HomeMy WebLinkAboutMinutes 08/11/20 PUBLIC HEARING August 11, 2020 Present: Kathy Chandler-Henry Chairman Matt Scherr Commissioner Jeanne McQueeney Commissioner Kelley Collier Deputy County Manager Kathy Striver Deputy Clerk to the Board This being a scheduled Public Hearing,the following items were presented to the Board of County Commissioners for their consideration: Commissioner Updates Chairman Chandler-Henry stated that due to the Grizzly Creek Fire,the planning file scheduled to be heard in El Jebel this afternoon would be tabled. The work session planned for the Roaring Fork Valley would be done virtually. Commissioner McQueeney spoke about an electronic recycling company in Basalt. The company specialized in providing job opportunities for disabled people who were often overlooked by businesses. A majority of the company's workers were on the autism spectrum. She believed it was a good business model and a good resource for the area. Commissioner Scherr reminded people about the 2020 Census and stated that the county's response was still low. He reiterated the importance of everyone's participation. Chairman Chandler-Henry thanked all of the firefighting crews battling the Grizzly Creek Fire. County Manager Updates Kelley Collier,Deputy County Manager,spoke about the air quality and the monitoring system in place. Residents could view the results at www.purpleair.com. There would be public health alerts based on the air quality as it continued to decline throughout the day. She also reminded folks that there were some temporary employment positions open at the county and encouraged people to explore the positions on the county's website. COVID-19 Update Birch Barron stated that it had been a busy week. The COVID-19 risk level had been updated to `Cautious."Disease spread remained high. There were 118 cases reported in the last two weeks. The severity of the cases remained low. There were still hot spots throughout the U.S.The positivity rate in Texas remained high. The number of new cases in the community remained high,but there had been a significant decrease in the past seven days. Moving the indicator to yellow would require a reduction in cases to 96 or lower. He was optimistic that the community could rebound,however,there were still people in the community that tested positive who were not willing to work with Public Health. The school system used the meter system and decided that based on the recent decline in cases,they would start the school year. Chairman Chandler-Henry asked about the meter and how often the meter was updated. Mr.Barron stated that the meter was updated on Sunday night and again on Monday. Becky Larson had been updating the meter remotely. 1 08/11/2020 Commissioner McQueeney believed the meter was helpful,and it was important for people to understand which events caused the meter to change. Mr.Barron stated that the meter changed due to severity,test turnaround times,and positivity cases. Chairman Chandler-Henry believed people were paying close attention. Mr.Barron provided an update on the Grizzly Creek fire.The fire was not under control and would likely move up into the flat tops and continue to spread. On a positive note,the fire was not moving towards structures. The traffic delays were significant. I-70 was still closed and CDOT was recommending that drivers not use Cottonwood Pass. The smoke density was high,and he encouraged people to stay indoors to avoid the poor air quality. Constituent Input Chairman Chandler-Henry opened and closed constituent input,as there was none. Business Items 1. Resolution 2020-055 to Approve Format of the 2020 General Election Intergovernmental Agreement (IGA)and Allow Clerk&Recorder to Sign IGA Regina O'Brien,Clerk&Recorder Executive Summary: The Clerk and Recorder serves as the Designated Election Official for the November 3, 2020 General Election. The Clerk must enter into an intergovernmental agreement(1GA)with a political subdivision wishing to participate in the General Election.This Resolution approves the format of the 2020 General Election IGA and authorizes the Clerk to sign the agreement after approval and execution by a participating political subdivision. Ms. O'Brien explained the reason for the resolution. She encouraged people to check their voter registration at www.govotecolorado.gov for accuracy. If anyone had questions and/or had any address changes,the election team was available to help. Commissioner McQueeney moved to approve the resolution to approve the format of the 2020 General Election Intergovernmental Agreement(IGA)and allow the Clerk& Recorder to sign the 1GA. Commissioner Scherr seconded the motion. The vote was declared unanimous. 2. The Board of County Commissioners will meet as necessary to review and take action on any issues related to the COVID-19 Local Disaster Emergency. There were no items to consider. Commissioner Scherr moved to adjourn as the Eagle County Board of County Commissioners and reconvene as the Eagle County Housing and Development Authority. Commissioner McQueeney seconded the motion. The vote was declared unanimous. Eagle County Housing and Development Authority 1. First Amendment to Agreement Between Lake Creek Village LLC and LKSM Design Architecture Daniel Murry,Housing 2 08/11/2020 Executive Summary: In 2019,we began working with LKSM Design Architecture on a Recycling and Trash System upgrade at Lake Creek Village. Currently,there is only one trash site for recycling and garbage,along with a roll-off for large items. Due to the complexity of the solution,we are working in two phases and have decided to design multiple areas to have enclosures and additional receptacles. We will be building a second building on-site for recycling and trash,as well as a large enclosure for the roll-off for large items. This should reduce trash on property and enable our team to promote more recycling on property. Daniel Murry explained that the original project had expanded in size and therefore additional design implications. Commissioner McQueeney moved to approve the first amendment to the agreement between Lake Creek Village LLC and LKSM Design Architecture. Commissioner Scherr seconded the motion. The vote was declared unanimous. 