RESOLUTION NO. 92 - - p�
APPROVAL OF PERMIT TO CONSTRUCT MAJOR EXTENSION of
SEWAGE TREATMENT SYSTEM to serve the CORDILLERA DEVELOPMENT,
IN ACCORDANCE WITH SECTION 6.04,
EAGLE _COUNTY ADMINISTRATIVE REGULATIONS
File No. 1041 - 017 -91
WHEREAS, the Board of County Commissioners, in its capacity
as the Eagle County Permit Authority, together with the Eagle and
Colorado Valley Planning Commission, conducted a joint public
hearing on December 17, 1991, after publication and notice as
required by law, to consider an application submitted by the
Upper Eagle Valley Consolidated Sanitation District ( "Applicant ")
to conduct the following activity of state interest:
Major extension of existi sewer treatment system
(hereinafter referred to as the "Application "); and
WHEREAS, the Application was tabled to January 7, 1992, at
which time the Board of County Commissioners, acting as the
Permit Authority, has considered all the evidence, exhibits and
arguments presented.
WHEREFORE, based on the evidence presented at the hearing,
the Permit Authority makes the following findings with regard to
the Application:
1. This is not a proposal for a "new domestic water or
sewage treatment system ": the development will utilize the
existing Squaw Creek sewage treatment plant.
2. The proposed development does not conflict with the
approved Eagle County Master Plan and the Edwards Sub -Area Plan
or any Federal or State land use or water plans.
3. The proposed development will not adversely affect
either surface or subsurface water rights of upstream or down-
stream users.
4. Area and community development and population trends
demonstrate a need for this extension for wastewater collection
and treatment.

5. Appropriate easements can be obtained for the construc-
tion of the proposed outfall sewer and interceptor sewer.
6. The benefits of the proposed sewer line outweigh any
losses of any natural resources or agricultural lands rendered
unavailable as a result of the project.
7. The proposed development will not decrease the quality
of peripheral downstream surface or subsurface water resources
below that designated by Colorado Water Quality Control Commis-
sion as established on May 22, 1979, and effective July 10, 1979
or more stringent standards subsequently adopted, if non -point
source water pollution control techniques are properly
implemented.
8. The proposed development and its associated collector
system will not violate Federal or State air quality standards.
9. The proposed development will not significantly deteri-
orate aquatic habitats, marshlands and wetlands, groundwater
recharge areas, steeply sloping or unstable terrain, forest and
woodlands, critical wildlife habitat, big game migratory routes,
calving grounds, migratory ponds, nesting areas -and the habitats
of rare and endangered species, public outdoor recreation areas,
and unique areas of geologic, historic or archaeological impor-
tance if the construction is in accordance with the application
submitted and the staff recommendations are implemented.
10. The proposed development will not significantly degrade
existing natural scenic characteristics, create blight, nor cause
other nuisance factors such as excessive noise or obnoxious
odors, if the construction is in accordance with the application
submitted and the staff recommendations are implemented.
11. The proposed development will not create an undue
financial burden on existing or future residents within the
development area and the source development area.
12. The development sites of the proposed outfall sewers
and interceptor sewer are not subject to significant risk from
earthquakes, floods, fires, snowslides, landslides, avalanches,
rock slides or other disasters which could cause a system opera-
tion breakdown.
13. The construction of structures, buildings, and improve-
ments associated with the proposed development will not sig-
nificantly impact existing or proposed communities within the
development area and source development area.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO, acting
as the Permit Authority:

THAT, the permit to construct an extension of a sewer line
from the Squaw Creek Wastewater Treatment Plant to serve Cordil-
lera developments as described in the Application is granted to
the Upper Eagle Valley Consolidated Sanitation District, subject
to the following conditions:
1. All construction activities located within elk or deer
winter range or winter concentration areas shall be constructed
between March 15 and December 15 of each construction year. All
construction activities located within wildlife movement cor-
ridors shall avoid the intervals from November 20 to December 15,
and March 20 to May 20 of each year.
2. Sewer line alignment must be located to avoid, to the
extent practicable, sensitive environmental areas such as wet-
lands, riparian corridors and critical wildlife areas.
3. All construction staging areas shall be designed to
contain incidental and accidental fuel and lubricant spills.
4. A complete assessment of service area commitments and
planned treatment expansion of the District must be submitted
when it is available, but not later than December 31, 1992.
5. An Eagle County Road Cut Permit shall be required prior
to construction in the County Right -of -Way.
6. All disturbed areas shall be reclaimed to prevent soil
erosion. Both temporary and long -term erosion control shall be
implemented. Cost estimates for erosion control shall be pre-
pared by a Registered Professional Engineer and submitted for
inclusion in a "Construction Improvements Agreement" prior to
construction.
7. The applicant shall require sufficient collateral from
the developers to insure completion of the phased construction of
the interceptor and outfall sewer lines prior to construction of
each phase.
THAT, the Board hereby finds, determines and declares that
this Resolution is necessary for the health, safety and welfare
of the citizens of Eagle County.
