r APPROVAL OF SPECIAL USE PERMIT

WHEREAS, Steven Pittel, doing business as Nova Guides, ( "Appli-
cant") did file an application with the Eagle County Department of
M G Community Development on or about May 16, 1991, for a Special Use
Permit for a recreational facility within a Resource Zone District, in
the unincorporated area of Eagle. County described as follows:

%0C WHEREAS, based on the evidence, testimony, exhibits, study of the
L Master Plan for the unincorporated areas of Eagle.County, comments of
'0 the Eagle County Department of Community Development, comments of
"' public officials and agencies, the recommendation of the Planning
NQ Commission, and comments from all interested parties, the Board of
County Commissioners of the County of Eagle, State of Colorado ( "the
M u-1 Board "), finds as follows:

C W 1. That proper publication and public notice was provided as
am required by law for the hearings before the Planning Commis-
NQ. sion and the Board.
2. That the proposed special use conforms to the requirements
tn 4 of Section 2.09 of the Eagle County Land Use Regulations,
T W which are incorporated herein as if set forth with particu-
m larity.

3. That the proposed special use will be compatible with exist-
ing uses in the area.

4. That the following have been considered: The potential
effect of the use on the character of the neighborhood,
adequacy of access to and from the area, appropriateness of
the physical arrangement of the use on the proposed site,
and consistency with the Master Plan.
5. - That for the above - stated and other reasons, the proposed
special use is in the best interest of the health, safety,
morals, convenience, order, prosperity and welfare of the
citizens of Eagle County.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
That the application of Steven Pittel, DBA Nova Guides, File No.
ZS- 309 -91, for approval of a Special Use Permit for a recreational
facility within the Resource Zone District described hereinabove, be
approved, subject to the conditions as set forth herein.
THAT, the following conditions shall be placed upon this approval
and that violation of any condition shall be the basis for revocation
of the Special Use Permit:
1. The permitted uses for the "recreation center" formerly
referred to as a lodge, shall be limited to 4,500 Sq. Ft. of
the following:
A. One restaurant with up to 50 seats. The restaurant is
intended to serve clients of Nova Guides and shall not
be open to the public. A water conservation plan shall
be prepared and approved by the Environmental Health
Officer prior to issuance of the Individual Sewage
Disposal System Permit.
B. Office space, lobby, educational facility, day care,
cross country ski facility, inside storage associated
with permitted uses.
2. The "recreation center" shall be located as indicated on the
site plan, "A Special Use Permit for Nova Guides" revised
December 8, 1991, shall be limited in height to 28 feet, and
shall be designed to fit the character of the area. Archi-
tectural drawings shall be reviewed by the Colorado Histori-
cal Society prior to submittal to Eagle County.
3. The site located between Highway 24 and the railroad tracks
shall be limited to storage associated with permitted uses
and outside storage that is screened and limited to 3000 Sq.
Rt. The site can be used as a shop /maintenance facility.
The facility shall be limited to 4,500 sq. ft. and shall be
a maximum of 28 feet high, and shall be earth tones with
non - reflective surfaces. The fuel storage tanks shall be
limited to 500 gallons and shall be placed inside a second-
ary containment structure capable of containing 110% of the
tank volume. The fuel storage and handling area shall be
roofed to minimize contaminant migration due to incidental
fuel releases. Appropriate precautions shall be taken to
minimize and mitigate fuel and oil spills.
4. The building permit application shall include details for
the parking lot construction, including but not necessarily
limited to the following:
A. Non -point source control prepared by Registered Profes-
sional Engineer or Architect.
B. Detailed Landscaping Plan

5. The applicant shall provide notice to the U.S. Army Corps of
Engineers prior to any construction and have the COE verify
the wetland boundaries.
6. An "Improvements Agreement" shall be in place prior to the
issuance of building permits or individual sewage disposal
permits. The "Improvements Agreement is required to collat-
eralize the following public improvements:
a. Access road
b. Landscaping
C. Water supply systems
d. Adequate sewage disposal systems, as determined by the
Environmental Health Officer
e. Screened storage area fencing
THAT, the Board of County Commissioners directs the Department of
community Development to provide a copy of this Resolution to the
applicant.
