HomeMy WebLinkAboutR92-067 full release of collateral for MoonridgeCommissioner (; �- 7--e-,; moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO 6 RESOLUTION NO. 92 - t ,7 AUTHORIZING THE FULL RELEASE OF COLLATERAL PROVIDED BY EAGLE II DEVELOPERS for MOONRIDGE SUBDIVISION WHEREAS, Pursuant to C.R.S. 30-28-137, the Board of County Commissioners of Eagle county, Colorado (hereinafter "the Board") did enter into a Subdivision Improvements Agreement with Eagle II Developers, for the construction of certain improvements related to Moonridge Subdivision as provided in said Agreement; and WHEREAS, to guarantee the construction of the improvements, Eagle II Developments provided collateral in the form of Irrevocable Letter of Credit No. 142, issued by First Bank of Eagle County in the amount of $24,085.00; and WHEREAS, Eagle II Developers has represented that the required improvements are complete, and that the facilities have been accepted as complete by the Edwards Metropolitan Water District and the Upper Eagle Valley consolidated sanitation District ("the Districts"); and WHEREAS, staff of the Eagle County Engineering Department has inspected the facilities, and recommends that the collateral be released in its entirety, inasmuch as the Districts have accepted the improvements as constructed. WHEREFORE, based on the recommendation of the Engineering Department, the Board hereby finds as follows: 1. That the improvements required by the Subdivision Improvements Agreement have been satisfactorily completed. 2. That said improvements have been accepted by the Districts pursuant to Exhibit "All attached hereto, and the Board no longer has an interest in the warranty of the work. THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the collateral provided by Eagle II Developers be and is hereby released in its entirety. THAT, the Board hereby finds, determines and declares that this Resolution is necessary for the health, safety and welfare of the citizens of Eagle County. of MOVED, READ AND ADOPTED by the Board of County Commissioners the County of Eagle, state of Colorado, at its regular meeting JW . Both ?districts will accept and maintain the newly installed main lines. Formal acceptance by both Boards is anticicapated within the next sixty (60) days.