2. 2020 OCAF Letter Riverview Apartments and HUD Rent Schedule Renewal Riverview Apartments Daniel Murry,Housing Executive Summary: Each year,HUD and Colorado Housing and Finance Authority(CHFA)set the rents at the Riverview Apartments. Riverview is a Project Based Section 8 complex that is subsidized by HUD. The increase in rents does not affect the resident rent and only affects the Housing Assistance Payment that is received monthly by HUD. This year the increase will be approximately$22,000 in additional Gross Potential Rent from HUD. Lastly,there typically is a change for a Utility Allowance which reduces rent so residents can pay utilities-For 2020-2021,the Utility Allowance remained constant per HUD. Daniel Murry stated that this document was simply a formality. Commissioner Scherr moved to approve the 2020 OCAF Letter Riverview Apartments and HUD Rent Schedule Renewal Riverview Apartments. Commissioner McQueeney seconded the motion. The vote was declared unanimous. Commissioner McQueeney moved to adjourn as the Eagle County Housing and Development Authority and reconvene as the Eagle County Air Terminal Corporation. Commissioner Scherr seconded the motion. The vote was declared unanimous. Eagle County Air Terminal Corporation 1. Agreement Between Thyssenkrupp Elevator Corporation and Eagle County Air Terminal Corporation for On-Call Escalator/Elevator Services Koltin Howard-Talbott,Airport Executive Summary: This agreement between ECAT and TKE is for on-call service and monthly preventative maintenance on ECAT's 2 elevators and 2 escalators. TKE will also be performing all required testing. These are newly installed devices at the airport and this routine service will allow them to continue operating smoothly to provide a better service to our community and passengers.TKE will respond to any outages that occur to the escalators/elevators to limit downtime. Commissioner Scherr moved to approve the agreement between Thyssenkrupp Elevator Corporation and Eagle County Air Terminal Corporation for On-Call Escalator/Elevator Services. Commissioner McQueeney seconded the motion. The vote was declared unanimous. 3 08/11/2020 Commissioner McQueeney moved to adjourn as the Eagle County Air Terminal Corporation and reconvene as the Eagle County Board of County Commissioners. Commissioner Scherr seconded the motion. The vote was declared unanimous. Work Sessions - Eagle County Room Review of the 3rd Supplemental Budget Executive Summary: BoCC will be reviewing the 3rd Supplemental request on August 11,2020 during the Manager update. Public Notice will be completed on August 13th,and the request for these additional Appropriations will be made in the August 18th public meeting. Demonstration of New Live-stream Platform for Public Hearings/Planning Files Executive Summary: In response to constituent input and Eagle County's continued desire to provide opportunities for public engagement while managing the COVID-19 pandemic,Eagle County announces an update to its public meeting and hearing procedures to include additional opportunities for live public comment.To help encourage this live public comment option,teach people how the new system works,and for Eagle County to have the opportunity to test and identify potential technological challenges our community members may have,we encourage folks to join the 11:30 a.m. work session on August 1 lth which will be televised on ecgtv.com and Channel 18 in the Eagle Valley. Planning File - El Jebel Building 1. 10 Acre PUD-PDSP-9012 and ZC-9017-Sketch/Preliminary Plan for Planned Unit Development and Zone Change(second reading) Morgan Landers,Planning DESCRIPTION: Eagle County has received an application for the 10 Acre PUD project in the Basalt Area.The applicant is proposing five single family lots with accessory dwelling units permitted on four of the lots.The application is for both a Sketch/Preliminary Plan for Planned Unit Development(PUD)and an application for a Zone Change from Resource to PUD.This hearing is the second of two hearings on this file,the first hearing was held on August 4,2020.The public comment attached to this agenda was comments received prior to the first hearing.New public comments received through the link below will be published to the website following the close of public comment on August 6,2020. Commissioner Scherr moved to table file until August 25th at 2 PM at the Community Center in El Jebel. Commissioner McQueeney seconded the motion. A New Regional Landlord-Tenant Recovery Fund Executive Summary: Mountain Voices Project would like to share the Landlord-Tenant Recovery(LTR)Fund concept with the BOCC with hopes of Eagle County participating as a referring partner and founder.
