BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 92 - T -'
REGARDING REIMBURSEMENT TO BUTTERS
FOR CERTIFICATE OF REDEMPTION
DUE TO INSUFFICIENT DESCRIPTION OF ASSESSED PROPERTY
WHEREAS, in 1986, the records of the Eagle County Treasurer
showed that real property taxes for a certain parcel of land
located near the Eagle County Fairgrounds were due and unpaid for
the tax year 1985; and
WHEREAS, at that time, Eagle County records erroneously
showed that this certain parcel of land was owned by James Craig
Butters and Maria Brunhilda Butters (hereinafter "Butters "), as
part of a parcel of land identified by Schedule Number 18655; and
WHEREAS, on or about November 18, 1986, the Eagle County
Treasurer sold at tax sale the taxes purported to be due and
unpaid; and
WHEREAS, C.R.S. 39 -11 -112, as amended, provides that a sale
of tax lien shall not be held invalid because charged on the roll
in the wrong name; however, said tax lien and land or lots in
other respects shall be sufficiently described on the tax roll to
identify the same; and
WHEREAS, the Treasurer has now determined that the subject
parcel is part of another parcel of land which is now owned by
Eagle County, and was therefore not sufficiently described on the
tax roll at the time of sale; and
WHEREAS, in 1989, BankWest, the Butters' mortgagee, redeemed
the tax lien described herein, believing it to be a lien against
the Butters' property; and
WHEREAS, in fairness to the taxpayer, the Eagle County
Treasurer recommends that the County reimburse Butters, who have
r- since paid off BankWest for the redemption of the tax lien.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, Eagle county shall reimburse the certificate of
redemption, in the following amounts:

THAT, reimbursement to the holder of the certificate of
redemption shall be made from the various funds to which the tax
was originally distributed; except that the interest shall be
paid from the County General Fund; and
THAT, the Eagle County Budget officer and the Eagle County
Treasurer are hereby directed to take all actions necessary to
effectuate this resolution.
MOVED, READ AND ADOPTED by the Board of County Commissioners
of the County of Eagle, State of Colorado, at its regular meeting
