020

Executive Summary: Two files will be heard during this hearing. Both files occur at 185 Elk Tract Road. If
approved,the plats will be recorded simultaneously. The first application is SMB-9121-2020.The purpose of this
application is to subdivide Lot 1 into Lot A, Lot D, and a future development area.The second application is
SMB-9127.The purpose of this application is to re-subdivide Lot A into Lot A, Lot B,and Lot C.
Morgan Landers, Eagle County Community Development Director presented the application. Gregory
Perkins,attorney for the applicant,Tambi Katieb,Julie Pranger,and Holly Strablizky were present via Google Chat.
Staff had not received any public comment as of today. There were three(3)standards of approval and she
indicated that all the standards have been met. Staff recommended approval of the files.
Tambi Katieb,Land Planning Collaborative, Inc. presented a PowerPoint presentation. He stated that it was
a ski in and ski out property. He spoke about the character of the project.
Commissioner Scherr asked about the building that was on the site.
Mr. Katieb stated that the structure was demolished.

Commissioner Scherr wondered about the limit for three.
Ms. Strablizky, Eagle County Attorney,stated that this was an arbitrary number. Three was determined to
be the threshold in 1999. It may be something to consider moving forward in the newer version of the code.
Ms. Landers stated that this was a standard way of subdividing the property.
Julie Pratter, Eagle County Staff Engineer,stated that the Beaver Creek PUD guide indicated that there was
a 25 ft. stream set back. There was a bit of discrepancy between the PUD guide and the plat because of the way the
plat was worded. Staff made the determination that plat was more restrictive than the PUD guide and would be
carried forward.
Commissioner McQueeney wondered if this was more of an administrative decision as the building had
already begun.
Ms. Landers stated that typically minor type B subdivision,per the land use regulations,must be approved
by the BoCC. Because individual lots were being created,the method required a public process and approval by
the board.
Chairman Chandler-Henry wondered if the lot line allowed the structures to be sold individually.
Ms. Landers indicated that that was correct.
Chairman Chandler-Henry opened and closed public comment,as there was none.
Commissioner McQueeney moved to approve the File No. SMB-9121-2020,incorporating staff's findings,
because the application meets the standards for approval of a Minor Type B Subdivision.
Commissioner Scherr seconded the motion. The vote was declared unanimous.
Commissioner Scherr moved to approve the File No.MB-9127-2020,incorporating staff's findings,
because the application meets the standards for approval of a Minor Type B Subdivision.
Commissioner McQueeney seconded the motion. The vote was declared unanimous.
