BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO.2020-077
SIXTH EXTENSION OF THE EAGLE COUNTY
COVID-19 LOCAL DISASTER EMERGENCY
WHEREAS, on March 6, 2020,Eagle County Public Health and Environment
("ECPHE") confirmed its first case of COVID-19 within the county. Since that time,
Eagle County has seen over 1200 cases of the illness as well as 9 fatalities to date.
Federal, state, and local authorities continue to take action to address the emergency; and
WHEREAS,on March 6, 2020, pursuant to the authority delegated by the
Board of County Commissioners ("Board"), the Eagle County Manager declared a
COVID-19 Local Disaster Emergency("Declaration") because the cost and magnitude
of responding to and recovering from the impact of COVID-19 in the community is far
in excess of the county's available resources; and
WHEREAS,the Board has extended the Declaration five times previously, on
March 10, April 7, April 28, May 26, and June 30, 2020 because the conditions that
spurred the declaration have not abated; and
WHEREAS, Eagle County Public Health and the State of Colorado currently
have orders that remain in effect to provide for increased personal and business
activities but also to continue to address the ongoing transmission of COVID-19 within
Eagle County; and
WHEREAS,the Fifth Extension of the Declaration expires on September 30,
2020, and the Board is desirous of extending the Declaration until such time as
rescinded or otherwise modified by the Board; and
WHEREAS, pursuant to C.R.S. § 24-33.5-709(1), "[a] local disaster may be
declared only by the principal executive officer of a political subdivision. It shall not be
continued or renewed in excess seven days except by or with the consent of the
governing board of the political subdivision;"and
WHEREAS,the conditions that spurred the Declaration and five previous
extensions still continue to pose a serious threat to the health and safety of the citizens of
Eagle County; and
WHEREAS,pursuant to C.R.S. § 24-33.5-709(2), "[t]he effect of a declaration of
local disaster emergency is to activate the response and recovery aspects of any and all

applicable local and interjurisdictional disaster and emergency plans and to authorize the
furnishing of aid and assistance under such plans;" and
WHEREAS, extending the Declaration and continuing to operate under Eagle
County's emergency operations plan will allow a more effective response.
NOW,THEREFORE, BE IT RESOLVED by the Board:
THAT,the Board confirms, determines, and declares that the presence and high
likelihood of additional cases of the COVID-19 virus within Eagle County and the State or
Colorado constitute a local disaster emergency that warrants continuing the emergency
response and furnishing aid and assistance to affected portions of the community.
THAT,this Sixth Extension of the Declaration("Sixth Extension") is hereby
adopted, and the terms and conditions set forth in the original Declaration, inclusive of all
prior extensions,will continue until such time as rescinded or otherwise modified by the
Board.
THAT, this Sixth Extension shall be promptly filed with the Eagle County Clerk
and Recorder and with the Office of Emergency Management.
THAT,this Sixth Extension is necessary for the public health, safety and welfare
of the citizens of the County of Eagle, State of Colorado.
MOVED,READ AND ADOPTED by the Board of County Commissioners of the
County of Eagle, State of Colorado, at its regular meeting held September 29, 2020.
