DocuSignEnvelopeID:D52C36C6-AB63-4B01-B2E2-D50A98B92A13PUDGuidefor10AcrePUD,Feb.20211.IntroductionThisPlannedUnitDevelopmentGuide(“Guide”,“PUDGuide”or“DevelopmentGuide”)setsforththelanduseanddevelopmentstandardsforthepropertiesinthe10AcrePlannedUnitDevelopment(“PUD”).TheGuidedefinesthepermitteduseoflandandprovidesforopenspacesandincludesadditionalsupplementaryregulations.2.Purpose;EffectTheprimarypurposeofthisGuideistoestablishthestandards,restrictions,andregulationsthatgoverndevelopmentandlandusewithinthePUDasshownon10AcrePUDfinalPlat.ItalsoensuresthePUDisdevelopedasacomprehensiveplannedcommunity.ThisGuidewillensuretheorderlyandcompatibledevelopmentofthe10AcrePUD.TheGuideconstitutesthestandardzoningprovisionsforthePUDwithsite-specificrestrictionsforthedevelopmentplanandconditionsofthelandcontainedwithinthisdevelopment.TheprovisionsoftheEagleCountyLandUseRegulations(ECLUR)andthesuccessorsthereof,arebythisreferenceincorporatedhereinasifsetforthinfull,totheextentnotinconflictwiththeprovisionsofthisPUDGuide.Notwithstandingtheforegoing,intheeventofaconflictbetweentheECLURandthisPUDGuide,theprovisionsofthisPUDGuide,asamended,shallprevailandgovernthedevelopmentof10AcrePlannedUnitDevelopmentprovided,however,thatwheretheprovisionsofthisPUDGuidedonotclearlyaddressaspecificsubject,theordinances,resolutionsorregulationsofEagleCountyshallprevail.DefinitionsandusesestablishedhereinshalltakeprecedenceoverdefinitionsandusesestablishedintheECLUR,asamended,wheneverexpresslyprovidedforherein.ThisPUDGuideisauthorizedpursuanttoEagleCountyResolutiondated2/23/2021approvingthefinalPlatforthe10AcrePUD.3.GeneralInformationThePUDiscomprisedof9.79acresand5Lots.The“Uses”sectionpermitsoneSinglefamilyDwellingperLot.AllbutoneLotisallowedoneAccessoryDwellingUnitthereforethisPUDmayhaveupto9dwellingunits.AcreagesareindicatedbelowinTable1:4 DocuSignEnvelopeID:D52C36C6-AB63-4B01-B2E2-D50A98B92A13PUDGuidefor10AcrePUD,feb.202110.FencesAllnewinstallationoffencesshaltconformtothefottowingrequirements:•AllfencesexceptExclusionFencesandPrivacyfencesshattberequiredtomeetthewiLdlifefriendlyfencingguidelinesofCotoradoParksandWildlife.•Fencingmaynotenclosemorethan33%oftheLotareaexceptforfencingconformingtowildlifefriendlyfencingguidelinesofColoradoParksandWildlife.•Privacyfencesmaynotexceed60totatlinearfeetinanyonedirection.•PrivacyFencesmayonlybelocatedwithinBuildingEnvelopes.•DrainageeasementsshallbefreeofExclusionfences.•Allfencesmustbe8ftorlessinheight.•fencesshallnotbeconstructedwithininfiltrationordetentionpondsortheirembankments.Fencesshallnotbeconstructedinalocationormannertointerferewiththefunctionofutilitiesanddrainageorimpedeaccesstosuchfeaturesandtheirassociatedeasements.Asplitrailfence,orotherfenceofruralcharacter,shallbeprovidedalongWillitsLanethatpreventspedestrianscrossingatlocationsotherthanatMeadowDrive.11.Sustainability11.1RenewableEnergySystemAllSinglefamilyDwellingsshallfulfilloneofthefollowing,whichareaboveandbeyondECLURrequirements:1.Provideanon-siterenewableenergysystemthatoffsets50%ormoreofitsenergyuse.2.AchieveaHomeEnergyRatingSystem(HERS)Indexof3lorless.3.AchieveaHERSIndexof45andinstallaphotovoltaicsystemsizedatlesserofI)themaximumallowedbythelocalelectricutilityorii)1.5WattpersquarefootofFloorArea.ElectricvehiclechargersshallbeexcludedinthecalculationofsuchoffsetsandHERSIndices.Demonstrationofcompliancewiththerequirementsofthissectionshallbeprovidedatbuildingpermitapplication.14
