Commissioner moved adoption
of the following Resolution:
BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 92 -
APPROVAL OF PERMIT TO CONSTRUCT the NORTHWEST OUTFALL SEWER LINE
to serve Portions of the CORDILLERA DEVELOPMENT,
IN ACCORDANCE WITH SECTION 6.04,
EAGLE COUNTY ADMINISTRATIVE REGULATIONS
File No. 1041 - 012 -91
WHEREAS, the Board of County Commissioners, in its capacity
as the Eagle County Permit Authority, together with the Eagle and
Colorado Valley Planning Commission, conducted a joint public
hearing on November 12, 1991, after publication and notice as
required by law, to consider an application submitted by the
Upper Eagle Valley Consolidated Sanitation District ( "Applicant ")
to conduct the following activity of state interest:
Maj_r extension of existing sewage treatment system
(hereinafter referred to as the "Application "); and
WHEREAS, the matter was tabled to December 17, 1991, when
the Board of County Commissioners considered all the evidence,
exhibits and arguments presented, including comments from the
Northwest Colorado Council of Governments, the Colorado Division
of Wildlife, the Office of the State Engineer, and the Colorado
Geologic Survey.
WHEREFORE, based on the evidence presented at the hearing,
the Permit Authority makes the following findings with regard to
the Application:
1. This is not a proposal for a "new domestic water or
sewage treatment system ": the development will utilize the
existing Squaw Creek sewage treatment plant.
2. The proposed development does not conflict with the
approved Eagle County Master Plan and the Edwards Sub -Area Plan
or any Federal or State land use or water plans.
3. The proposed development will not adversely affect
either surface or subsurface water rights of upstream or down-
stream users.

4. Area and community development and population trends
demonstrate a need for this extension for wastewater collection
and treatment.
5. Appropriate easements can be obtained for the associ-
ated outfall sewer proposed in this application.
6. The benefits of the proposed sewer line outweigh any
losses of any natural resources or agricultural lands rendered
unavailable as a result of the project.
7. The proposed development will not decrease the quality
of peripheral downstream surface or subsurface water resources
below that designated by Colorado Water Quality Control Commis-
sion as established on May 22, 1979, and effective July 10, 1979,
or more stringent standards subsequently adopted, if non -point �-
source water pollution control techniques are properly ;
implemented. .�
8. The proposed development and its associated collector
system will not violate Federal or State air quality standards.
9. The proposed development will not significantly deteri-
orate aquatic habitats, marshlands and wetlands, groundwater
recharge areas, steeply sloping or unstable terrain, forest and
woodlands, critical wildlife habitat, big game migratory routes,
calving grounds, migratory ponds, nesting areas and the habitats
of rare and endangered species, public outdoor recreation areas,
and unique areas of geologic, historic or archaeological impor-
tance if the construction is in accordance with the application
submitted and the staff recommendations are implemented.
10. The proposed development will not significantly degrade
existing natural scenic characteristics, create blight, nor cause
other nuisance factors such as excessive noise or obnoxious
odors, if the construction is in accordance with the application
submitted and the staff recommendations are implemented.
11. The proposed development will not create an undue
financial burden on existing or future residents within the
development area and the source development area.
12. The development site of the proposed Northwest Outfall
Sewer Line is not subject to significant risk from earthquakes, -
floods, fires, snowslides, landslides, avalanches, rock slides or
other disasters which could cause a system operation breakdown.
13. The construction of structures, buildings, and improve-
ments associated with the proposed development will not sig-
nificantly impact existing or proposed communities within the
development area and source development area.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the permit to construct the Northwest Outfall Sewer
Line in accordance with the Eagle County Administrative Regula-
tions, Section 6.04, "Major Extensions of Existing Domestic
Sewage Treatment Systems" be approved, provided that the follow-
ing conditions are met:
1. The Northern Parcel development for Cordillera, as
proposed in the Preliminary Plan for Cordillera, shall first be
approved. If it is not approved, but the Village Center is
approved as proposed in the Preliminary Plan, alternative sewage
disposal options should be evaluated.
2. All disturbed areas shall be . reclaimed to prevent soil
erosion. Both temporary and long -term erosion control shall be
implemented. Cost estimates for erosion control shall be pre-
pared by a Registered Professional Engineer and submitted for
inclusion in a "Construction Improvements Agreement" prior to
construction.
3. The wildlife impacts associated with this permit shall
be evaluated by the "Cordillera Wildlife Enhancement Committee"
and mitigation shall be implemented.
THAT, the Board hereby finds, determines and declares that
this Resolution is necessary for the health, safety and welfare
of the citizens of Eagle County.
